ORDER
(PER HON'BLE SHRI C.V.SANKAR, MEMBER (ADMN) The applicant has filed the present OA seeking the following relief:
i. Call for the relevant records and on perusal;
ii. Quash and set-aside the impugned Posting/Transfer Policy vide
No.A/96995/RTP/DGQA/Adm-7B/D(QA)/2016 dtd.24.11.2016(Annexure-
A6) and subsequent orders (i) order dtd.28.12.2016(Annexure-A7) stating that 'the posting/transfer policy in r/o Non-technical Group-B officials is kept in abeyance until further orders (ii) Amendment dt.10.2.2017(Annexure- A11) deleted para-6 also for para-10 officials having 3 years or less service for superannuation, will be exempted from rotational transfer (iii) order dtd.29.3.2017(Annexure-A12) directed all Directorates any orders for Rotational Transfer issued two posts (JTO(D) & Sr.DM) should not be implemented till such time (iv) order dtd.24.4.2017(Annexure-A16) directed to cancelled the order dtd.29.3.2017 as discussed in the meeting at Asst.Secretary(DP) office on 18.4.2017 (v) Order dtd.2.5.2017(Annexure- A18) directed all Directorates should not include the Group 'B' Drawing cadre post of JTO(D) and Senior D'Man for rotational transfer until further orders and (vi) order dtd.17.5.2017(Annexure-A19) directed officials holding the post of JTO(D) and Senior Draftman will not fall the purview of Rotational Transfer Policy issued vide MoD Note of 24.12.2016 issued by the respondents, as arbitrary, discriminatory, unjust and unfair and therefore void and also for the reasons stated in the application.
iii. While directing the respondents to revise the Posting/Transfer Policy dtd.24.11.2016(Annexure-A6) while preparing the lists of sensitive and non- sensitive posts of Group-B (gazetted and non-gazetted) officials, viz. Technical and Non-Technical in Director General of Quality Assurance(DGQA) Organization in terms of the letter dtd.30.4.2009(Annexure-A8) and the guidelines of the DoPT dtd.2.7.2015(Annexure-A9) in the interest of justice and equity.

The case of the applicant is that he was selected and appointed as Chargeman 3 OA.No.170/00877/2017/CAT/Bangalore Bench which was redesignated as Junior Engineer(Quality Assurance)(JE(QA)) on 23.3.2012. While working as such, he was granted in-situ promotion to the post of Assistant Engineer(QA) on 4.9.2015 which is not related to public relation. The 3 rd respondent issued rotational transfer order dtd.18.3.2016(Annexure-A1) transferring the applicant to SQAE(L), New Delhi in terms of para-4 of the Rotational Transfer Policy(RTP) dtd.20.5.2011(Annexure-A2) which is applicable to directly recruited JE(QA)/AE(QA) while asking option for posting. As per the instructions of DoPT and CVC, the respondents have issued RTP vide note dtd.30.4.2009(Annexure-A8) as per which the posts of (a) officers and staff dealing with local purchase of computer, stationary etc., and having direct contact with trade, (b) officers and staff dealing with posting/transfer and (c) technical officer/staff having direct dealing with trade, are treated as sensitive posts and category (a) will be rotated after tenure of 3 years and category (b) & (c) will be rotated after tenure of 5 years. Being aggrieved by the transfer order, the applicant filed OA.No.447/2016 which was disposed of on 30.6.2016(Annexure-A4) in view of an affidavit filed by the respondents exempting the applicant from rotational transfer for the year 2016. But he does not fall under the purview of RTP-2016. He submits that transferring him under the provision of para-4 of RTP dtd.20.5.2011 is incorrect. He got in-situ promotion of AE(QA) and hence he falls under the provision of para-5 of RTP dt.20.5.2011 and hence is due for RTP in the year 2020. Accordingly he filed RA.75/2016 which is also disposed of on 7.11.2017(Annexure-A5) giving liberty to the applicant to file a fresh OA since the new transfer policy came into force during the pendency of RA. The new transfer policy in respect of Group B is applicable to Technical and Non-Technical official of DGQA vide letter dtd.24.11.2016(Annexure-A6). Therefore, the earlier RTP dtd.20.5.2011 has no relevance and became invalid as on 24.11.2016. After 4 OA.No.170/00877/2017/CAT/Bangalore Bench implementation of the new transfer policy dtd.24.11.2016, the respondents issued order dtd.28.12.2016(Annexure-A7) stating that the posting/transfer policy in respect of non-technical Group-B officials is kept in abeyance until further orders. Therefore, the said transfer