Heard on the question of admission and interim relief.
Though the petitioner has raised several issues, it is submitted by the learned counsel for the petitioner that the petition filed by him be disposed of with liberty to the petitioner to approach the respondent authorities under the provisions of M.P. Nagar Tatha Gram Nivesh Adhiniyam for the purpose of seeking release of the land included in a scheme notified under Section 50 of the Adhiniyam or for permitting him to undertake activities to develop his land on his own or in the alternative for a direction to the authorities to purchase the same and pay the value of the land to the petitioner at the market value.
The learned Govt. Advocate for the respondent/State submits that in case the petitioner does so by filing a representation, which shall be considered by the competent authority in accordance with law.
In view of the aforesaid, the petition filed by W.P. No.10866/2012 (Prithvipal Singh Vs. State of M.P. & Ors.) the petitioner is disposed of with a direction to the effect that in case the petitioner files a representation within one month alongwith a copy of the order passed today and a copy of the petition before the respondent authorities, the concerned authority shall consider and decide the representation expeditiously in accordance with law, as far as possible, preferably within a period of five months thereafter by passing a reasoned order.
It is made clear that this court has not expressed any opinion on the merits of the case and therefore the authority would be at liberty to examine the matter keeping all facts and facets into consideration and thereafter either accept or reject the representation by passing a reasoned order.
With the aforesaid direction, the petition filed by the petitioner stands disposed of.
