East Punjab Urban Rent Restriction (Amendment) Act, 1953Punjab Act No. 43 of 1953Statement of Objects and Reasons of the East Punjab Urban Rent Restriction (Amendment) Act (43 of 1953). - The object of the East Punjab Urban Rent Restriction (Amendment) Bill, 1953, is to remove the lacuna in Section 2(j) of the East Punjab Urban Rent Restriction Act, 1949, by specifying the authority for declaring any area to be an "urban area" for the purposes of the Act. Retrospective effect is being given to this amendment to provide legal cover for the notifications already issued by the State Government under the said Section, declaring certain areas to be urban areas under the Act.Section 2 of the Act runs as under :-In clause (j) of Section 2 of the East Punjab Urban Rent Restriction Act, 1949 (Act 3 of 1949), after the words "declared" the words "by the State Government" shall be inserted and shall be deemed always to have been so inserted as if this Act had been in force on and from the date of any notification issued in this behalf, and where in any proceedings concluded before the commencement of this Act any notification has been found to be invalid on the ground that the State Government was not empowered to issue such a notification, such finding shall be void and of no effect, and the Court shall, notwithstanding anything to the contrary contained in any other law for the time being in force, on application made within six months from the commencement of this Act by any party prejudicially affected by such finding, restore the proceedings at and continue it from the stage reached immediately before the order embodying or based on such finding was made.Punjab Government Gazette (Extraordinary), 1953, page 1116.The following Act of the State Legislature received the assent of the Governor of Punjab on the 3rd November, 1953 and was published in the Punjab Gazette, Extraordinary, dated the 9th November, 1953.An Act to amend the East Punjab Urban Rent Restriction Act, 1949.It is hereby enacted as follows :-

1. Short title.

- This Act may be called the East Punjab Urban Rent Restriction (Amendment) Act, 1953.

2. Amendment of Section 2(j) of Punjab Act III of 1949.

- In clause (j) of Section 2 of the East Punjab Urban Rent Restriction Act, 1949 (Act III of 1949), after the word "declared" the words "by the State Government" shall be inserted and shall be deemed always to have been so inserted as if this Act had been in force on and from the date of any notification issued in this behalf; and where in any proceedings concluded before the commencement of this Act any notification has been found to be invalid on the ground that the State Government was not empowered to issue such a notification, such finding shall be void and of no effect, and the Court shall, notwithstanding anything to the contrary contained in any other law for the time being in force, on application made within six months from the commencement of this Act by any party prejudicially affected by such finding, restore the proceedings at and continue it from the stage reached immediately before the order embodying or based on such finding was made.