policy is existing only for technical Group B category i.e. AE(QA), JE(QA), JTO(S), SA, JTO(D) & Sr.DM occupants of such posts not holding any sensitive job nor having any public dealing job which have been subjected to rotational transfer. As per the DOPT's prescribed policy of rotational transfer vide OM dtd.2.7.2015(Annexure-A9), the Ministries/ Depts./Cadre authorities shall communicate the action taken on framing of RTP, identification of sensitive posts, rotation of officers from sensitive posts. But the respondent No.2 has not prepared the list of sensitive and non-sensitive posts as such the RTP-2016 is defective and not taken approval from the respondent No.5(DoPT) while issuing the impugned RTP-2016. The new RT policy dtd.24.11.2016 consists of various transfers (i) on tenure(7 years) of official in a station including service rendered in lower rank (ii) on completion of the tenure(3 years) of sensitive posting (iii) on total cumulative tenure of any official in the same station shall not exceed 12 years in the entire service career (iv) appointment/initial posting (v) on promotion (vi) on exigencies of service of the officials posting on returning from long term training/deputation (vii) on compassionate ground and (viii) on administrative ground. As such the RTP dtd.24.11.2016 is defective and not as per the guidelines issued by the DoPT vide OM dtd.2.7.2015. The 1st respondent has amended and modified the impugned RTP-2016 vide order dtd.10.2.2017(Annexure-A11) by his whims and fancies without approval of DoPT & CVC, wherein para-3 is not amended or modified in respect of posting/transfer. Further 2nd respondent has issued another order dtd.29.3.2017(Annexure-A12) excluding Drawing cadre. Being aggrieved by the 5 OA.No.170/00877/2017/CAT/Bangalore Bench new RTP dtd.24.11.2016, the All India DGQA Engineer's Association, Bangalore has filed OA.150/2017. During pendency of the said OA, the 2 nd respondent vide letter dtd.21.4.2017(Annexure-A14) identified 5 cadres as sensitive posts referring RTP dtd.30.4.2009 & 24.11.2016. Respondent No.3 has issued transfer order dtd.21.4.2017(Annexure-A15) only for AE(QA) working in non-sensitive post. The 2nd respondent issued one more order dtd.24.4.2017(Annexure-A16) and cancelled the order dtd.29.3.2017(Annexure-A12). The OA.150/2017 was disposed of on 27.4.2017(Annexure-A17) remitting the matter back to the respondents to do the needful within one month's time. The 2 nd respondent issued another order dtd.2.5.2017(Annexure-A18) referring orders dtd.24.4.2017 & 29.3.2017 and instructed all technical directorates not to include JTO(D) & Sr.D'Man for rotational transfer until further orders. The 2nd respondent issued another order dtd.17.5.2017(Annexure-A19) deciding that officials holding the posts of JTO(D) and Sr.D'Man will not fall within the purview of RTP-2016 which is contrary and confirming that the department has no uniform policy. The 2 nd respondent vide letter dtd.19.5.2017(Annexure-A20) has identified the sensitive posts and directed all Technical Directorates under the DGQA to ensure the rotational transfer of officials in the sensitive posts are carried out. This is contrary to letter dtd.21.4.2017 issued by him only. The 2nd respondent has issued another letter dtd.19.5.2017(Annexure- A21) and the same has been circulated to all Directorates under the DGQA referring the order passed in OA.No.150/2017. The 3 rd respondent has issued letter dtd.6.6.2017(Annexure-A22) to all the establishments under Electronics discipline with the direction to declare posts as sensitive posts. The respondent No.3 issued a letter dtd.29.6.2017(Annexure-A24) referring the respondent No.1 letter dtd16.6.2017(Annexure-A23) and directed all establishments under electronics 6 OA.No.170/00877/2017/CAT/Bangalore Bench discipline to forward the persons occupying posts beyond 3 years. Therefore, the impugned RTP-2016 is only applicable for technical Group-B cadre and confirmed that RTP-2016 is defective and without uniformity. The respondents have not prepared the list of personnel working in sensitive posts in compliance with order in OA.150/2017. The applicant's transfer made on old policy dtd.20.5.2011 is superseded by new policy dtd.24.11.2016. The RTP-2016 and various amendments issued by the respondents are liable to be quashed and set aside as they are opposed to the rules in force and also catena of cases decided by the Hon'ble Apex Court and Tribunal.

