The Appellant filed an RTI application (online) dated 29.12.2022 seeking the following information:
"1. Please inform me the details (names, addresses etc.) of all the "Animal Welfare Organization" (including private individuals volunteering for it) as per definition of Rule 2(b) of the Animal Birth Control Rules, 2001, with which/ in alliance with which, the MCD, Keshav Puram Zone, Delhi is working with, during the period of 24 months from 01.01.2021 till 29.12.2022 2 Please inform the total numbers of street/stray dogs which were caught for sterilization in Keshav puram Zone on monthly basis (for each calendar month) for the last 24 months from 01.01.2021 till 29.12.2022.
3. Please inform the total numbers of street / stray dogs which are actually sterilized and immunized in MCD, Keshav puram Zone on monthly basis (for each calendar month) for the last 24 months from 01.01.2021 till 29.12.2022.
4 Please inform the total numbers of street dogs which are caught for sterilization from AC Block of Shalimar Bagh, Delhi-110088, on monthly basis (for each calendar month) for the last 24 months from 01.01.2021 till 29.12.2022.
5. Please inform the total numbers of street dogs which are actually sterilized and immunized, which were caught from AC Block of Shalimar Bagh, Delhi-110088, on monthly basis (for each calendar month) for the last 24 months from 01.01.2021 till 29.12.2022. 6 Please inform me the names of the people (along with their designations in their respective organization/department) in Monitoring Committee, as per Rule 4 of Animal Birth Control Rules, 2001, during the period 01.01.2021 to 29.12.2022. Any change in the people of Monitoring Committee and their respective periods are to be informed separately.
7 Please inform me the (i) number of times the authorization is given by Committee to veterinary doctor to put to sleep critically ill or fatally injured or rabid dogs in a painless method by using sodium pentathol, during the period 01.01.2021 to 29.12.2022. and the (ii) numbers of dogs which are put to sleep under this approval and also inform the place / locations from where these dogs were picked up. 8 Please inform me on the following points about the last assignment of survey done on the number of street dogs:
i. Agency details (names, addresses etc.) Date when this assignment was given ii. Scope of the work to be done in the assignment Page 2 of 15 iii. Area of coverage under assignment Please give me the certified copies of the report submitted by this iv. Agency, pursuant to their findings along with their comments and remarks.
9. Please inform me animal kennels/shelters under North MCD, Keshav Puram Zone and their respective name(s), address(es) along with the addresses of the kennels/pounds and the capacity of each such kennel / pound, of Animal Welfare Organizations managing these animal kennels / shelters.
10. Please inform the number of dogs which are kept in these animal kennels/shelters, and reasons for keeping these dogs in these animal kennels / shelters, as on the last day of each calendar month in last 24 months i.e., from 01.01.2021 to 29.12.2022. Please give details separately for (i) Pet Dogs and (ii) Stray Dogs.
11. Please inform the total numbers of ambulance cum clinical vans which are used as mobile center for sterilization and immunization, as on i. 29.12.2022, ii. 31.12.2021 iii. 31.12.2020 iv. 31.12.2019
12. Please inform the month wise details of the numbers of dogs sterilization done by these mobile centers for sterilization and immunization in last 24 months i.e. from 01.01.2021 to 29.12.2022.
13. What is the rate fixed for sterilization/immunization of dogs by the Committee. Please inform me the date on which this rate was fixed, in last 24 months i.e. from 01.01.2021 to 29.12.2022, and its effective date(s) of applicability of this rate and also please provide me with the certified copy of the Minutes of Meeting of the Committee in which the rates were fixed.
14. Please give me the details of money which is re-imbursed to these Animal Welfare Organizations for sterilization/immunization at a fixed rate. Please provide me the details for last 24 months i.e. from 01.01.2021 to 29.12.2022. separately for each and every Animal Welfare Organizations.
15. Please inform me the details (members, addresses, and the mobile landline numbers of Dog Control cell which is set up by local authority in consultation with the Monitoring Committee in Keshav Puram Zone of MCD.
16. Please inform me the numbers of complaints received by the Dog Control cell under MCD, KPZ, on monthly basis for last 24 months Le. from 01.01.2021 to 29.12.2022 by bifurcating into different categories Page 3 of 15 under which the complaints are received i.e., dog nuisance or dog bite etc. etc.
17. Please inform me the method used for identification and recording of sterilized/vaccinated dog for being identified as sterilized or immunized dogs.
18 Please inform that in addition to what is mentioned in 17 above, is there any other method used for identification and recoding of these sterilized/vaccinated dogs.

