It is contended that the writ petitioner was appointed as Part Time Sweeper on 01.01.1989, worked as such till 01.01.2004, was entitled to daily wager status after completion of ten years of service i.e. with effect from 01.01.1999, but was not granted the said status till 01.01.2004, thereby denying the benefit of five years' service to the writ petitioner. Further contended that the writ petitioner is also entitled to regularization in terms of the policy occupying the field, which has not been granted. It is accordingly prayed that ::: Downloaded on - 15/04/2017 17:50:27 :::HCHP -: 2 :- the respondents be directed to redress the grievances of the writ petitioner by issuing writ of mandamus.

2. Respondents have filed reply and have not seriously contested the writ petition.

3. In the given circumstances, I deem it proper to dispose of this writ petition with a direction to the respondents to examine the case of the writ petitioner in light of the averments contained in the writ petition read with the policy, Rules & Regulations occupying the field and the judgment rendered by this Court in CWP No. 2735 of 2010, titled Rakesh Kumar vs. State of H.P. and others, decided on 28.07.2010, which has now been upheld by the Apex Court and make a decision within six weeks.

4. The writ petition is disposed of accordingly alongwith all pending applications, if any.
