ORDER
By Hon'ble Manish Garg, Member (J) In the present OA, the applicant is seeking following reliefs:
"(a) Direct the respondents to implement the recommendations of committee on Career Advancement of Staff in ITI‟s & fix the pay/pay scales as per recommendations i.e. 01/01/2006 (without arrears) and arrears with interest @ of 12% w.e.f. the date of submission of report i.e. 19/5/2011 to the date of disbursement with all consequential benefits as mentioned in Annexure A/2.
(b) award costs of the proceedings and
(c) Pass any other order/direction which this Hon‟ble Tribunal deem fit and proper in favour of the applicant and against the respondents in the facts and circumstances of the case."
2. Brief facts:
2.1 The applicants are serving as Craft Instructors, Group Instructors & Librarians in Department of Training and 45 OA No. 1705/2016 Technical Education (DTTE), Govt. of NCT of Delhi. They are aggrieved by arbitrary and discriminatory action of the respondents in not implementing the recommendations of the Committee constituted by the respondents for career advancement of staff serving in the DTTE.
2.2 It is submitted by the applicants that as can be seen from the seniority list of Craft Instructors and other equivalent posts there are 397 regular Instructors including Craft Instructor of different Trades, Language Instructor, Maths Instructor, Drawing Instructor, Steno Instructor etc. Out of these 397 Instructors, 72% are applicants in the instant case, who were appointed between 1983 and 2013 on different dates. Remaining applicants are Librarians, Instructor (AVTS) and Group Instructors, who got promotion on different dates after stagnating for years together. Some of them are members of Departmental Staff Welfare Association, namely, Training Institute‟s Engineers Welfare Association of Delhi (TIEWAD).
2.3 The applicants submit that it is clear from the details given in the seniority list that there is acute stagnation in DTTE. The individuals who have joined 24-25 years back have not yet got even a single promotion. They have been requesting respondents time and again to ensure at least two-
three promotions in entire service career, as provisions for 46 OA No. 1705/2016 promotion increases efficiency in public service while stagnation reduces efficiency and make the service ineffective but the respondents did not consider the repeated request of applicants. The respondents are bound to carry out cadre review as made mandatory by DOP&T. 2.4 Applicants further submit that in the meeting of Ad hoc Task Force (ATF) of Ministry of Labour and employment on result framework documents (RFD) for the year 2010-11 held on 26.03.2010 where it was decided to conduct a nationwide study on performance evaluation of Industrial Training Institutes (ITIs)/ITC to find out the efficiency of ITIs. The study was conducted by Quality Council of India (QCI) on behalf of DTTE.
2.5 The applicants further submit that the staff welfare association namely TIEWAD, repeatedly submit the grievances regarding elevation/upgradation of instructional staff and to give the existing promotion policy and financial upgradation policy. The DTTE after noticing the frequent representations related to similar grievances from different category constituted the committee, named, Committee on Career Advancement of Staff in ITI comprising of eminent professor from countries, elite institutions, like IIT Delhi, Delhi Technological University, Jamia Millia Islamia and its own three senior officers in November 2010. 47 OA No. 1705/2016 2.6 The administrative department initiated regarding the following recommendations:
(1) To introduce the concept of academic grade pay and non-compounded advance increment proportion to the qualification as in polytechnics.
(2) To consider the elevation of all categories ranging from bottom to top of the organisational chart.
2.7 The Committee observed, how the existing policies are acting like the barriers to get the benefits which the employees are entitled otherwise. It looked into all aspects/ recommendations of QCI and submitted its report in September 2011. They further submit that the administrative department, i.e. DTTE consume unreasonable time to decide the course of action to initiate the process of implementation of the recommendation of Committee on career advancement of staff in ITIs. The noting sheet reveal that the then Principal Secretary/Director DTTE and Assistant Director (Trg.) were solely responsible for delay.