Please inform me kennel wise/pound wise details for last 24 months i.e. from 01.01.2021 to 29.12.2022 (date, numbers of dogs along with their respective animal welfare organization details about the Incurably ill and mortally wounded dogs which are euthanized by administering sodium pentathol for adult dogs and Thiopental Introperitoneal for puppies.
20. Please inform me kennel wise/pound wise details (date, numbers of dogs) along with their respective animal welfare organization details about the Incurably ill and mortally wounded dogs which are euthanized by any other method, aa mentioned in 19 above.
21. Please inform me the month wise details (date,, numbers of dogs, area from where these dogs are caught) which are caught under Furious or dumb rabid dogs category during last 24 months Le. from 01.01.2021 to 29.12.2022.
22. Please inform me the month wise details of animal welfare organization where the dogs caught under furious or dumb rabid dogs category during last 24 months Le. from 01.01.2021 to 29.12.2022, as mentioned in 21 above, were taken.
23 Please inform the names and designations of two persons Inspection Panel for inspection of suspected rabid dogs, for each and every animal welfare organization, during last 24 months in. from 01.01.2021 to 29.12.2022.
24 Please inform the details of dogs (dates, numbers of dogs and name(s) of respective animal welfare organization where the dogs caught under category of rabid dogs were kept in isolation, during last 24 months je frum 01.01.2021 ta 29.12.2022.
25. Please inform me that how many dogs, of the numbers mentioned in 24 above, died a natural death. Please give me details of all such deaths of dogs (date, number of dogs and name(s) of respective animal welfare organization | where these dogs died during last 24 months i.e., from (01.01.2021 to 29.12.2022

Feeling aggrieved and dissatisfied, complainant approached the Commission with the instant complaint.

"1 As per the definition under Rule 2(b) of the Animal Birth Control Rules, 2001, the MCD works in collaboration with Animal Welfare Organizations. From time to time, these organizations are engaged on a zonal basis as per orders issued by the Headquarters. At present, the NGOs working with MCD are listed in the enclosed office order for your reference.
2. Total number of 488 number of street dogs were caught by veterinary services department, keshav puram zone during the said period in RTI and sent to the concerned NGOs/sterilization centre for sterilization and anti rabies immunization.

Specifically there is no dog control cell in keshav puram zone however post receipt of complaints through zonal control room/other sources the dog Page 10 of 15 catching team is there for catching of stray dogs and sending them to the NGOs/AWOs for the purpose of sterilization and anti rabies immunization of stray dogs which are further rehabilitated in their local habitat.
16. The complaint of stray dogs nuisance are received through different sources i.e. Zonal control room which receives complaints pertaining to all department of the zone on all concerned issues and out of total complaint those related to the stray dogs are be segregated.
17. The pinna of the ear is cut/cropped after sterilization and anti rabies immunization of stray dogs as a mark of identification.
18. There is no other method of identification a sterilized and immunized stray dogs other than cropping of its ear.

27. Upon receipt of the complaint in the office, the Zonal Head of the Veterinary Services Department, Keshav Puram Zone, marked the complaint to the Veterinary Inspector for immediate action to resolve the issue.

