Section 252 in The Maharashtra Municipal Councils, Nagar Panchayats And Industrial Townships Act, 1965

252. Council to provide or permit burning and burial grounds.

(1)A Council may, with the previous sanction of the Collector, provide suitable places for burning or burying or otherwise disposing of dead bodies and may charge for the use of any such place or for the supply of any material such fees as the Council may from time to time determine.
(2)No person shall, after the appointed day, open or provide any new place within the municipal area for the disposal of dead bodies, except with the permission of the Council:Provided that -
(i)no such permission shall be granted by the Council without the sanction of the Collector;
(ii)in granting such permission, it shall be lawful for Council to impose with the sanction of the Collector, such conditions as it may deem fit.
(3)The Council may at any time by a general or special notice require any person owning or maintaining any place for the disposal of the dead on the appointed day, to take such measures to maintaining such place in good order and in a safe sanitary condition as may be specified in the notice or may apply to the Collector under the next succeeding section to close the place.
(4)The conditions to be imposed under sub-section (2) or the measures required to be taken under sub-section (3) shall not be inconsistent with any bye-laws framed by the Council for the maintenance of places for the disposal of the dead, due regard being had to the religious usages of the community or section of the community entitled to use of such place.
(5)Any person who contravenes any provision of sub-section (2) shall, on conviction, be punished with fine which may extend to [five thousand rupees] [These words were substituted for the words 'five hundred rupees' by Maharashtra 1 of 2011, Section 32, (w.e.f. 14-1-2011).].
