Heard learned counsels for the petitioner and the State.

The petitioner being the medical practitioner is apprehending his arrest in a case registered for the offences punishable under Sections 18 (C), 27b(ii) 18A, 18B, 26A, 28 and 28A of the Drugs and Cosmetics Act.

It is alleged that from the clinic of the petitioner some physician samples and some medicines of the government supply were recovered.

It is submitted by learned counsel for the petitioner that seizure list does not bear signature of the petitioner or any of his staff.

Considering the nature of accusation and quantity of recovery, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with 2 Patna High Court Cr.Misc. No.23436 of 2012 (2) dt.10-07-2012 2/2 Asthawan P.S. Case No. 37 of 2012 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Nalanda at Biharshariff, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