2.8 Meanwhile, applicants kept on making representations to the respondents, including representation dated 27.03.2015, to implement the recommendations of the Committee on career advancement but of no avail. In the aforesaid facts and circumstances, the applicants approached this Tribunal by filing OA No.2304/2015 which was disposed 48 OA No. 1705/2016 of vide order dated 02.07.2015 directing the respondents to dispose of the representation dated 27.03.2015, keeping in view the submission made therein by passing a reasoned and speaking order in accordance with law within 90 days from the date of receipt of that order.
2.9 However, the respondents instead of implementing the recommendation have issued the impugned order dated 15.10.2015 stating therein that the matter has been forwarded to 7th CPC for consideration vide their letter dated 07.08.2015. It is further submitted that while reaching the conclusion to refer the matter to 7th CPC neither the DTTE nor the Finance Department of GNCTD considered the contents of the letter dated 20.10.2014 wherein it was advised that the approval of Ministry of Finance, Govt. of India is required for upgrading the pay scale of existing post. At this juncture, 7th CPC is neither under any obligation nor legally bound to consider or give any reasoning behind the act of non-consideration or making any correspondence with the Administrative Department regarding the matter. According to them, since the service condition of technical staff of ITIs are governed by recommendations of Pay Commission, it is for the Pay Commission to take a final view in the matter. With this misconceived notion, the recommendations of the Committee duly constituted under law have been forwarded 49 OA No. 1705/2016 to the 7th CPC. In this connection, it is submitted that the recommendations made by the Committee are based on and in sync with Govt. of India decision accepting the recommendations made by QCI and directing implementation thereof by the States/UT. It is further submitted that once a decision has been taken at the level of UOI, this administrative department, viz. DTTE and also the Finance Department of UT of Delhi have no further role or competence in the matter except to implement the same. However, respondents have grossly misdirected the claim of applicants. 2.10 It is also submitted that in similar matter pertaining to DASS cadre, the GNCTD has referred the matter to MHA and the same was approved and also implemented without being referred to the 7th CPC. It shall not be out of place to mention here that 7th CPC has already submits its report and there is absolutely no consideration on this aspect. Hence the OA.

Per contra, learned counsel for respondents on behalf of respondent No.1 to 5 & 9 filed the counter reply contending that a committee was constituted with the approval of respondent No.3 for dealing with the issues/grievances raised by the TIEWAD vide letter dated 12.03.2010 related to their career advancement. The Committee after going through all the aspects of the grievances raised submitted its final report 50 OA No. 1705/2016 on 19.09.2011 to respondent No.3. It is submitted that the DTTE after duly considering the recommendations made by the aforesaid Committee, forwarded the same to the Finance (Accounts) Department, GNCTD, respondent No.4 herein on 19.10.2012. Consequent to aforesaid, Respondent No.4 advised the Administrative Department to examine the proposal and also sought clarification, "whether the committee for Career advancement has been constituted by the Deptt. in pursuance of the recommendations of Quality Council of India or any other Competent Authority?" and returned the file to department on 22.04.2013. All the queries were clarified by the department and the matter was once again referred to respondent No.4 on 05.07.2013 for its opinion. Thereafter, the matter was referred to DGE&T, respondent No.6 herein. In view of the aforesaid, the respondent sent letter dated 21.04.2014 along with agenda note to respondent No.6 indicating therein that the recommendation of the committee on advancement of staff in ITIs along with its proposal for discussion in the next National Council for Vocational Training (NCVT), but however, for reason best known to respondent No.6 the note was not placed in NCVT meeting.
