Petition under Section 151 CPC praying that in the circumstances stated in the
affidavit filed in W.P., the High Court may be pleased to suspend the operation of the
proceedings bearing Lr. No. DAAO/A2/Affi-colleges/ZA-2020/2020 dt. 12.11.2020 and
the letter dt. 28.11.2020 issued by the 5th respondent by directing the respondents
herein to include the name of the 2nd petitioner College in the Web Counseling Portal to
enable the 2nd petitioner college to have intake of students for the academic year 2020-
2021, pending disposal of WP No. 24753 of 2020, on the file of the High Court.

The court while directing issue of notice to the Respondents herein to show
cause as to why this application should not be complied with, made the following
order.(The receipt of this order will be deemed to be the receipt of notice in the case).

ORDER

HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI TA NO.1 OF 2020 IN W.P.NO.24753 OF 2020 Order:

The Writ Petition is filed to declare the proceedings dated 12.11.2020 and the letter dated 28.11.2020 issued by the fifth respondent as arbitrary and illegal and a consequential direction was sought to permit the second petitioner to take students for the academic year 2020-21 as per the approval of the AICTE dated 15.06.2020.

The case of the petitioners is that the second petitioner is an approved technical institution established by the first petitioner society and offering Undergraduate, Postgraduate and Diploma courses after having been granted approval from the AICTE for the academic year 2020-21 vide proceedings dated 15.06.2020; the fifth respondent is tasked with granting of affiliation for colleges approved by AICTE after conducting an inspection by the expert committee and for the academic year 2020-21, the fifth respondent issued notification inviting applications from the institutions seeking affiliation and the second petitioner submitted the application on 05.10.2020 duly complying with the statutory requirements prescribed by the fifth respondent for grant of affiliation; pursuant to the said application, a fact finding committee of the university conducted inspection of the second petitioner College on 17.10.2020 and thereafter the second petitioner College was communicated deficiency report dated 29.10.2020 by the fifth respondent calling for its explanation; in response to the deficiency report dated 29.10.2020, the second petitioner submitted its compliance report along with covering letter dated 31.10.2020 and the deficiencies mentioned are minimal and can be ed rectified in due course; despite the same, the second scpondent issued the proceedings dated 12.11.2020 whereunder the petitioner institution was placed under Zero admissions category for the academic year 2020- 21; in the said proceedings it is stated that the deficiencies will be communicated shortly; assailing the said proceedings dated 12.11.2020, the petitioners filed WP No.22040 of 2020 and this Court on 26.11.2020 recorded that as the petitioners were intimated the deficiencies vide letter dated 25.11.2020, the writ petitioner would submit its reply and the University was directed to deal with the same in accordance with law; on 27.11.2020, the petitioners submitted explanation and the fifth respondent issued proceedings dated 28.11.2020 stating that the reply of the petitioners has been considered and the decision to keep the college under zero admission remains unchanged; after receiving the proceedings dated 28.11.2020 the petitioners have withdrawn W.P.No.22040 of 2020 with liberty to file a comprehensive Writ Petition; challenging the proceedings dated 12.11.2020 and the letter dated 28.11.2020 issued by the fifth respondent, the present Writ Petition is filed.

Learned Senior Counsel Sri P. Venugopal, appearing for the learned counsel for the petitioners on record Sri Ch. Siddhartha Sarma, submits that the fifth respondent is governed by the provisions of the Andhra Pradesh Higher Education Regulatory and Monitoring Commission Act, 2019 (Act No.20 of 2019) and that neither the Act nor the Rules framed under the said Act speak about the Zero admission and hence there is no source of power to the fifth respondent to place the colleges in Zero Admission list for the academic year; the petitioner Institution undertakes to pay the University Common Service Fee and the affiliation fee and an amount of Rs.35,96,250/- is due from the State Government towards fees reimbursement; the less enrolment of the students cannot be a ground to reject the affiliation; the deficiencies mentioned therein are minimal and can be rectified in due course of time and the petitioner college has been put on Zero admission category without informing what are the deficiencies are; the deficiency pointed out with regard to teacher student ratio ought to have been considered on the admitted strength and not on the sanctioned strength; the staff members were already appointed from 01.11.2020; the deficiencies with regard to library titles is not there in the first deficiency report dated 29.10.2020 and the pandemic situation has made it difficult to comply with the deficiencies pointed out and that the reduced intake will satisfy the required student teacher ratio as pointed out by the petitioners in their letter dated 27.11.2020 and with regard to non-availability of 100. MBPS internet connection, the petitioners submitted a bill for 1400 GP plan which is only available in 100 MBPS bandwidth; unless the petitioner college is notified for admission in the ensuing Counselling for the academic year 2020-21, it would be impossible for the petitioner institution to have any intake for the entire year and hence a direction is sought to exhibit the petitioner institution in the website/web Counselling portal enabling the petitioner institution to take the students for the academic year 2020-21.