On the contrary, the respondents have submitted in their reply statement that the Rotational Transfer Policy has been existing in DGQA Organization since long and Technical/Scientific Staff of the organization are routinely transferred under this policy. The aim of the policy is to avoid developing vested interests. In the best interest of the organization some small changes have to be incorporated in the RTP from time to time. Erstwhile RTP in respect of Technical/Scientific Group B officials of DGQA dtd.20.5.2011 was revised by Min. of Defence vide order dtd.24.11.2016 wherein in addition to the Technical/Scientific Group B officials, non-technical Group B staff were also included by the authorities. However, on receipt of representations from various Service Associations of DGQA, Min. of Defence, in consultation with DGQA HQ, carried out certain amendments to the revised RTP which includes deleting the non-technical staff from the purview of RTP. Resultantly, the revised posting/transfer policy is now applicable only to Group B Technical/Scientific staff of DGQA. The revised transfer policy is legally and administratively sound and has prior approval of the competent authority of the Administrative Ministry i.e. Min. of Defence. It is also consistent with the Central Vigilance Commission(CVC) 7 OA.No.170/00877/2017/CAT/Bangalore Bench directives on rotation of officials working in sensitive posts. No further approval from any other authority is required. Accordingly, the RTP is applicable to all Scientific and Technical Group B officials irrespective of whether they hold sensitive posts, tenure in which is 3 years or non-sensitive ones. They are bound to be posted out of a station once they complete 7 years of service in that station irrespective of their having been deployed in sensitive posts or otherwise during the interregnum.
4. The respondents submit that the applicant who was appointed as Chargeman(DR) on 19.3.2010 has completed the prescribed tenure of 7 years in the station as per RTP-2016. He is due for transfer outstation on completion of 5 years of service and was ordered posting at New Delhi under RTP-2011. Being aggrieved, the applicant filed OA.447/2016. The respondent authorities deemed it expedient not to contest the case and exempt him from rotational transfer on self education ground. It is not understood as to how such a benign act of the respondent authorities as exempting an individual from rotational transfer as his own request can be construed as bad in law. Furthermore, the Tribunal while disposing of the OA did not take exception of the exemption granted by the respondent authorities in any manner whatsoever. The applicant's contention that he is governed by para 4 of respondent No.2 letter dtd.20.5.2011 and not by para 5 and thereby he is due for rotational transfer in the year 2020 is absolutely wrong. He is due for transfer under the latest policy i.e. RTP-2016 w.e.f. 1.7.2017 as he has been serving at the station since his initial appointment on 19.3.2010. Furthermore, having accepted All India Service Liability as a term of appointment, the applicant cannot renege on his commitment and refuse to move on transfer after completing the prescribed tenure in a station. The respondents exempted the Drawing Office staff from the purview of RTP as they do not come under Technical or Scientific 8 OA.No.170/00877/2017/CAT/Bangalore Bench category. The applicant is mixing up two entirely different issues of rotation of staff deployed in sensitive posts and not rotational transfer of Gp B Technical Staff, as issued by the 2nd respondent vide letter dtd.20.5.2011(Annexure-R2). Annexure-R4 order dtd.24.11.2016 clearly lays down that tenure of an official in a station will be 7 years inclusive of the period of service rendered in lower grade, if any, in the same station. On completion of 7 years of service in a station an official, irrespective of his having worked in a sensitive or non-sensitive post in the interregnum, will be posted out of that station under rotational transfer policy. DOPT OM dtd.2.7.2015 is applicable to members of Central Secretariat Service which caters to Central Ministries and their attached offices located in and around Delhi. The Service/Cadre which is purely non technical has no relevance to the Technical/Scientific Cadre of DGQA Organization. Policies framed by the DoPT for such an unlike cadre cannot be followed by the DGQA organization in toto as policies are framed by the executive authorities in congruity with the role and mandate given to the organization concerned and its requirement vis-a-vis changed circumstances. The RTP of DGQA is absolutely unrelated to classification of posts as sensitive and non- sensitive. Furthermore the respondent authorities have already published a list of sensitive posts vide respondent No.2 note dtd.19.5.2017(Annexure-R5) in compliance to the order in OA.No.150/2017(Annexure-R6).