4. It is further submitted that the respondents vide letter dated 30.01.2014 addressed to the Hon‟ble Lt. Governor 51 OA No. 1705/2016 sought ex post facto approval of the Committee as the same was constituted earlier without the approval of the competent authority to which the Hon‟ble LG accorded its approval for constitution of the said Committee on 06.02.2014. The file was thereafter again forwarded to respondent No.4 on 23.05.2014 for approving the recommendation of the Committee but the respondent No.4, however, opined to send the Committee recommendations to All India Council for Technical Education (AICTE) so that same may be considered in the next set of recommendations by AICTE. Consequent to aforesaid, the matter was further discussed by the respondent No.3 wherein it was decided that those recommendations which are covered under the norms of AICTE/NCVT be sent to the respondent No.4 for implementation, i.e. recommendations from Sl.No.1 to 7 and those recommendations which are not covered under AICTE/NCVT norms as on date (from Sl. No.8 & 9) be sent to AICTE, who in turn will discuss the matter as per the suggestion of QCI and take a final call as to its implementation on All India basis. It is further submitted that although the recommendations of the committee are based on the recommendation of the QCI, the said recommendations could be implemented only after getting the approval of the competent authority. It is further submitted that even the Finance Department of GNCTD, respondent 52 OA No. 1705/2016 No.4 in pursuance of the Committee‟s recommendation have finally made the following observations:
"366. During the last examination, F.D. had advised the Admn. Deptt. that the recommendation of the Departmental Committee may be sent to AICTE for examination and consideration in the next set of recommendation by the AICTE to states in respect of the Technical Staff employed in ITIs, Polytechnics & Technical Colleges.
367. The Admin Deptt. has now stated that the service conditions of technical staff of ITIs are governed through the recommendations of the pay commission, though it would be appropriate if the recommendations of the committee be forwarded to 7th Central Pay Commission."
5. On the recommendations of the Finance Deptt., GNCTD, respondent No.3 forwarded the recommendations of committee to the 7th CPC vide its letter dated 07.08.2015 wherein department requested that the recommendations of the committee may be taken into consideration before deciding the pay scales of ITI staff in 7th CPC.
6. The respondent No.6 filed a separate reply and submitted that a Working Group was constituted comprising of Secretaries of the 04 States on the "Career Progression of ITI Instructors and changes in CTS Programme". Three meetings of the Working were held to discuss on the Career Progression of ITI to Instructors. The recommendations of working group of Career Progression for Instructors were discussed vide agenda item No.9 in the meeting of Sub- Committee of NCVT dealing with Norms and Courses held on 17.01.2015 at New Delhi. After detailed discussion, the Sub- 53 OA No. 1705/2016 Committee approved following guidelines for Career Progression for Instructors of ITIs:
(a) For promotion to the post of Principal and Group Instructor 25% of Post Instructor will be reserved for degree holders. Remaining 75% will be filled on Seniority basis considering all i.e. Degree (Remaining not covered under 25%) /Diploma /CTS holders.
(b) Pay parity should to be restored and initial grade pay should be fixed to Rs.4600/-.
(c) After eight years of service as instructor there should be a change in designation from instructor to senior instructor with an additional increment.
The above norms as approved by NCVT for Career Progression for Instructors has been conveyed to all Secretaries/Principal Secretaries of all the State Govt./UT Administrations dealing with Craftsmen/Vocational Training, Directors dealing with Craftsmen/Vocational Training of all States/UT Administrations vide letter dated 07.01.2016.
7. Applicant has filed rejoinder to reply filed by respondents No.1 to 5 & 9 and respondent No.6 wherein he has reiterated his pleas taken in the OA.
8. Heard Sh. Ajesh Luthra, learned counsel for applicant and Sh. Amit Yadav, Sh. R.K.Sharma with Sh. S.K.Gulia, learned counsel for respondents and perused the material on 54 OA No. 1705/2016 record and written submissions filed by the learned counsel for the parties.
