INTRODUCTION:
1.1 This batch of appeals has been filed under Section 74 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (hereinafter referred to as "the RFCTLARR Act, 2013"), assailing the correctness of the awards passed by the Authority/Reference Court (hereinafter referred to as "the RC") on 21.11.2018, 01.05.2019, 19.08.2019, 28.08.2019 and 21.09.2019. As per the office report, the State of Haryana as well as the landowners have filed the cross-appeals.
1.2 The learned counsel representing the parties are ad idem that this batch of the appeals (details whereof are at the foot of the judgment) can be conveniently disposed of by a common judgment.
2. RELEVANT PARTICULARS
2.1 The relevant information, concerning this bunch of appeals, is compiled in a tabulated form, which is as under:-

2.2 The landowners claim that the acquired land has immense potential as it is abutting the national highway. It is surrounded by the residential, commercial and industrial entities including Mini Secretariat, District Courts and educational institutions. They claim that the market value of the acquired land is not less than ₹3,00,00,000/- per acre.
2.3 Per contra, the State of Haryana claims that the Land Acquisition Collector has correctly assessed the market value and therefore, the reference applications are required to be dismissed.
3. ORAL AND DOCUMENTARY EVIDENCE 3.1 Before the RC, in Award dated 21.09.2019, the landowners have examined the following witnesses:-

PW.4 Pushpa Patwari, Halqa Sikanderpur 3 of 26 ::: Downloaded on - 24-07-2022 11:35:10 ::: Regular First Appeal No. 728 of 2019 (O&M) AND 4 Other Connected Cases 3.2 Apart from the sale deeds, the landowners have produced two layout plans No. 252 and 253, respectively. 3.3 On the other hand, the State of Haryana has examined RW.1 Kuldeep, Patwari from the office of the Land Acquisition Collector and produced Aks Shijra as Ex.R1 and the sale deeds as Ex.R2 to Ex.R11. 3.4 In the award passed by the RC on 28.08.2019, four cases were decided. The landowners examined PW.1 Ajay Khatri, Draftsman, PW.2 Daya Kaur, PW.3 Joginder Singh, Registration Clerk and produced the layout plan (Ex.P1), sale deed No. 7860 dated 08.11.2011 (Ex.P2), sale deed No. 5227 dated 28.11.2013 (Ex.P3), revenue layout plan (Ex.P4), the collector's rate list (Ex.P5), sale deed No. 4372 dated 12.11.2012 (Ex.P6) and sale deed No. 4151 dated 13.12.2010 (Ex.P7). 3.5 On the other hand, in the aforesaid award, the State of Haryana examined RW.1 Ajay, Patwari.
3.6 In the award dated 01.05.2019, the landowners relied upon the copy of previous judgment dated 21.09.2018 whereas, the State of Haryana did not lead any evidence.
3.7 Further, for the sake of brevity, a consolidated compilation of the sale deeds/sale exemplars with the relevant information, produced by the respective parties of villages, namely Jhajjar and Sikandarpur, is tabulated as under:-