The respondents further submit that the cap on total cumulative service of 12 years in the same station, has been deleted by the respondent authorities vide 1 st respondent letter dtd.10.2.2017(Annexure-R7). All the amendments were made with the prior approval of the competent authority of the Min. of Defence and approval of the Nodal Agency i.e. DOPT is not required. As such the contention of the applicant that the 1st respondent amended and modified RTP-2016 at his whims and fancies 9 OA.No.170/00877/2017/CAT/Bangalore Bench is denied. The nature of duties of AE(QA) or JE(QA) revolves around quality audit, surveillance, inspection and evaluation. They are required to perform multifarious kind of jobs, thereby requiring wide exposure to the various activities undertaken by the organization for their overall growth. Besides they come in contact with vendors/contractors/suppliers/private trade firms in connection with their job. Accordingly their transfer from one station to another is an inescapable necessity to avoid development of vested interest. On the other hand, nature of job of Drawing office staff remains more or less the same wherever they are posted, thereby not requiring exposure. Unlike technical staff, they are not detailed in QA/Surveillance/Inspection/Evaluation as they lack the requisite skills. As such they were excluded from the purview of rotational transfer. Cogency of RTP-2016 has been corroborated by this Tribunal vide orders in OA.No.320/2017 & 376/2017, OA.322/2017 & 364/2017 dtd.17.10.2017(Annexures-R8, R9 & R10 respectively) and Hon'ble High Court of Karnataka in WP.No.48428-48431/2017 & 52823- 52825/2017(Annexures-R11 & R12 respectively). The action taken by the respondent authorities has been just and appropriate and there is no violation of Articles 14 & 16 as alleged. Accordingly the OA is lilable to be dismissed.
6. The applicant has filed rejoinder reiterating the submission already made in the OA and submits that as per the DGQA standing order, the Drawing staff i.e., JTO(D) and Sr.D/man belongs to Technical Group B cadres are required to perform multifarious nature of job under diverse conditions. Whereas nature of duties of Drawing office staff remains more or less same everywhere. Also it is emphasised that promotion to SSO-II from JTO(D)/Drawing cadre are also at par with promotees from SE(QA) to SSO-II in discharging duties. There is no separate charter of duties at SSO-II level for drawing cadres. As such the exemption of Drawing office staff 10 OA.No.170/00877/2017/CAT/Bangalore Bench from the purview of RTP is no relevance and illogical. The statement of the respondents that the DGQA organization carried out certain amendments to the impugned RTP dtd.24.11.2016 which includes deleting the non-technical is false and incorrect. On 28.12.2016, the transfer of non-technical Group B cadre is kept in abeyance till further orders and not deleted. RTP-2016 is applicable to all Group B Technical and non-technical cadres.
7. The applicant submits that the respondents have not challenged the direction of the Tribunal in OA.No.150/2017 dtd.27.4.2017. As such the same is binding to implement RTP-2009. Despite the provision existing for transfer on compassionate ground in entire central government departments/ministries effectively, to bringing back the officials who are transferred under RTP with public expense, the respondents have adopted Compassionate Transfer Policy dtd.25.4.2013(Annexure-A36) and without superseding existing policy once again incorporated the compassionate transfer clause in para-8(d) of RTP- 2016(Annexure-A37). The respondents issued two circulars of transfer policies dtd.30.4.2009 and 24.11.2016. Both the policies are administratively sound, but implementation is faulty. Also two circulars of compassionate transfer policy dtd.24.11.2016(para-8(d) of RTP-2016) and dtd.24.4.2013 exist but both are contrary to each other. It is not understood which circular of transfer policy is valid and applicable. This clearly shows that there is no effective RTP as on today. The respondents have adopted pick and choose policy. The transfer policy dtd.30.4.2009 has got statutory force and it is not modified and not overruled. In this background, the respondents have grossly violated DoPT & CVC orders by allowing the personnel to continue in the sensitive posts beyond the prescribed period. As such the policies on transfer under Rotation and compassionate ground are illegal 11 OA.No.170/00877/2017/CAT/Bangalore Bench and unconstitutional.
