40. Appointment of polling agents.
(1)Each contesting candidate or his election agent may appoint one polling agent and one or two relief polling agents as may be specified by the State Election Commission, from time to time, to act as the polling agent of such candidate at each polling station.(2)Every such appointment shall be made in Form 11 and shall be handed over to the polling agent for production at the polling station.(3)At every election where a poll is taken, each contesting candidate at such election, his election agent or his polling agent shall have a right to be present at the polling station provided for taking the poll.(4)Where any act or thing is required or authorised by this rule to be done in the presence of the polling agent, the non-attendance of any such agent at the time and place appointed for the purpose shall not invalidate the act or thing done, if the act or thing is otherwise done fully.
