- The owner, agent and manager of every mine shall ensure that-(a)the appliance, equipment, machinery or other material that are used or may be used in the mine are of sound construction and of a type and specification conforming to an Indian or international standard identified for the purpose:Provided that such appliance, equipment, machinery or other material shall not be used in the mine unless the same has been tested and passed the test as per the standard and the manager has kept a record of the type, details of specification, reference of the particular standard, test criteria in accordance with the standard and status of testing, place of testing, copies of test report and any other relevant details; and(b)the code of practice and standard operating procedure for appliance, equipment, machinery or other material are complied with.