Learned Government Pleader and learned Standing Counsel for the fifth respondent University submit that basing on the inspection report and the explanation submitted by the petitioners, the second petitioner was put on Zero admission category and that there are many deficiencies that were pointed out by the inspection committee.

As seen from the proceedings of the All India Council for Technical Education dated 15.06.2020 granting extension of approval for the FER aety academic year 2020-21 to the petitioner Institution, it is clearly|stated that the Institution has to fulfill all the facilities such as infrastructure, faculty and other requirements as per the norms specified in the Approval Process Handbook 2020-21 for the total approved intake and that the approval is subject to strict compliance of provisions made in AICTE Regulation dated 01.07.2009 for prevention and prohibition of ragging in technical institutions. Pursuant to the application made by the petitioner dated 05.10.2020 for affiliation for the academic year 2020-21 from the JNTU, the fifth respondent conducted physical inspection on 17.10.2020 by two faculty members working in the University and the inspection committee pointed out the following deficiencies.

"1. In pursuance of the orders of the Government, your institution is responsible for collecting the University Common Services fee from the admitted students as per the details given in the respective Government orders. You have no right to retain in your custody and as and when you have received the amount from the students, you have to credit the same to the account of the university within stipulated period. Under any circumstances, you have no right to keep the amount with you. The following amounts are yet to be paid to the University by your institution, based on admitted students. As per the records available with the University, demanding you to pay all the due amounts to the University. The particulars of the dues are also mentioned below:
University Common Services Fee to be paid to this University: Rs.1745900-00 Your Institution has to pay the Affiliation Fee based on the sanctioned strength of the students. Your Institution -- has to pay the affiliation fee to the University till the academic year 2019-20, as follows.
Affiliation Fee to be paid to this University: Rs.661600-00 In the 14 Executive council meeting it is unanimously resolved to stop the admission for the academic year
- 2020-21, if the due amounts were not paid till the academic year 2019-20, within two days from the date of this explanation called for notice.

2. It is also observed by our faculty members who visited to your institution that there are some particular members who are shown as the faculty members of your institution in the application submitted by you, the very same members were also shown as faculty members in the other institutions also.

Thus, it is call upon you to submit the salary particulars paid to these faculty members during last six months, appointment orders, Original certificates and proof of their working, i.e., attendance register, etc., to the University within two days. Further, these faculty members working in the multiple institutions will be considered seriously by the University and necessary action will be taken. You are hereby call upon you to give proper explanation if any in this regard. The list of the faculty members are given in enclosed Annexure-1.

3. | With reference to the inspection reports submitted by the inspection teams, the University has scrutinized the applications and inspection reports. It is noticed that your Institution is not having the sufficient admissions in the following disciplines and an average of three years admission considering the lateral entry of students is less than 25%, as given in Annexure-2.

Thereby, your Institution is liable to give explanatory note, how it will be viable to your institution to run these courses with less admitted strength, while continuing the required faculty strength, payment of salaries, library facilities, Laboratory facilities and other expenditure to le incurred by maintaining the required standards.

4. With reference to the inspection reports submitted by the inspection teams, the university has scrutinized the applications and inspection reports. IN addition, Andhra Pradesh State Higher Education Regulatory and Monitoring Commission (Andhra Pradesh Higher Education Regulatory and Monitoring Commissions) inspected your institution earlier. The deficiencies as given in the Annexure -- 3, are noted in your Institution, and not meeting the AICTE norms to maintain the required standards.

It is therefore you are call upon to submit the explanatory note for the above referred deficiencies in your institutions and you are required to submit the details within the stipulated time."

The said deficiencies report dated 29.10.2020 was communicated to the petitioners and according to Annexure-II of the deficiency report, average admissions in the last three years is 12.4% for B.Tech stream and Annexure-III of the said report deals with the mandatory parameters and other academic parameters, wherein deficiencies are shown. It is also pointed out therein that none of the last year deficiencies were complied with. The major comments of scrutiny committee are as follows.

