For the petitioner in WPA 4313 of 2023 Mr. Sankar Nath Mukherjee Mr. Niraj Gupta Ms. Afroja Nusrat ..for the added respondent in CAN 13 of 2023 in WPA 13700 of 2021 Mr. Ranajit Chatterjee, learned counsel appearing for the applicants in CAN 18 of 2023 and CAN 19 of 2023, in course of his submissions, drew the attention of the Court to a letter dated December 13, 2023 written on behalf of his clients to the Central Bureau of Investigation (CBI) requesting for inspection of the respective OMR sheets and disclosure of the reason for inclusion of the names of his clients in the list of 907 school teachers of classes XI and XII published.
39In view of his submissions, the Court requested the parties to address on the issue of directing the CBI to produce the electronic materials seized from the ex-
employee of NYSA and the procedure to be followed.
Mr. Kalyan Bandyopadhyay, learned Senior Advocate appearing for some of the candidates submits that the Court should not issue of such a direction. Court should first decide on the admissibility of such evidence in terms of the Evidence Act, 1872. In support of such contentions, he draws the attention of the Court to the directions contained in the order of the Hon'ble Supreme Court dated November 9, 2023.
Without prejudice to his previous contentions, Mr. Bandyopadhyay submits that in the event the materials are directed to be produced, then at least, the CBI official who seized such materials as well as the person claiming to give the Certificate on behalf of NYSA should be allowed to be cross-examined. He submits that a Writ Court can direct examination of witnesses and that trial on evidence can be held by a Writ Court.
Mr. Lakshmi Gupta, Mr. Jaydip Kar, Mr. Pramit Ray and Mr. Pratik Dhar, learned Senior Advocates and several other advocates appearing for different candidates adopt such submissions.
40In addition, Mr. Kar submits that since there is a Certificate claimed to be under Section 65(B)(4) of the Evidence Act, 1872, such an exercise need not be undertaken.
Mr. Billawadal Bhattacharya, learned Deputy Solicitor General draws the attention of the Court to the various provisions of the Evidence Act, 1872 and submits that production of the materials are not necessary. Court can proceed on the basis of the affidavit of Evidence. He submits that, however, in the event Court desires to adopt such a procedure, then the original Certificate may be produced as directed. So far as the production of any Official of CBI is concerned, he seeks time to take instructions.
Mr. Bikash Ranjan Bhattacharya, learned Senior Advocate appearing for the writ petitioners submits that in the event, the Court desires to look into those materials, they may be directed to be produced.
We considered the rival contentions of the parities and also the order of the Hon'ble Supreme Court.
The Hon'ble Supreme Court requires us to consider the issue as to whether the authenticity of images were established by applying the prevailing rules of the Evidence or not.
41The images are in electronic format. They are said to be contained in three electronic devices, again claimed to be seized by the CBI from an ex-employee of NYSA, an entity who was entrusted with the scanning and evaluation of the OMR sheets.
Wholly without prejudice to the rights and contentions of the parties, we deem it appropriate to direct the CBI to produce the electronic devices seized from the ex-
employee of NYSA on January 24, 2024.
It is submitted by Mr. Billawadal Bhattacharya, learned Deputy Solicitor General that seized electronic devices were sent to the Central Forensic Science Laboratory. CBI retained a copy of the contents of such devices.
CBI shall preferably produce the electronic devices seized on the next date.
The CBI shall also produce the original Certificate issued by the ex-employee of NYSA, annexed to the affidavit of the CBI, on the next date.
School Service Commission will also certify and produce the data available with them with regard to the four categories of cases before us, on the next date. Again same direction with regard to inspection of such materials produced will apply.
42These directions will cover all the categories of cases that are being heard by us.
The issue as to the right of cross-examination will be considered if and when raised by any individual party to the proceeding. Parties to the proceedings are at liberty to take inspection of the electronic materials and documents produced in Court.
Inspection taken will be without prejudice to the rights and contentions of the parties.
Exception to the affidavit of CBI, filed in Court be taken on record.
