Section 278(2) in The General Rules (Criminal), 1977

(2)Ordinary.Prisoners may be admitted to the superior class by order of the State Government. The rules relating to the treatment of superior class prisoners in jails are contained in chapter XIII (Jail Manual).All convicted prisoners, who are not admitted to the superior class, shall be known as ordinary class prisoners and shall be governed by the general rules regarding the treatment of prisoners as contained in the Jail Manual.[279. Recommendation for superior class. - (a) In respect of Criminal Prisoner who is an accused before it, whether in trial, enquiry appeal or revision, and keeping in view the provisions of paragraph 280, the High Court may recommend to the State Government, and a Court of Session or a Magistrate may recommend to the District Magistrate for his admission to superior class.
(b)the High Court may, pending receipt of the order of the State Government direct the Superintendent of the Jail concerned to admit the prisoner provisionally to the superior class and the Superintendent of jail shall comply with such direction.]