"1. Average Admissions for the last three years in B.Tech is 12.4%
2. All the Laboratories are to be strengthened as per the curriculum.
. No legal software's are available . Shortage of STR by 60% . None of the teaching faculty are ratified . Faculty ~ cadre ratio is not as per norms . E-journals are to be procured . Shortage of Bio-metric Devices 70% . No internet facility in the institution WOON AUK W » watt (
10. Governing body meetings are not conducted in the presence of university nominee
11. None of the last year deficiencies are complied
12. Sports facilities, placement office, women protection cell and NSS Unit are not available Officer
13. Anti ragging measures are not taken.
14. Barrier free environment is not existing."

The petitioners submitted the compliance report explaining the deficiencies vide letter dated 31.10.2020 stating that they would clear all pending fees to the University before 30.11.2020 and with regard to the allegation that a particular faculty member was shown as a faculty member in the other Institution also the petitioner was called upon to submit the salary particulars which are paid to the said faculty member, appointment order, original certificate, proof of their working i.e., attendance register etc. But, Annexure-I compliance report submitted by the petitioners only shows that all the original certificates are enclosed and it is also stated that they would recruit the faculty as per the norms and will improve the library facilities and with regard to Annexure-III of the deficiency report, the compliance report showed that they would comply with the same. After the explanation of the petitioners, the impugned letter dated 12.11.2020 was issued placing the petitioner institution in Zero admission category. The said proceedings dated 12.11.2020 shows that it is based on the note orders of the Vice- Chancellor dated 12.11.2020 and the recommendation of the Standing Committee for Affiliation. As the details of the deficiencies though communicated to the petitioners vide letter dated 29.10.2020, as the petitioners submitted the compliance report on 31.10.2020, it is once again stated in the impugned letter dated 12.11.2020 that the details of the deficiencies will be communicated shortly and accordingly the deficiencies were intimated vide letter dated 25.11.2020. As seen from the said letter dated 25.11.2020 the compliance report submitted by the petitioners on 31.10.2020 was taken into account and the following deficiencies were intimated.

"1. Student-Teacher Ratio (STR): As per AICTE norms, the college shall have 1:20 STR for UG programs. The college is having 1080 students intake since 2017-18 including the requested intake for 2020-21). So the total qualified faculty shall be
54. But as per Fact Finding Committee Report, there are only 24 faculty members available. The deficiency is 56%.
| In your compliance report you have mentioned that you will improve the STR. But the required number shall be available on the day of FFC inspection.
2. Deficiency of library facility: As per AICTE norms, the number of titles required is 3300 and the number of volumes required is 16500. But only 1565 titles and 7497 volumes are available. So there is considerable deficiency in library facilities.
3. The college is not having internet facility as per AICTE norms, as per FFC report which is a serious deficiency. It is not understandable how the college is able to conduct the examinations without AICTE stipulated 100 MBPS internet facility.
4. You have' submitted a _ notarized undertaking wherein you have claimed that you are paying AICTE pay scales to the faculty, but there is no documentary evidence.
5. Many mandatory facilities stipulated by AICTE as given below are not available in your institution:
(i) Barrier free environment
(ii) Sports facilities
(iii) Placement office
(iv) Women protection cell
(v) Anti-ragging measures
6. The Biometric attendance devices for students are to be installed at the ratio of 1 machine for 50 students. There is a shortage of 70% in biometric machines available.
7. Poor admissions: The admissions of a college reflect the quality of education offered by the institution and the quality of teachers and _ infrastructure available. The college has recorded a very dismal percentage of 12.4% on an average for the last three years.

Because of these deficiencies, your college is kept under ZERO ADMISSIONS category for the academic year 2020-21 so that you can improve the facilities to the required standards and apply for affiliation next year."

And basing on the directions granted in WP No.22040 of 2020, the petitioners again submitted explanation on 27.11.2020 which reads as follows.

"1. Student-Teacher Ratio
a) You are aware of the fact that most of the institutions are following student -- teacher ratio on admitted strength, but not on the sanctioned intake strength.

The same system is following by most of the affiliated institutions in our University and it is the deficiency.

b) Noticed for most of the colleges by the FFC and the university though found that deficiency in most of the colleges, only verifying the compliance of the STR with the admitted intake, even after recording the deficiency in STR with approved intake, the University granted affiliation to many institutions, few of the institutions are as follows.

