State of Maharashtra - Subsection

Section 244(1) in The Maharashtra Municipal Councils, Nagar Panchayats And Industrial Townships Act, 1965

(1)If it appears to the Council that the water of any well, tank or other place is likely, if used for the purpose of drinking, bathing, washing or for any other purpose, to endanger health or cause the spread of any dangerous disease, the Council may -
(i)require the owner or the person in-charge of such well, tank, or other place by written notice to take such measures as may be necessary to prevent danger to public health or prevent the spread of any dangerous disease;
(ii)by public notice, prohibit the removal or use of the said water for any such purpose and may take such steps as may be necessary to prevent any person from removing or using water from such well, tank, or other place:
Provided that, when a declaration under sub-section (2) of Section 240, has been made by the Collector, it shall be lawful for the Chief Officer or the Health Officer to take action under this sub-section and report the action taken to the Council for approval.
