Heard learned counsel for the parties.
Petitioner has filed M.A. No. 448 of 2015 for restoration of revision petition, which was dismissed in default on 09-07-2015. Learned counsel for the petitioner submitted that on 09-07-2015 as his car became out of order he reached to this Commission at 12.00 A.M. and by that time matter was dismissed in default, which may be restored. Learned counsel for the respondent submitted that signature of Roshan Lal on accompanying affidavit differs from signature of Roshan Lal in affidavit filed along with earlier M.A. No. 532 of 2014.
Learned counsel for the petitioner has not filed his affidavit in support of submission made in the application but looking to the reasons mentioned in the application, if deem it appropriate to restore revision petition subject to cost. Consequently, M.A. No. 448 of 2015 filed by the petitioner is allowed subject to cost of Rs.1,000/- to counsel for the respondent and order dated 09-07-2015 passed by this Commission in R.P. No. 470 of 2013 - Roshan Lal Vs. L.I.C. of India is recalled and revision petition is restored at its original number.
Adjourned to 09-02-2016 for final hearing at admission stage.