1. Sai Rajeshwari Institute of Technology-Proddatur, | YSR-Kadapa district 1 " <

2. Quba college of Technology and Technology-SRSR Nellore district

3. SKR college of Engineering and Technology-SPSR Nellore district.

If the university is disputing that there is no deficiency for the above mentioned institutions with regard, to faculty (STR) when compared with approved intake, the FFC report and evaluation report of those institutions may be produced before the Hon'ble High Court for kind perusal.

But the University targeted only our College on the same Student-Teacher Ratio, though we have sufficient faculty for admitted intake and there is no deficiency for admitted intake. Due to Covid-19 pandemic, few of the existing faculty discontinued and at the time of University inspection we have 29 number of faculty. We are taking steps to appoint the required faculty to make good the availability of faculty to meet the STR with the approved intake.

The faculty available at our institution presently sufficient for the admitted intake is as follows:

For first year (2020-21 students to be admitted) the approved intake is 240 and the required faculty for the first year is as follows:
Faculty Required: 12 Faculty Available: 12 For second year the approved intake is 240 and the admitted intake is 04 and required faculty for the admitted intake is as follows:
Four students admitted in CSE branch only.
Faculty required: 03 11 For third year the approved intake is 240 and the admitted intake is ZERO.
For fourth year the approved intake is 240 and the admitted intake is 119 the required faculty for the admitted intake is as follows:
Faculty required: 15 Faculty available: 18
(b) For fact finding committee we submitted list of 29 staff members. I am herewith enclosing the same copy for your ready reference.

_ (c) After receiving your earlier deficiencies letter dated 29.10.2020 we appointed 4 (four) more staff members for Civil (01), CSE (01) and H&S (02) from 01.11.2020 onwards. I am herewith enclosing the details of the above four staff members.

(d) I am herewith attaching the allocated time table for the existing staff members for your ready reference.

2. Deficiency of the Library facility:

Now it is wonder for me receiving the deficiency in Library Titles and Volumes, your earlier deficiencies report dated 29.10.2020.
You have mentioned to procure E books. For that I am herewith enclosing the proof of consortium fee (to procure E books) paid by our society to the Registrar, JNTUA.

3.Internet:

I'am herewith enclosing BSNL data bill against 1400 GB Tariff Plan, for your ready reference. The Bill is generated in the month of November; it reflects the past six month's usage history.

4. We are paying the salaries regularly, even in his pandemic situation, COVID19 and evidence is submitted to FFC.

(i) Barrier free environment.

We will take all measures in maintaining barrier free environment. We placed order for one elevator to M/s. Adler Elevators Ltd, in the month of February 2020. We received the assembled parts of the equipment. Assembling process is delayed due to the pandemic situation. The installation process will be completed when the normal situation comes. We are herewith enclosing the bills.

(ii) Sports facilities We have Indoor and Outdoor sports facilities.

(iii) Placement Office We have fully furnished and modernized placement cell and the same is observed by the FFC. You can check which is recorded at the time of FFC inspection, the same is submitted (photos & Videos) to FFC

(iv) Women protection Cell:

We have taken all measures for these also.
(v) Anti-ragging measures:
We have taken all measures for this and there is no complaint from 2008 to till date.
Biometric Attendance:
We have sufficient Biometric machines for the available students.
We will purchase immediately for the academic year 2020-21 admitting students. Many respectable persons advised not use biometric machines in this pandemic situation. Even though, we are going to procure the biometric machines before admissions.
Poor admissions.
Poor admissions is not in our hands. Our society is established in 1985, by running UG, PG and technical kee, ol 13 institutions with high quality of teachers, infrastructure with moral values and ethics.
By pursuing the above facts, kindly consider our request and grant affiliation for the academic year 2020-21 for the smooth running of the institute without suffering the staff and students."
After receipt of the said reply dated 27.11.2020, again the impugned letter dated 28.11.2020 is issued observing as follows.
"1. As far as the student-teacher ratio is concerned, it shall be based on the permitted intake for different years and not based on admitted strength.

Your answer itself states that your institution does not have required STR based on intake. Further, yhou have taken a comparison with other colleges regarding STR. Here is the observation of standing committee for affiliation based on FFC reports on STR position:

2. Regarding the library facilities, deficiencies are pointed about physical titles and volumes as per clause

5.3 of AICTE Approval Process Handbook (2020-21), but you have raised the point of e-resources which is totally different and irrelevant to the context.

3. The deficiency about the internet is regarding the band width. You should have a band width of 100 MBPS for the approved intake as per AICTE, but you do not have that band width as per FFC report. The bill for 1400 GB is not a proof of 100 MBPS band width availability.

