36. Provision as to restriction to use certain names, etc.
(1)Any person using any name, mark or trade mark, etc., referred to in sub-section (1) of section 26 of the Act who has not obtained previous approval of the Bureau for such use shall, if such name, mark or trade mark, etc., has been established by or under any law for the time being in force, make an application to the Bureau for permission to the use thereof, within a period of six months from the date of notification of these rules and the Bureau may grant permission to such name, mark or trade mark, etc.(2)The application to be made to the Bureau under sub-rule (1) shall be in such form as may be specified by the Bureau.(3)The Bureau shall cause to be maintained a register in which shall be entered all names, marks and trademarks permitted by the Bureau under sub-rule (1).
