lokZsPp U;k;ky; }kjk ;g fu/kkZfjr fd;k x;k gS fd %& "when it is established that the persons belonging to marriage party were carrying in the vehicle in goods vehicle, it was clear cut violation of policy terms. Hence the insurer is not liable."
12- Royal Sundaram Alliance Insurance Company Ltd. Vs. Eshwar and others 2008 (5) M.P.H.T. 45 (CG) eas NRrhlx<+ mPp U;k;ky; }kjk ;g fu/kkZfjr fd;k x;k gS fd& // 7 // "6......... In United India Insurance Company Limited Vs. Smt. Rambai and others, Miscellaneous Appeal No.789 of 2006, decided on 7.7.2008, this Court has held that the deceased having travelled on the tractor could also not be termed as a third party so as to fasten statutory liability on the Insurance Company. By carrying the deceased on the engine of tractor a fundamental breach of the policy of insurance is established and, therefore, liabiity for payment of compensation could not be fastened on the Insurance Company. In National Insurance Co. Ltd. Vs. Bramaranbike and others, 2006 ACJ 671, the High Court of Karnatka has in similar situation held that the liability cannot be fastened on the Insurance Company in such a case. In New India Assurance Co. Ltd. Vs. Diwakar and others, 2006 (2) TAC 937 (Bom), the High Court of Bombay has also held that in a case case of death of a child aged 11 years travelling on the mudguard of the tractor the insurer not being statutorily required to insured passengers in a goods vehicle was not liable to pay compensation. In New India AssuranceCo. Ltd. Vs. Vedwati and others, Appal (Civil) No. 860/2007 [arising out of SLP (C) No.8317/2002] with Civil Appeal No. 861/2007 arising out of SLP (C) No.8802 / 2002] decided by the Supreme Court of India on 20-2-2007, it was held that carrying of passengers on a tractor is not contemplated by the Act. In other words, the Legislative intents seems to be prohibit carrying of any passenger on the tractor. The inevitable conclusion therefore, is that since the provisions of the Act do not enjoin any statutory liability on the owner of the vehicle to get the tractor insured for any passenger travelling on the engine of the tractor, the insurer would not be liable to indemnify the owner. In the present case, in view of the testimony of Anil Kumar Sahu, applicant's witness No.2, who was also travelling on the tractor with the deceased, it is established beyond doubt that at the time of // 8 // accident the deceased Lilesh Kumar Yadav was carelessly sitting on the engine of the tractor and died as a result of fall therefrom. Liability to pay compensation, therefore, squarely rests with respondent No.3 / owner of the tractor."
13. Revision Petition No.4126 of 2012 Ram Kumar Vs. National Insurance Company Limited, Divisional Manager, Sirsa, Haryana, eas ekuuh; jk"Vªh; vk;kx s }kjk ;g fu/kkZfjr fd;k x;k gS fd %& "8. We have also gone through the merits of this case. This is clear that the petitioner had used the vehicle in violation of the terms and conditions of the insurance policy by carrying 40 passengers, which was more than its capacity and against the insured purpose, being a goods carrying vehicle."
14. Suraj Mal Ram Niwas Oil Mills (P.) Ltd. vs. United India Insurance Company Limited & anr. IV (2010) CPJ 38 (SC), eas ekuuh; lokZsPp U;k;ky; }kjk ;g fu/kkZfjr fd;k x;k gS fd %& "22. Before embarking on an examination of the correctness of the grounds of repudiation of the policy, it would be apposite to examine the nature of a contract of insurance. It is trite that in a contract of insurance, the rights and obligations are governed by the terms of the said contract. Therefore, the terms of a contract of insurance have to be strictly construed, and no exception can be made on the ground of equity. in General Assurance Society Ltd. (supra), a Constitution Bench of this Court had observed that :-
"In interpreting documents relating to a contract of insurance, the duty of the Court is to interpret the words in which the contract is expressed by the parties, because it is not // 9 // for the Court to make a new contract, however reasonable, if the parties have not made it themselves." [See also : Oriental Insurance Co. Ltd. v. Sony Cheriyan, VI (1999) SLT 565 = (1999) 6 SCC 451; Vikram Greentech (supra); Sikka Papers Limited v. National Insurance Company Limited & Others, III (2009) CPJ 90 (SC) = (2009) 7 SCC 777; New India Assurance Company Limited v. Zuari Industries Limited & Others., IV (2009) ACC 390 (SC) = IV (2009) CPJ 19 (SC) = VII (2009) SLT 122 = 2009 9 SCC 70; Amravati District Central Cooperative Bank Limited v. United India Fire and General Insurance Company Limited, III (2010) SLT 232 = (2010) 5 SCC 294.
23. Similarly, in Harchand Rai Chandan Lal's case (supra), this Court held that :-
"The terms of the policy have to be construed as it is and we cannot add or subtract something. However liberally we may construe the policy but we cannot take liberalism to the extent of substituting the words which are not intended."

Thus, it needs little emphasis that in construing the terms of a contract of insurance, the words used therein must be given paramount importance, and it is not open for the Court to add, delete or substitute any words. It is also well settled that since upon issuance of an insurance policy, the insurer undertakes to indemnify the loss suffered by the insured on account of risks covered by the policy, its terms have to be strictly construed to determine the extent of liability of the insurer. Therefore, the endeavour of the Court should always be to interpret the words in which the contract is expressed by the parties.

Having considered the instant case on the touchstone of the aforenoted broad principles to be borne in mind while examining the claim of an insured, we are of the opinion that // 10 // the claim of the appellant must fail on the short ground that there was a breach of the afore-exacted special condition incorporated in the cover note. The special condition viz "each and every consignment" must be declared before dispatch of goods is clear and admits of no ambiguity. The appellant was obliged to declare "each and every consignment" before it left the appellant's factory premises and there is nothing in the policy to suggest that the insured had liberty to pick and choose the dispatches which they wanted to declare to the insurer, not even at the instance of the consignee, who otherwise is a stranger to the contract between the insurer and the insured. We have no hesitation in rejecting the plea of the appellant that they were required to declare only those dispatches in which they had an insurable interest. It bears repetition that notwithstanding any request by the consignee, the policy of insurance postulated declaration in respect of each and every dispatch by the appellant. Therefore, the fact that purchasers did not want an insurance cover on certain dispatches had no bearing on the obligation of the appellant to declare each and every dispatch under the policy. It is a settled proposition of law that a stranger cannot alter the legal obligations of parties to the contract."
