The M.P. Gram Panchayat (Regulation of Slaughter House) Rules, 1998Published vide Notification No. F-1-20-98-22-P-2, M.P. Rajpatra (Asadharan), dated 4-1-1999 at page 18 (2-5)In exercise of the powers conferred by the sub-section (1) of Section 95 read with Clause (v) of Section 54 of the Madhya Pradesh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994), the State Government hereby makes the following rules the same having been previously published as required by sub-section (3) of the Section 95 of the said Act, namely

1. Short title and commencement.

(1)These rules may be called the Madhya Pradesh Gram Panchayat (Regulation of Slaughter House) Rules, 1998.

(2)These rules shall come into force with effect from the date of their publication in the "Madhya Pradesh Gazette".

2. Definitions.

- In these rules, unless the context otherwise requires,-

(a)"Act" means the Madhya Pradesh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994);

(b)"Gram Panchayat" means Gram Panchayat established under the Act;

(c)"Inspector" means officer-in-charge of the slaughter house;

(d)"Secretary" means Secretary of the Gram Panchayat;

(e)"Slaughter House" means slaughter house owned and run by Gram Panchayat.

No person shall slaughter any animal for the sale of meat within the Gram Panchayat area at any place other than the Gram Panchayat Slaughter House, established or a place fixed for the purpose by Gram Panchayat:Provided that if any person applies to the Sarpanch for permission to slaughter an animal at any other place in accordance with any religious usage or custom, he may grant him such permission on the following conditions, namely :-

(a)decency and privacy shall be observed;

(b)the killing shall not be done at any public place.

(1)The slaughter house shall remain opened for the slaughter of animals during such hours as the Secretary may from time to time direct.

(2)No animals shall be slaughtered at any other time :Provided I hat in special circumstances, the Gram Panchayat may allow the slaughter of any animal at any other time. In all such cases, the previous written permission of the Gram Panchayat shall be obtained.

(3)No animal shall be slaughtered at any place other than the slaughter house except for a religious purpose.

The Secretary shall cause to be fixed at a conspicuous place in the slaughter house a notice showing :-

(i)the hours of the working of the slaughter house, and

(ii)any other directions which the Gram Panchayat may deem fit to issue in this behalf.

Every animal for the slaughter shall, on being brought to the slaughter house, be presented for inspection to the Inspector who before passing any animal for slaughter, shall satisfy himself that-

(a)it is more than three weeks old;

(b)its flesh is fit for use as human food;

(c)it is not pregnant or with unweaned young;

(d)it is not diseased or in dying condition;

(e)its slaughter has not been prohibited by any law or order : Provided that any animal which has met with an accident is otherwise healthy may be passed for slaughter.

7.

The Inspector shall maintain a register in which he shall enter a brief description of each animal provided for slaughter.

8.

(1)No person shall knowingly bring into any part of the slaughter house-

(a)a diseased or unsound animal;

(b)an animal which is less than 3 weeks old;

(c)an animal which is pregnant or with unweaned young;

(d)an animal the slaughter of which is prohibited by any law or order;

(e)any carcass;

(f)any dog;

(g)tiny animal not meant for slaughter or for the slaughter of which the slaughter house is not provided.

(2)Any animal brought in contravention of these rules shall be summarily removed by the direction of the Inspector.

9.

(1)Animal approved for slaughter by the Inspector shall be branded with a distinctive mark on ears, hooves or horns and admitted into the waiting yard of the slaughter house.

(2)All animals when approved shall be kept in the waiting yards until the owners or persons in charge receive permission to bring them in the slaughter yard.

(3)The owner of the animal shall remain responsible for its security while it is in the waiting yard.

10.

Animals rejected as unfit for slaughter shall be removed forthwith from the premises of the slaughter house :Provided that animals found to be affected by any infectious or contagious disease or which may reasonably be suspected of being so affected shall, if the Inspector so directs, be forthwith apprehended and removed to the Veterinary Hospital or such other place as the Gram Panchayat may provide for the purpose.

11.

Each animal shall be slaughtered immediately over the drain and no blood shall be allowed to flow upon the floor.

12.

(1)Slaughtered animals shall be dismebowelled as soon as possible after slaughter.

(2)The contents of the stomachs and bowels shall not be washed into the drain or allowed to drop on the floor, but shall be emptied into buckets or receptacles provided for the purpose by the Gram Panchayat.

13.

No person shall rub or cause to be rubbed the inner sides of skins on the ground within any portion of the slaughter house premises.

14.

(1)All carcasses shall after skinning and cleaning be presented to the Inspector for inspection.

(2)Carcasses which have been passed by the Inspector as fit for human consumption shall, if necessary be branded or stamped so as to define their quality.

(3)No person shall remove any carcass from the slaughter house premises until it has been duly passed by the Inspector.

(4)The Inspector shall cause any carcass or meat which is in his opinion, unfit for human consumption, to be buried or destroyed.

15.

No person shall remove entrails and of falls from the slaughter house until they have been properly washed and cleaned.

16.

No person shall blow or stuff any meat within the slaughter house premises and the Inspector may cause to be buried or destroyed any meat found to be blown or stuffed.

17.

Any carcass or meat ordered to be destroyed in accordance with provisions of sub-rule (4) of Rule 14 or 16 shall be so treated as to render its use for human food impossible.

18.

No meat shall be sold on the premises of the slaughter house.

19.

No person shall remove or cause to be removed from the premises of the slaughter house any carcass or meat except in clean receptacle and covered in such manner as to be screened from public view and adequately protected against flies and dust.

20.

No butcher or person shall remove from the slaughter house or place, any skin, entail, offals of the animal until they have been properly washed and cleaned.

21.

The Inspector shall, by general or special order, direct the disposition of all skins, heads horns and feet of slaughtered animals and all carcasses or meat found left in the slaughter house after the hour fixed for closing the slaughter house.

22.

(1)No person suffering from leprosy, sores or any other skin disease or any contagious or infectious shall enter the slaughter house premises.

(2)No person other than the Gram Panchayat staff on duty and licensed butchers and their assistants or bona fide servants, shall enter the slaughter house premises during the process of slaughtering, skinning and cutting up of carcass.

(3)No person shall create any disturbance in the slaughter house premises.

(4)Any person who contravenes the provisions of these rules may be removed summarily under the direction of the Inspector.

23.

Any breach of these rules shall be punishable with fine which may be extended to two hundred and fifty rupees and if the breach is a continuing breach with further fine which may extend to five rupees for every day during which the breach continues after the first punishment.

24.

As per directions of the State Government, issued from time to time, slaughter house shall remain closed, on that days specified in the order.

25.

All rules, bye-laws corresponding to these rules and in force immediately before the commencement of these rules, are hereby repealed in respect of matters covered by these rules.
