The present writ petition is disposed of as having been rendered infructuous, in view of striking down of Section101-A of the Right to Fair Compensation and Transparency in Land Acquisition (Rehabilitation & Resettlement) Act, 2013,in view of the detailed judgment of even date passed in CWP No.11498 of 2019 'State of Haryana and another Vs. Nishabar Singh and others', since the relief has already been granted in the said case and the present case accordingly stands covered.
Challenge is to the notice dated 18.01.2022 passed by Estate Officer, HSVP, is repelled since apparently the land was acquired way-back on 31.03.1997 and 12.10.2000 for development of sector road and sectors 1, 2 & 23-23-A, Gurugram and possession has been taken vide rapat no.240 dated 1 of 2 ::: Downloaded on - 28-12-2024 05:09:04 ::: Neutral Citation No:=2024:PHHC:172142-DB CWP-1409-2022 (O&M) -2- 31.03.1997 and rapat no.69 dated 12.10.2000, respectively. A perusal of the said notice would go on to show that the petitioners are in unauthorized occupation of the acquired land and the acquisition is not subject matter of challenge.
