(2)(a)The deposit made under sub-rule (1) shall, unless forfeited under sub-rule (3) or (4), be returned as soon as practicable after the result of the election is declared:Provided that where a candidate is not shown in the list of contesting candidates or dies before the commencement of the poll, the deposit shall be returned as soon as practicable after the publication of the list or after his death, as the case may be.(b)The deposit shall be returned to the candidate, his legal representative, or a person authorised by him on his behalf.
