Prayer in this petition is for issuance of a writ in the nature of Mandamus directing the respondents to allow the petitioner to participate and compete for the post of Trained Graduate Teachers (TGTs) Sanskrit against advertisement No.2/2023, by giving relaxation in Haryana Teachers Eligibility Test (HTET) certificate's validity.
It is the case of the petitioner that pursuant to an advertisement issued by the respondents, he had applied for the post of TGT (Sanskrit). But due to change in criteria for the post of Group 'C' and 'D', the said recruitment drive was cancelled. Thereafter, a new advertisement was issued in the year 2019 and the petitioner had again submitted his application. This time again the respondents had withdrawn the said recruitment process. Similar was the fate of the advertisement issued in the year 2022. It is the further case of the petitioner that the HTET qualification obtained by the petitioner had expired and he could not avail the benefit of the said certificate due to the fault on the part of the respondents.
1 of 3 ::: Downloaded on - 06-06-2023 22:33:08 ::: Neutral Citation No:= 129 CWP-5069-2023 (O&M) -2- Learned counsel for the petitioner submits that the petitioner had cleared his HTET examination in Sanskrit in the year 2011; that the said certificate was valid for a period of five years i.e. till 2016; that vide order dated 25.08.2020 issued by the Additional Chief Secretary, Government of Haryana, a decision was taken that the validity period of STET/HTET certificate will be for seven years from the date of issuance of the said certificate by the Board of School Education, Haryana and that though the validity of the HTET certificate was till 2016, yet the fact remains that the said validity was extended by the Government of Haryana till 2018.
I have heard the learned counsel for the petitioner. It is not disputed that the petitioner had earlier cleared the HTET examination in the year 2011. It is also not disputed that the said certificate was initially valid till 2016, but the same was further extended till 2020.
On a specific query put to the learned counsel for the petitioner, as to why the petitioner did not opt for re-appearing in the HTET examination, after expiration of the same in the year 2016, learned counsel for the petitioner was unable to answer it.
It seems that the petitioner did not bother to re-appear in the HTET examination, which was/is to be conducted by Board of School Education, Haryana, Bhiwani and was merely relying upon the extension granted by the Government of Haryana. This conduct and lackadaisical approach of the petitioner speaks volumes, who apparently chose to sleep 2 of 3 ::: Downloaded on - 06-06-2023 22:33:08 ::: Neutral Citation No:= 129 CWP-5069-2023 (O&M) -3- over the matter. Equity aids only those, who are vigilant about their rights and not those, who prefer to go into slumber.
In view of the above, I find no merit in the present petition. Dismissed.