9. Analysis:
9.1 The issue raised in the OA regarding stagnation for want of appropriate promotional avenues is no more res integra in view of authoritative pronouncement of Hon‟ble Supreme Court in catena of cases. The stagnation at the cost of education of students was recognized by the committee of experts, however, the recommendations of the said committee have not been implemented till date. The Hon'ble Supreme Court has held in the case of UOI Vs. Hem Raj Singh Chauhan, AIR 2010 SC 1682 that cadre review exercised every five years is ordinarily mandatory subject to exceptions which may be justified in the facts of a given case. Lethargy, in-action, an absence of sense of responsibility are allowed to fall in the exception clause.
9.2 In the case of applicants, cadre review has not been undertaken since inception. Finally, the committee of experts was constituted and the said committee submitted its report in 2011 to provide better promotional avenues to the applicants as stagnation was hampering the efficiency of instructors. But, the recommendations of the said committee have also not been implemented till date. The said action of the authorities is not only arbitrary but also violative of law as 55 OA No. 1705/2016 laid down by the Hon'ble Supreme Court in the case of V. Jagannadha Rao & Ors. Vs State of Hon'ble Tribunal, FCI & Ors. Vs. Purshottam Lal Bansal & Ors. and A. Satyanarayana & Ors. Vs. S. Purshottam & Ors., 2008 (5) SCC 416. In the said decisions, the Hon'ble Supreme Court has held that stagnation for long period is not in the interest of administration and it is always in the interest of administration to have a channel of promotion, so as to avoid stagnation at a particular level. It has also been held in the aforesaid decisions that right to be considered for promotion is a fundamental right and the same is necessary to remove stagnation and avoid frustration amongst the employees.
9.3 The applicant in reply to para 5A to 5P of the counter affidavit have denied the submissions made by the respondents and have submitted that the subject matter of career advancement is related with cadre restructuring.
"Extant instructions are that the cadre review should be undertaken at least once in a period of five years", Hon‟ble Supreme Court has held in the case of Hem Raj Singh Chauhan (supra) that:
"44. Concurring with the aforesaid interpretative exercise, we hold that the statutory duty which is cast on the State Government and the Central Government to undertake the cadre review exercise every five years is ordinarily mandatory subject to exceptions which may be justified in the facts of a given case. Surely, lethargy, in-action, an absence of a sense of responsibility cannot fall within category of just exceptions.56 OA No. 1705/2016
45. In the facts of this case neither the appellants nor the State of U.P. has justified its action of not undertaking the exercise within the statutory time frame on any acceptable ground. Therefore, the delayed exercise cannot be justified within the meaning of `ordinarily' in the facts of this case. In the facts of the case, therefore, the Court holds that there was failure on the part of the authorities in carrying out the timely exercise of cadre review."
9.4 Therefore, department should fulfil its statutory duty pertaining to cadre review exercise which is overdue as per extant instructions.
9.5 In this regard, applicants have relied on the case of S.P. Singh, ADG & ors. vs. Union of India and ors., WP (C) No.121/2015 wherein Hon‟ble High Court of Delhi has also discussed the case of Hemraj Singh Chauhan (supra) and held as under:
"The grievance raised by the petitioners is that as per the various monographs issued by the DoPT from time to time, particularly the Office Memorandum dated 14.12.2010, it is mandatory for the Central Government to review the cadre structures once in every five years so as to maintain harmony between the requirements of the cadre and the legitimate career expectations of its members. Unfortunately, no such exercise for 'Cadre Review' has taken place in the CRPF since 1996. The petitioners have referred to a decision of the Apex Court in the case of Union of India & Anr. v. Hemraj Singh Chauhan & Ors., (2010) 4 SCC 290, wherein the Court took a view that the statutory duty which is cast on the State Government and the Central Government to undertake the