                               O R D E R (Oral):

Per: Mr. Justice Sunil Thomas, Judicial Member The applicants in all these Original Applications have approached this Tribunal claiming the benefits of the MACP Scheme with effect from 01.01.2006, on the strength of the decision of the Hon'ble Supreme Court reported in Union of India v. Balbir Singh Turn and another (2018) 11 SCC 99 in which it was held that notwithstanding the O.M dated 19.05.2009, applying MACP Scheme with effect from 01.09.2008, it would be applicable with effect from 01.01.2006. The reasoning in Balbir Singh Turn's case was that the benefit granted to an employee was part of the pay structure, which affects his pay and pension.

2. The learned counsel appearing for the parties in all the above mentioned O.As and the learned SCGSC were heard.

3. It was fairly contended by Mr. C.S. Gopalakrishnan Nair, learned counsel for the applicants that a three Judges Bench of the Hon'ble Supreme Court in Union of India and Others v. M.V. Mohanan Nair (2020) 5 SCC 421 has held that MACP Scheme benefits are only an incentive meant to relieve stagnation framed under executive policy and its continued existence cannot be termed as an enforceable right. He placed before us the latest judgment of the Hon'ble Supreme Court in Union of India and Others v. Ex. HC/GD Virendra Singh and others (2022) SC 739 which clinches the issue. However, the grievance of the learned counsel was that the civilians and non-civilians are not held at par with each other.

4. Ms. O.M. Shalina, the learned SCGSC as well as other respondents' counsel in the connected cases placed reliance on the decision of the Hon'ble Supreme Court in Union of India and Others v. Ex. HC/GD Virendra Singh and others (2022) SC 739 wherein the Court had reiterated the decision in M.V. Mohanan Nair's case referring to the contention that the decision rendered by the three Judges Bench in M.V. Mohanan Nair's case does not refer to Balbir Singh's case and does not overrule it specifically, it missed the point that the entire ratio and reasoning given in Mohanan Nair's case cannot be reconciled with Balbir Singh's case. It was reiterated that the decision in M.V. Mohanan Nair's case had examined the MACP Scheme in depth and detail to settle the controversy holding that the supersession of the ACP Scheme by the MACP Scheme is a matter of Government policy, and that after accepting the recommendation of the VI th CPC, the ACP Scheme was withdrawn and the same was superseded by the MACP Scheme on 01.09.2008.

It was asserted that ACP Scheme and MACP Schemes were held to be in the nature of incentive schemes to relieve stagnation and not as part of pay structure, which had revised the pay and the Dearness Allowance with effect from 01.01.2006. It was further contended by the learned SCGSC that the decisions in Union of India v. R.K. Sharma and others (SLP (c) 15572/2019), Union of India v. S. Ranjit Samuel (CA 1625-1627/21), Mohanan Nair's case and Virendra Singh's case covers all the issues.

5. In the light of the latest legal position, the claim based on Balbir Singh Turn's case cannot succeed. The issue arising herein stands covered by the 28 O.A No. 373/18 & C. Cases decision in Union of India and Others v. Ex. HC/GD Virendra Singh and others (2022) SC 739 as mentioned above. In the result, this O.A along with connected O.As have to fail.

6. The Original Applications are dismissed. No costs.