4. DISCUSSION:
4.1 The RC has noticed that the sale instances (Ex.P1 to Ex.P51) are evidences of the purchases made by the landowners themselves in the years 2005 to 2007. The sale deeds (Ex.P55 to Ex.P57) are pertaining to the years 2005 to 2007, but these cannot be taken into consideration by adding 12% per annum escalation. The sale deed (Ex.P59 dated 05.07.2011) is just two days prior to the issuance of notification under Section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as "the 1894 Act"), but is found to be relevant. The sale instance (Ex.P61 dated 06.05.2011) is 62 days prior to the issuance of notification under Section 4 of the 1894 Act. The sale instances (Ex.R2 to R11), produced by the State of Haryana, were ignored on the ground that these reflect a price lesser than the market value assessed by the Land Acquisition Collector (hereinafter referred to as "the LAC") on the ground that the compensation cannot be lower than the amount assessed by the LAC.
4.2 Thereafter, the RC took average of the sale instances (Ex.P1 to Ex.P51, Ex.P55 to Ex.P57, Ex.P59 and Ex.P61), which comes to ₹81,50,204/- per acre. The RC, after applying a deduction of 1/3rd, on account of expenditure on infrastructural facilities, assessed the market value @ ₹54,33,469/- per acre as on 07.07.2011.
4.3 In award dated 01.05.2019, the Reference Court, while relying 9 of 26 ::: Downloaded on - 24-07-2022 11:35:10 ::: Regular First Appeal No. 728 of 2019 (O&M) AND 10 Other Connected Cases upon its previous judgment dated 21.09.2018, assessed the same amount i.e. ₹54,33,469/- per acre, besides ordering the payment of solatium @ 100% additional amount @ 12% per annum, interest @ 9% for the first year and 15% per annum for the subsequent period in accordance with Section 70(2) and 70(3) of the RFCTLARR Act, 2013.
4.4 Heard the learned counsel representing both the parties and with their able assistance, perused both the paper-book as well as the various records, which were requisitioned. 4.5 The learned counsel representing the appellants contend that the RC has overlooked the letter dated 26.10.2015 issued by the Central Government which provides that the market value is required to be assessed as on 01.01.2014. They further contend that the RC has not followed the procedure as laid down under Section 26 of the RFCTLARR Act, 2013 and has committed errors while taking the average of the relevant sale deeds.
The RC has also erred in failing to multiply the market value assessed by the relevant factor as provided in Section 26(2) of the RFCTLARR Act 2013.
While questioning the correctness of the development cut of 1/3rd applied by the RC, the learned counsel has contended that once the comparable sale instances of the contemporaneous period have been produced, the decision to impose 1/3rd cut, on the base value, is erroneous.
4.6 Per contra, the learned counsel representing the State of Haryana contends that the RC has neither decided the cases in accordance with Section 26 read with Section 30 of the RFCTLARR Act, 2013, nor it has taken into consideration the sale deeds produced by the State of Haryana. It has further been contended that there has been a downfall in the 10 of 26 ::: Downloaded on - 24-07-2022 11:35:10 ::: Regular First Appeal No. 728 of 2019 (O&M) AND 11 Other Connected Cases real estate market, therefore, the prices are not likely to increase in a consistent manner.
4.7 From a careful reading of the judgment, passed by the RC, it is evident that the RC has overlooked the provisions of Section 26 of the 2013 Act, which provides that the LAC is required to assess the market value which is the highest after examining the three different approaches given in Section 26 itself. Furthermore, the RC has also overlooked the explanation (1), (2), (3) and (4) added to the Section 26(1) of the RFCTLARR Act 2013.
It is also evident that the sale instances of the calender year 2011 could not be taken into consideration in view of the Explanation (1) to Section 26(1) of the RFCTLARR Act 2013.
4.8 As regards the issue of the communication dated 26.10.2015, the matter has been examined by this Bench in State of Haryana and Another v. Rajbir and Another (Regular First Appeal No. 309 of 2021, decided on 19.04.2022), the relevant part thereof is extracted as under:-
"14. Section 23 of the 1894 Act specifically provides that the crucial date for assessment of the market value of the acquired land shall be the date of publication of notification under Section 4(1) of the 1894 Act. Further, the additional amount/benefit under sub-section(1-A) of Section 23 of the 1894 Act is, also, required to be calculated from the date of publication of notification under Section 4(1) till the date of award of the Collector or the date of taking possession of the acquired land whichever is earlier. Section 24(1)(a) of the RFCTLARR Act, 2013 which specifically takes care of 11 of 26 ::: Downloaded on - 24-07-2022 11:35:10 ::: Regular First Appeal No. 728 of 2019 (O&M) AND 12 Other Connected Cases transitional period between the 1894 Act and the RFCTLARR Act, 2013, does not provide that the date of enforcement of the Act shall be construed as the date of issuance of notification under Section 4(2) or Section 11 of the RFCTLARR Act, 2013. Proviso to sub-section (1) of Section 26 provides that the date of determination of the market value shall be the date on which the notification has been issued under Section 11 of the RFCTLARR Act, 2013. Notification under Section 11 is a preliminary notification issued by the Government expressing its desire to acquire the land.

Further, Section 30(3) of the RFCTLARR Act, 2013, provides that the additional amount at the rate of 12% per annum on such market value is required to be calculated from the date of publication of notification for conducting Social Impact Assessment Study of the proposed land under sub- section (2) of Section 4 of RFCTLARR Act, 2013, till the date of award of the Collector or the date of taking possession of the land whichever is earlier. If the communication is considered as a direction issued by the Central Government in exercise of powers under Section 113 and the date of such assessment of the market value is taken as 01.01.2014, then, the same shall not only be in violation of Section 24 of the 1894 Act but also an infringement of the proviso to Section 26 (1) of the RFCTLARR Act, 2013. Clause 5 of Section 24 of the 1894 Act provides that any increase in the value of the acquired land 12 of 26 ::: Downloaded on - 24-07-2022 11:35:10 ::: Regular First Appeal No. 728 of 2019 (O&M) AND 13 Other Connected Cases which is likely to accrue from the use to which it might be put when acquired is to be ignored. In fact, by the aforesaid letter, the goalpost itself is sought to be changed. The date of assessment of the market value of the acquired land either under the 1894 Act or RFCTLARR Act, 2013 is sought to be overridden/surpassed. Both the Acts are based on the fundamental rule that the date of preliminary notification shall be the date for assessment of the market value. Once, there is no specific provision providing for assessment as on 01.01.2014, in the considered opinion of the Court the communication should be construed as arbitrary and ultra- vires to the provisions of both the Acts.
16. This matter can be examined from yet another perspective. By changing the goalpost to 01.01.2014, the exemplar sale deeds which have been executed and registered post the date of preliminary notification under Section 4 of the 1894 Act which are, ordinarily excluded from consideration, shall be required to be taken into account and thus, will go against the legislative approach, otherwise provided under both the Acts. In such a situation, it will become difficult for the courts to distinguish between bonafide sale deeds and the pretentious sale deeds which have been executed only to jack up the claim for compensation. Once, the factum of proposed acquisition of the land in the vicinity is in the knowledge of the residents of the area or landowners, then, the possibility of 13 of 26 ::: Downloaded on - 24-07-2022 11:35:10 ::: Regular First Appeal No. 728 of 2019 (O&M) AND 14 Other Connected Cases executing sale deeds with malafide intent for jacking up prices in the area would increase.

