This miscellaneous petition under Section 227 of the
Constitution of India has been filed by the petitioner against the order
dated 13.03.2018 passed by the Judicial Magistrate First Class in
Criminal Case No.184/2011, by which JMFC vide order dated
15.02.2018rejected the application filed by the petitioner for closing the case.
2. Facts of the case are that on 23.03.2011, petitioner - Virendra Jain has filed an FIR against accused Bittu @ Abhishek and Chhotu @ Ankush Dube at Police Station Badnagar. The Station House Officer registered the case for the offence punishable under Sections 294 and 506/34 of the IPC. After investigation, charge sheet has been filed. His application under Section 321 of Cr.P.C. has been rejected on the ground that it is not maintainable.

4. In the miscellaneous petition, he prayed for the following reliefs:-

5. On due consideration of the provisions of Section 321 of 3 THE HIGH COURT OF MADHYA PRADESH, BENCH AT INDORE M. P. No.1939 of 2018 (Virendra Jain vs. Bharat Kher & another) Cr.P.C., I am of the view that JMFC has rightly rejected the application as not maintainable. No case is made out to interfere with the impugned order. The miscellaneous petition is accordingly, dismissed.
