Order on Review Petitions by Circulation

The above 11 Review Applications have been filed kng the applicants, vex) are -out cm? the 14 applicants in group of OAs decided by this Tribunal tn; a. common. order dated 21.11.2019. All these Review Applications have identical contents.
2. The first issue for consideration in these 11 Review applications is delay in filing them beyond the rmmiod cm? 30 days provided under Rule 17(1) cxf the Central Administrative Tribunal (Procedure) Rules, 1987, against the order of the Tribunal in O.A.(for group of OAs in common order). The Review Petitions had to be filed within 30 days of date of the order or date on which certified copy of the order were received. The common order in 14 (nu; was passed km; this Tribunal on 21.11.2019. These Emnmmmr Applications lumma been filed on 31.01.2020.
3. For delay in filing of them, each of the ll applicants has f1led.ei Misc. Petition seeking condonation.<xf delay nmntioning that inns copy of the order was received by their Advocate on 16.12.2019 and the Review Applications should have been filed on or before 15.01.2020. 13by the Advocate_in communicating to the applicants about receipt of the order of the Tribunal.
4. This is Inn; an. acceptable justification for line delay ill filing time Review Arplications. We do not find any merit in this line of argument that the Advocate took time in communicating about receipt of the order of the Tribunal. Therefore, the Misc. Petitions in each of the ll Review Applications filed for condonation of delay are rejected.
5. The next issue for consideration is justification Ifilf filing line Review; Applications. In the identical copy of these ll Review Applications, the applicants have requested. that the gist of arguments in their rejoinder submitted on 19.07.2019 along with case compilation on ratio decidendi, the following three judgments have not been inserted in the order of the Tribunal:
(i). Hariram and another Vs. Registrar General Delhi High Court, CDJ 2017 DHC 651?
(ii). Regional Manager and Anr. Vs. Pawan Kumar
Pandey, CDJ 1976 SC O54; and
(iii). Sachi Agro Trading Pvt. Ltd. Vs. UOI, 2017

6. The review applicants have further stated that insertion of the three caselaws in the order of the Tribunal will not result in material change in the contents or findings or reasoning given in the order of the Tribunal.
7. In context of this contention of the applicants, a perusal of Para 3(f) of the order of the Tribunal very clearly shows that the applicants had given copies of 14 caselaws and, therefore, all those have been mentioned in the order of the Tribunal. In fact after perusal of copies of the caselaws submitted tn: the applicants in time OAs involving the common order, the caselaws which had a direct bearing on the contentions of the applicants were listed and those caselaws of which copies had not been provided were not mentioned in the list.
8. Since inns applicants themselves have stated in the Review Applications that insertion of the three caselaws in the order will not result in any material change in the contents or findings or reasoning of the order, in our opinion these Review Applications seem. an attempt of purely academic nature.
