1. Learned Counsel appearing for the Petitioner submits that the Petitioner is working as Teacher (LB) at Government Kasturba Gandhi Girls Residential School, Korba (C.G.). She was initially appointed in year 2008 under the Recruitment Rules i.e. Chhattisgarh Shikshakarmi (Appointment and Service) Rule, 2007. According to the said Rule, the Petitioner was required B.Ed. or D.Ed. degree at the time of her recruitment. Since, she was not possessed the said degree, therefore, she was not granted regular pay scale and other benefits. The similar matter was duly considered by this Court in case of Jayant Kumar Patle Vs. State of Chhattisgarh and others passed in WPS No.4271/2017 dated 03.11.2017. The Petitioner made representation dated 21.06.2023 before Respondent No.3 mentioning all her grievances but, till date it has not been decided by Respondent No.3. Therefore, it is prayed that the instant petition may be disposed of directing Respondent No.3 to consider and decide the representation of the Petitioner in light of judgment passed by this Court in case of Jayant Kumar Patle Vs. State of Chhattisgarh and others.

2. Learned Counsel appearing for the State not opposes the limited prayer made by learned Counsel for the Petitioner.

3. I have heard learned Counsel appearing for the parties.

4. Considering the above submissions of learned Counsel appearing for the parties, the instant petition is disposed of directing Respondent No.3 to consider and decide representation dated 21.06.2023 of the Petitioner in light of judgment passed by this Court in case of Jayant Kumar Patle Vs. State of Chhattisgarh and others passed in WPS No.4271/2017 dated 03.11.2017 and other relevant rules and law as early as possible preferably within two months from the date of receipt of copy of this order.
