Section 243(3) in M.P. Civil Court Rules, 1961

(3)The issue of a commissions is discretionary with the Court. A party applying for the issue of a commission is as much bound to do so without unreasonable or unnecessary delay as he is bound so to take any other steps in prosecution of the proceeding. The fact that an application has been made at an unreasonably late stage in the unit may, in the absence of adequate explanation for the delay, be sufficient reason for a refusal to issue a commission.