Cadre Review exercise every five years is ordinarily mandatory subject to exceptions which may be justified in the facts of a given case but surely lethargy, in- action and absence of a sense of responsibility cannot fall within the category of just exceptions. The petitioners also referred to a letter dated 17.01.2014 of the Joint Secretary (Police-II), Ministry of Home Affairs (in short 'MHA'), Government of India to the Director General, CRPF to look into the matter for conducting a Cadre Review of Group 'A' Service of CRPF and the said letter was followed by another letter dated 24.04.2014 from the Home Secretary, Government of India stating therein that such Cadre Review of CRPF was conducted in the year 1991 and was to be 57 OA No. 1705/2016 reviewed every five years thereafter and premised on this, the DG, CRPF was directed to look into the matter and submit his proposal for Cadre Review without any further delay. Since no action was forthcoming, the Home Secretary wrote another letter dated 06.06.2014 and categorically informed the DG CRPF that the time specified in the DoPT guidelines for submitting Cadre Review proposal has already expired long back but no proposal has been received from CFPF. In this regard and in response to the said communication, the DG CRPF in his letter dated 02.07.2014 observed that cadre review proposal is pending for finalisation due to non receipt of final work study report. As regard work study, it was added that with due approval of MHA, M/s Accenture Service Pvt. Ltd, was awarded the contract of work study for augmenting the staff strength in respect of Force HQr, 4 Zonal HQrs and CoBRA Sector HQr during the month of March-2013. Since the study report on H R augmentation submitted by this consultant was found lacking sufficient ground of functional justification against the recommended posts, CRPF had advised them to rectify the shortcomings wherever needed.
Mr. Vikram Jetly, the learned Central Government Standing Counsel appears on advance notice on behalf of the respondents/Union of India and submits that Cadre Review proposal of Group 'A' Service of CRPF has already been submitted by the DG CRPF to the MHA on 10.12.2014 after having concurrence of Financial Advisor and approval of DG CRPF and the matter is presently under examination with the MHA. The learned CGSC also submits that after examination in the MHA, the same shall be sent to the DoPT with regard to the Group 'A' Service of CRPF and then to the Ministry of Finance. The learned CGSC also submits that the same shall take some more time to finalise the Cadre Review of Group 'A' Service of CRPF.
Indisputably, this Cadre Review of Group 'A' Service of CRPF has not taken place since the year 1996. This issue of Cadre Review has been a subject matter of discussion before the Hon'ble Supreme Court in the case of Hemraj Singh Chauhan (supra), wherein the Apex Court took a view that the statutory duty which is cast on the State Government and the Central Government to undertake the Cadre Review exercise every five years is ordinarily mandatory, subject to just exceptions. The learned Apex Court went on to observe that lethargy, in-action and absence of a sense of responsibility cannot fall within the category of just exceptions. With regard to these petitioners who are Group 'A' Officers of CRPF, the exercise of Cadre Review has not taken place for the last more than 19 years due to which a large number of officers have either retired without being promoted to higher ranks, or are likely to retire in future too suffering the same fate.
Considering the fact that CRPF has already submitted the Cadre Review proposal of Group 'A' Service of CRPF after seeking concurrence of Financial Advisor and the approval of 58 OA No. 1705/2016 the DG CRPF, we direct that the MHA shall take steps to proceed in the matter to carry out Cadre Review within a maximum period of four months from the date of this order. For any further delay caused at the end of any of the department, the concerned officers will have to offer explanation for causing such delay considering the fact that this exercise of Cadre Review has not been taken place for the last more than 19 years.
With the above direction, the present petition stands disposed of with the liberty to the petitioners to approach this Court again if the said direction is not complied with by the respondents."
