1. All these writ petitions are heard and decided together as common issue is involved in these petitions.
2. The grievance of the petitioners in these bunch of writ petitions is abrupt stoppage of monetary compensation which the petitioners were receiving under the "Loknayak Jaiprakash Narayn (MISA/D.I.R. Rajnaitik Ya Samajik Karno Se Nirudha Vyakti) Samman Nidhi Niyam, 2008".
3. Learned counsel for the petitioners would submit that another bunch of petitions was decided by the Coordinate Bench of this Court on 26.05.2020. The facts relevant for these cases is that the petitioners or their family members in the instant petitions were detainees during the emergency period. Consequent thereto in the year 2008, the State government decided to reward the persons or family members who underwent political detention under the MISA Act or under the DIR Act during the emergency period between 25.06.1975 to 31.03.1977. In order to 17 support the detainee or their family members the rules known as Loknayak Jaiprakash Narayn (MISA/D.I.R. Rajnaitik Ya Samajik Karno Se Nirudha Vyakti) Samman Nidhi Niyam, 2008 were promulgated whereby monetary allowances were given to the detainee or their family members. The said rules were repealed by notification dated 23.01.2020 (Annexure R-1). In the meanwhile, since certain verification clause was set into motion on 28.01.2019 and the payment which was given to the petitioners or their family members were stopped. As such it was subject of challenge. She further submits that in the bunch of cases which were decided on 26.05.2020 this Court has passed the following orders. The relevant portion of the order is reproduced herein under:-
"27. In view of the aforesaid legal position as it stands, it is evidently clear that the petitioners have not been subjected to scrutiny or verification after issuance of the impugned order dated 28.01.2019 nor is there any order of the State Government doubting and it is ordered accordingly and since the rules itself now stands repealed from 23.01.2020, the petitioners would be entitled for the benefit, arising out of the said act from the date it was withheld i.e.,January, 2019 till the date the Act itself stood repealed in January,2020.
28.The writ petition stands allowed. Let the payments for the period between January, 2019 to 23.01.2020 be made to each of the petitioners within a period of ninety days from the date of receipt of copy of this order."
He further submits that these petitioners have also filed the similar petitions which could not be heard for some reasons or the other inasmuch as a review petition against order dated 26.05.2020 was filled. It is contended the petitioners are entitled for the same relief which was granted in earlier batch of petition to grant pension between January 2019 to 23.01.2020, till the rules were repealed.
4. Learned State counsel opposes the argument and would submit that after the judgment was passed on 26.05.2020, a new notification was issued on 18 29.07.2020 which reads as under:-

5. He submits that under the new notification the repeal of the rules which was made on 23.01.2020 has been given a retrospective effect from January 2019, therefore the petitioners would not be entitled for any arrears due from January 2019 to 23.01.2020.
6. The petitioners or their family members who were detainee under the MISA Act were given certain pensions under the Loknayak Jaiprakash Narayn (MISA/D.I.R. Rajnaitik Ya Samajik Karno Se Nirudha Vyakti) Samman Nidhi Niyam, 2008 rules. On 28.01.2019 vide Annexure P-1 certain physical verification was required to be made and notification was issued. Thereafter the pensions which was being granted to the petitioners or their family members of the detainee was abruptly stopped. The challenge therefore was made to the abrupt stoppage of the pension. During the pendency of those petitions a notification was issue by the State government, whereby the rules under which the benefit was granted was repealed on 23.01.2020, which reads as under:-

7. Under these circumstances, it appears that this Court has ordered to pay the pension in the earlier batch of petitions from January 2019 till 23.01.2020 till the rules were repealed.
8. For some reason or other these batch of petitions could not be decided. In the meanwhile, the new notification of 29.07.2020 came into being. By effect of such notification, the repeal of rules of 2008 was given a retrospective effect from January 2019. Consequently, the date of repeal was preponed by retrospective date of January 2019. What would be the effect of the notification? Is a matter of adjudication before the appropriate Court, if challenged. However, if the notification is existing, in the teeth of such notification, the prayer made by the petitioners to grant the similar relief as was granted to the earlier batch of petitions cannot be considered. If the rules of 2008 have been repealed from January 2019, then the petitioners shall be entitled for the benefit uptill January 2019. Therefore now as it appears that the petitioners have to go in for another bout of litigation. In view of the changed circumstances and with existence of new notification similar relief can't be granted to the petitioner.
9. With such observation, the petition stands disposed off.