4, Regarding the salaries, our deficiency report states about your undertaking wherein you have claimed that AICTE pay scales are given. No proof of payment of AICTE scales is presented.

5. As far as barrier free environment is concerned, your answer itself is an indication that it is yet to be provided and not in place.

6. As per FFC report you do not have Women protection Cell, Physical Director and Anti-Ragging measures.

7. The biometric machines are mandatory for Government schemes related to the students and they also shall be based on intake.

8. Poor admissions definitely reflect low quality teaching, low quality faculty and the general impression the students have on the college. The statement that the admissions are not in our hands does not justify the poor quality of education. The college shall improve the quality of faculty, labs and other infrastructure to attract students by creating proper academic ambience.

In view of the above facts, we are not satisfied by your explanation and the decision to keep your college under ZERO ADMISSION remains unchanged."

As seen from the said impugned letter dated 28.11.2020, it is stated that the student-teacher ratio should be based on the permitted intake for different years and not based on the admitted strength and that no proof has been submitted by the petitioners with regard to payment of AICTE scales and that the explanation submitted by the petitioners is not satisfactory. The issue whether student-teacher ratio should be based on permitted intake or on the basis of admitted strength can only be decided H 15 after counter affidavits are filed. Prima facie, it appears that the AP Higher Education Regulatory and Monitoring Commission Act, 2019 does not deal with the affiliation of an institution and the said Act mainly deals with the regulation of fee in higher educational institutions and such other matters. The commission also has the power to deal with the standards of admission, teaching, examination etc. As seen from the impugned letter dated 12.11.2020, it is based on the recommendation of the standing committee for affiliation and the guidelines received from the Department of Higher Education and APHERMC. The said guidelines are not before this Court at this stage. The impugned letter dated 28.11.2020 shows that it is based on deficiency report and approval process handbook and not under Act 20 of 2019. The contention of the learned counsel that Section 9 of Act 20 of 2019 does not empower the fifth respondent to keep the second petitioner under Zero Admission Category does not merit consideration, because the impugned letter is not issued under Section 9 of the said Act, which deals with powers of the Commission established under the said Act. In the present case, the impugned letters are issued by the affiliating authority i.e., the fifth respondent University. And with regard to report of the fact finding committee of the University, this Court is of the prima facie opinion that a detailed examination of the said report is not permitted as the Hon'ble Supreme Court in a decision reported in Medical Council of India v. N.C. Medical College and Hospital?, held as follows.

18. On the one hand, the High Court has doubted the report of inspection and for that surprisingly relied on the self-serving contents of the website of the college. There is nothing to vouch for the authenticity of 1 2019(11) SCC 738 16 the website information. It is not what the institution asserts. on website but what is actually found on inspection, that has to be considered by the court and while exercising judicial review it is settled law that court cannot sit in appeal over the report of the assessors as observed in Medical Council of India v. Kalinga Institute of Medical Sciences (KIMS), (2016) 11 SCC 530 thus :

"21. A perusal of the decision of the High Court clearly indicates that it considered the latest report of the Inspection Team as if it was hearing an appeal against the report. In doing so, the High Court went into great details on issues relating to the number of teaching beds in the hospital, the limitations in the OPD Department, the number of units available in the subjects of General Medicine, Pediatrics etc., bed occupancy, number of Caesarean sections, discrepancy in data of major and minor operations, computerization in the institution, number of patients in the ICU, number of static X-ray machines, deficiency of examination halls, lecture theatres, library, students hostel, interns hostel, playground etc. etc. Surely, this was not within the domain of the High Court in exercise of its jurisdiction under Article 226 of the Constitution.
22. The High Court did not appreciate that the inspection was carried out by eminent Professors from reputed medical institutions who were experts in the field and the best persons to give an unbiased report on the facilities in KIMS. The High Court under Article 226 of the Constitution was certainly not tasked to minutely examine the contents of the inspection report and. weigh them against the objections of KIMS in respect of each Se ce?
To, co GON Skm 17 of its 18 items. In our opinion, the High Court plainly exceeded its jurisdiction in this regard in venturing into seriously disputed factual issues."

Admittedly, the petitioner college is not affiliated to the fifth respondent University and as the matter is coming up for admission for the first time, if an interim direction as sought for by the petitioners is granted at this stage suspending the impugned letters dated 12.11.2020 and 28.11.2020 and directing to include the petitioner college in Web Counselling portal, the second petitioner will admit the students for the academic year 2020-21 and the fate of the students who are admitted in the petitioner college will depend upon the result of the present Writ Petition.