29. Upon receiving the complaint in the office, the Zonal Head of the Veterinary Services Department, Keshav Puram Zone, forwarded it to the Veterinary Inspector for immediate action, instructing them to resolve the issue with the help of NGOs."
Page 11 of 15The Appellant/Complainant, during the hearing, reiterated the contents of his RTI application and instant appeal and submitted that till date information has not been provided to him by the Respondent. He further denied receipt of letter dated 09.04.2025 of the Respondent. It is only during the hearing that a hard copy of the letter/reply was handed over to the Appellant/Complainant. Appellant pleads that there is a conflict of interest of NGO because once ABC is successful the NGO's business will become unsustainable. Similarly, it has a conflict of interest with the sterilization and vaccination of animals. The Respondent's job is also secured when the ABC fails, else when the next generation of stray animals is not born, the department will face closure and so will the NGOs. Therefore, they connive to make the ABC, sterilization, vaccination a failure. He further submits that if all males and females has been sterilized as per the Respondent then how come new pups are born and are seen with those females.
The Appellant/Complainant submitted that these stray dogs are enjoying protection greater than that of species covered under Schedule I & II of the Wild Life (Protection) Act, 1972. The Scheduled species can be eliminated under certain circumstances on permission from the Chief Wildlife Warden but the stray dogs cannot be eliminated despite there being no specific law passed by the Parliament for their protection.
The Appellant/Complainant requested the Commission that he is not interested in getting any revised information from the Respondent rather penalty should be imposed on the Respondent, compensation should be awarded to him and directions should be given to initiate disciplinary proceedings against the concerned PIO.
The Respondent was unable to explain the delay in providing reply/information to the Appellant/Complainant and handed over a copy of reply to the Appellant/Complainant.
During the hearing, the Appellant/Complainant insisted for award of compensation to him upon which the Commission advised him to upload his written submissions along with a copy to Respondent substantiating as to how he has suffered any loss or any other detriment for which he is seeking Page 12 of 15 compensation and also justify the amount of compensation, but till date he has not uploaded any submissions.
Decision:
The Commission after adverting to the facts and circumstances of the case, and perusal of the records, observes that the Appellant is aggrieved that no information was provided to him by the Respondent within stipulated period as per the RTI Act.
There is nothing on record to show that any reply was given to the Appellant on his RTI application within stipulated period as per the RTI Act. It is only at the stage of second appeal that the Respondent has handed over their point- wise reply which is not even shared with the Appellant prior to the hearing. It is only during the hearing that a copy of reply was shared with the Appellant. It shows mala fide intent of the PIO in obstructing the information under the RTI Act. The Commission based on a perusal of the facts on record observes that the core contention raised by Appellant in the instant Appeal was non-receipt of complete information from the Respondent.
The Commission observes that the Appellant has sought specific information in his RTI application which should be put in public domain as per Section 4 of the RTI Act.
The Commission would like to counsel the Respondent that every public authority shall make constant endeavour to take steps in accordance with the requirements of Section 4 (1) (b) of the RTI Act to provide as much information suo moto to the public at required intervals through various means of communications, including internet, so that public does not have to resort to the use of RTI Act to obtain basic information. In this regard, the Hon'ble Supreme Court of India recently in case of Kishan Chand Jain vs. Union of India & Ors., Writ Petition (Civil) No. 990 of 2021, vide its judgement dated 17.08.2023, has held as under:
"25. Having examined the Right to Information established by the statute under Section 3 in the context of the obligations of public authorities under Section 4, we are of the opinion that the purpose and object of the statute will be accomplished only if the principle of accountability governs the relationship between 'right holders' and 'duty bearers'. The Central and State Information Commissions have a prominent place, having a statutory recognition under Chapters III and IV of the Act and their powers and functions all enumerated in detail in Section 18 of the Act. We have also noted the special power of 'Monitoring and Reporting' conferred on the Central and State Information Page 13 of 15 Commissioners which must be exercised keeping in mind the purpose and object of the Act, i.e., 'to promote transparency and accountability in working of every public authority".
26. "For the reasons stated above, we direct that the Central Information Commission and the State Information Commissions shall continuously monitor the implementation of the mandate of Section 4 of the Act as also prescribed by the Department of Personnel and Training in its Guidelines and Memorandums issued from time to time. The directions will also include instructions under O.M. dated 07.11.2019 issued by the Department. For this purpose, the Commissioners will also be entitled to issue recommendations under sub-Section (5) of Section 25 to public authorities for taking necessary steps for complying with the provisions of the Act."
In furtherance to the above directions passed by the Hon'ble Supreme Court of India, the Secretary of Central Information Commission vide letter dated 12.02.2024, has requested the Respondent Public Authority, to take necessary action for implementation of the mandate of Section 4 of the RTI Act, 2005.
Notwithstanding with the above order, the concerned PIO Shri Dr. Ravish Kasana, Veterinary Officer is directed to show-cause in writing as to why penalty should not be imposed on him for contravening the provisions of the RTI Act and as to why disciplinary action should not be initiated against him. The written submissions of the PIO shall be sent to the Commission within three weeks of the receipt of this order.
The FAA is directed to ensure compliance of this order.
The appeal is disposed of accordingly.