8. The respondents have filed additional reply contending that promotional grade of JTO(D) is Sr.Scientific Officer Grade-II. But it is absolutely wrong to categorise JTO(D) and SDM as Technical as they do not have to perform multifarious nature of job under diverse conditions. No standing order can be treated as sacrosanct unless it is certified by the certifying officer concerned in terms of Sec.5 of Industrial Employment Act, 1946. DGQA Standing Order is also no exception. It is a compendium of general guidelines. The duties assigned to a Drawing office staff remains more or less the same everywhere unlike AEs(QA)/JEs(QA). As such bringing them within the purview of RTP would be an exercise in sheer futility even though the promotional grade of an AE(QA) and JTO(D) is the same i.e. SSO(II). A JTO(D) reaches the level of SSO-II at the fag end of his service life whereas the next promotional grade of an AE(QA) is SSO-II. In reply to the contention at para-6, respondents submit that on a liberal interpretation, keeping the transfer of Gp B Non-Tech cadre in abeyance may be safely treated as equivalent to deletion until further orders. The classification of posts as sensitive or non-sensitive has nothing to do with cadre and its classification/categorisation as Tech & Non-Tech. Rotation of the officers deployed in such posts is a natural corollary. Para-3 of RTP-2016 makes it clear that an officer will be posted out of station as and when he completes the prescribed tenure in the station which is 7 years irrespective of his having worked in a sensitive post or not. The policy expressly mentions that officers deployed in sensitive post will be rotated in the same station, failing which in a nearby station, once he completes 3 years in that post. The RTP-2016 is cogent, well thought out and user friendly. It is beneficial to the organization and the employees concerned at the same time. The same applies to Compassionate 12 OA.No.170/00877/2017/CAT/Bangalore Bench Transfer Policy(CTP) also. As such, the deponent does not endorse the views of Vice-President, AIDEF in so far as it relates to favouritism and disparities in implementing RTP & CTP. However, the respondent authorities may at any time review the policies de novo which is their prerogative. DGQA HQ note dtd.30.4.2009 deals with rotation of staff deployed in sensitive posts and not rotational transfer of Gp B Technical Staff as issued by respondent No2 vide letter dtd.20.5.2011. The applicant is mixing up two entirely different issues. Since no order of DOPT/CVC has been violated by the respondents, the question of illegality or unconstitutionality does not arise. The RTP dtd.20.5.2011 has been modified and superseded by RTP dtd.24.11.2016 but no orders/directions of DoPT and CVC have been violated. On the contrary, the respondents have been discreet enough not to allow continuance of any official in a sensitive post beyond 3 years as mandated by CVC.
9. The applicant has filed additional rejoinder reiterating the submission already made in the OA and the rejoinder. The respondents have filed additional reply to the additional rejoinder. The applicant has also filed second additional rejoinder along with annexures on which he relies on. The respondents has again filed second additional reply statement to the second additional rejoinder filed by the applicant.
10. We have heard the Learned Counsel for both the parties and perused the materials and written arguments note filed by both the parties in detail. The issues raised in this application have been considered in detail in OA.No. 320/2017 & 376/2017, OA.322/2017 & 364/2017 by this Tribunal and in WP.No.48428- 48431/2017 & 52823-52825/2017(S-CAT) by the Hon'ble High Court of Karnataka. This Tribunal has gone into detail all the aspects relating to the deletion of non- technical posts, preparation of the list of sensitive and non-sensitive posts and the 13 OA.No.170/00877/2017/CAT/Bangalore Bench agreement of the policy with the guidelines of the CVC & DoPT etc. The Tribunal has consistently come to the conclusion that the contentions raised by the applicants against Rotational Transfer Policy-2016 do not merit any consideration. The orders being challenged in the Hon'ble High Court of Karnataka have also miserably failed. The Hon'ble High Court of Karnataka has clearly refused to accept the contention of the applicants that the Rotational Transfer Policy of 2016 is arbitrary, unconstitutional etc. The Hon'ble High Court has consistently held that the DGQA is an organization under the Ministry of Defence and that the classification of posts and deployment of personnel remains the prerogative of the organizations concerned and Courts cannot substitute their opinion. The Hon'ble High Court has therefore dismissed the Writ Petitions filed against the orders of this Tribunal. In the present application, similar points have been made and as stated in the reply and additional replies furnished by the respondents, the policy cannot be challenged on premises of discrimination, arbitrariness or any confusion whatsoever. Clear policy decisions have been taken based on the cogent reasons given by the respondents. Hence, the OA deserves to be dismissed. Accordingly, the OA is dismissed. No costs.