19. This matter for the purpose of interpretation can be considered from yet another perspective. If the intention of the Legislature was to apply all the provisions of the RFCTLARR Act, 2013, there was no necessity to enact a hybrid provision like Section 24(1)(a). In such case, it would have contained a provision that the pending or incomplete acquisition proceedings, shall lapse and the acquiring authority will start the proceedings afresh under the RFCTLARR Act, 2013. On a careful reading of Section 24(1)(a), it is evident that only the provisions relating to determination of compensation of the RFCTLARR Act, 2013 have been made applicable while saving the notifications under Section 4 and 6 of the 1894 Act. The Legislature does not also provide that all the provisions of the RFCTLARR Act, 2013, shall be applicable with respect to the incomplete proceeding under the 1894 Act. 20 XXXX XXXX XXXX XXXX XX
21. This court also does not find any substance in the arguments of the learned counsel that the communication dated 26.10.2015 is supplementary and does not supplant the Act. In the considered opinion of the court, the aforesaid letter is in conflict with the provisions of the Act, consequently, if taken into account, it would result in supplanting the provisions of the 14 of 26 ::: Downloaded on - 24-07-2022 11:35:10 ::: Regular First Appeal No. 728 of 2019 (O&M) AND 15 Other Connected Cases RFCTLARR Act, 2013, as to its implementation to the cases arising during the transition period.

30. While answering the question No.1, it is declared that under Section 24(1)(a) during the transitional period, the market value will have to be assessed on the date of publication of notification under Section 4(1) of the 1894 Act. Similarly, the additional amount under Section 30(3) of the RFCTLARR Act, 2013 shall be calculated from the date of publication of notification under Section 4 of the 1894 Act till the date of the award or date of taking possession of the land, whichever is earlier".
4.9 The RC has also erred in overlooking the sale instances (Ex.R2 to Ex.R11), produced by the State of Haryana, on the ground that they reflect a price lower than the market value assessed by the LAC. Even in the 2013 Act, there is no prohibition on the Court to take into account the sale deeds reflecting a price lower than what was assessed by the LAC. The only bar is that the market value cannot be assessed below the amount assessed by the LAC. In fact, Section 26 of the RFCTLARR Act 2013 provides for a totally different approach for the assessment of the market value of the acquired land. Further, the RC has not noticed that the market value arrived at, under sub-section (1) to Section 26 of the RFCTLARR Act 2013 was required to be multiplied by the relevant factor.
4.10 In the award, passed by the RC on 09.11.2018 and 19.08.2019, the same Presiding Judge has relied upon its previous award dated 15 of 26 ::: Downloaded on - 24-07-2022 11:35:10 ::: Regular First Appeal No. 728 of 2019 (O&M) AND 16 Other Connected Cases 21.09.2018. The RC found that the sale deeds No. 7860 (dated 08.11.2011), 5227 (dated 28.11.2013) and 4372 (dated 12.11.2012) are post the date of notification under Section 4 of the 1894 Act, therefore, it cannot be relied upon. However, vide award dated 28.08.2019, the RC relies upon the sale deed 4151 (dated 13.12.2010) with respect to the plot measuring 310 square yards, which has been sold for ₹6,51,000/-. The RC, after calculating the per acre rate @ ₹1,01,64,000/-, applied the deduction of 1/3rd to arrive at a figure of ₹67,76,000/- per acre.
5. DECISION:
5.1 For the reasons stated above, it is considered appropriate to remit the matter back to the RC for deciding the matters afresh, after granting an opportunity to the parties to lead further evidence, if any. Let the RC decide the matter within a period of six months, from today. 5.2 With the observations made above, all the appeals as well as cross-objections are disposed of.
5.3 The parties are directed to appear before the RC on 06.07.2022. 5.4 The miscellaneous application(s) pending, if any, in all the appeals, shall stand disposed of.