9.6 On the other hand, learned counsels for respondents have relied upon the case of SI Roop Lal and anr. vs. Lt. Governor through Chief Secretary Delhi & ors., 1999 Supp (5) SCR 310. We find that the facts of this case are not at all relevant to the facts of the present case as the question raised therein was whether a Sub Inspector (SI) who was appointed as such in the BSF when transferred on deputation to Delhi Police the cadre of SI (Executive) on being permanently absorbed in the transferred post was entitled to count his substantive service as SI in BSF for the purpose of his seniority in the cadre of SI (Executive) in Delhi Police or not? Whereas in the present case the issue involved is regarding restructuring of the cadre of applicants and as such the decision of the Hon‟ble Apex Court in SI Roop Lal (supra) is distinguishable on facts and issue. For the sake of clarity the question posed by the Hon‟ble Supreme Court in SI Roop Lal (supra) is reproduced below:

"Civil Appeal Nos. 5363-64/97 are preferred against the order dated 28.10.1994 made by the Central Administrative Tribunal, Principal Bench, New Delhi, in O.A. nos. 14145/94. W.P. (C) No. 191/99 filed before this Court under Article 32 of the Constitution of India challenges the constitutional validity of Office Memorandum No. 200020/7/80-Estt. (D) dated 29.5.1986 issued by the Government of India. T.C. (C) No. 56/99 is a transfer case filed seeking transfer of W.P. (C) No. 4128/98 pending on the file of the High Court of Delhi which involves the same question as is involved in the civil appeals referred to above. In all the above cases, the question involved is whether Sub- Inspector who was appointed as such in the Border Security Force (for short `the BSF') when transferred on deputation to Delhi Police in the cadre of Sub-Inspector (Executive) on being permanently absorbed in the transferred post, is entitled to count his substantive service as Sub-Inspector in the BSF for the purpose of his seniority in the Cadre of Sub- Inspector (Executive) in Delhi Police or not."
9.7 In a welfare state, it is necessary that there should be an efficient public service. The provision for promotion increases efficiency of the public service while stagnation reduces efficiency and makes the service ineffective. Rreasonable promotional opportunities should be available in every wing of public service that generates efficiency in service and fosters the appropriate attitude to grow for achieving excellence in service. In the absence of promotional prospects, the service is bound to degenerate stagnation kills the desire to serve properly.
10. Hon‟ble High Court of Gujarat in C/SCA No.1768/1992 decided on 13.10.2017 held as under:-
"44. The pay commissions are constituted for evaluating the duties and functions of the employees and the nature thereof vis-a-vis the educational qualifications required therefor. Although the pay commission is considered to be an expert body, yet, the State, in its wisdom and in furtherance of a valid policy decision may, or may not accept its 60 OA No. 1705/2016 recommendations. However, the State Government is not expected to brush aside the recommendations lightly and without assigning any reasons for the same. The recommendations of an expert body do carry some weight and sanctity. The decision of the State Government in not accepting the recommendations of the pay commission should not be an eyewash. It should appear from the materials on record that a proper application of mind was there by the Committee constituted by the Government to look into the recommendations and after thorough examination, the Committee has taken the decision. In the case on hand, I am not satisfied or rather convinced with the reasons assigned for not accepting the recommendations of the pay commission. In such circumstances, I have thought fit to ask the State Government to re-look into the matter having regard to the materials on record, which is quite voluminous."
11. Conclusion:
Based on the aforesaid analysis, we dispose of the Original Application with the following directions:-
i) The respondents are directed to re-consider implementing the recommendations of the committee on Career Advancement of Staff in ITI‟s and fix their pay/pay scales w.e.f. the date of submission of report, i.e., 19.05.2011.
ii) However, if the applicants wish to supply any other material or make representation apart from what has already been considered by the Committee on Career Advancement of Staff in ITIs, they may do so within a period of one month from today and it shall be open to the respondents based on the aforesaid material to re-examine the same in light of the decision rendered by the said Committee, within a period of two months from the date of receipt of such representation, if any, and in the event the decision is taken in favour of the 61 OA No. 1705/2016 applicants, the same shall be implemented in consultation with Ministry of Finance.
iii) The respondent authority shall conclude the exercise, as ordained above, as expeditiously as possible but preferably within a period of the two months from the date of receipt of a certified copy of this order under intimation to the applicants.
12. Associated MAs, if any, also stand disposed of.
13. In the facts and circumstances of the case, there shall be no order as to costs.
