Heard on IA No. 4161/2018, which is an application for condonation of delay in filing CRR-1179-2018.

Considering the fact that other side has also filed CRR-2162-2017 against the same impugned order, IA No. 4161/2018 is allowed.

The delay in filing CRR-1179-2018 is condoned. With the consent of both the parties, heard finally. Both these revisions arise out of the order dated 9.6.2017 passed by the Principal Judge, Family Court, Satna granting a sum of Rs.5000/- per month to the wife towards maintenance.

The said order of granting maintenance has been challenged by the husband by filing CRR-1179-2018 contending that the amount as awarded by the Family Court towards maintenance is on higher side. On the other side, the wife has challenged the said order by filing CRR- 2162-2017 contending the amount as awarded by the Family Court towards maintenance is inadequate.

During the course of hearing it is stated across Bar by learned counsel for both the sides that both the parties have settled the dispute out of the Court and they have filed a suit under Section 13-B of the Hindu Marriage Act for divorce by mutual consent. In that view of the matter, subject to final outcome of the suit for divorce by mutual consent, both these revision may be disposed of.

Accordingly, both these revisions are disposed of. The result of these revisions would be subject to final outcome of the suit for divorce by mutual consent and the settlement entered into between the parties.
