Counsel for the parties agreed that the issue agitated in this
petition is similar to one in SBCWP No.24957/2018 titled Santosh
Poswal Versus State of Rajasthan & Others and other connected
matters decided on 20.12.2018 and these petitions be accordingly
disposed of.
Mr.Ganesh Meena, AAG appearing for the respondents
however submitted that earlier this court in its order dated 20.12.2018 had directed that individual representations of the petitioners be disposed of by the Director, Secondary Education. He submitted that in the event each individual representation was to be considered by the Director, Secondary Education alone it would entail delays in view of the number of representations involved and also result in huge administrative costs resulting from calling of records from far of places by the Director, Secondary Education. He submitted that in this view of the matter (36 of 36) [CW-20922/2018] it be clarified that the individual representations with supporting facts and material received from the petitioners be considered either by the Director, Secondary Education himself or by his delegatee/s or even committee/s appointed by him for the purpose.
The petitioners' counsel did not and cannot have any objection to the above innocuous modification of the earlier order dated 20.12.2018 passed by this court.
In this view of the matter, these petitions are disposed of accordingly in terms of the order dated 20.12.2018 passed in the case of Santosh Poswal Versus State of Rajasthan & Others (supra) with the modification that the individual representations of the petitioners would be liable to be disposed of, by the Director, Secondary Education or any of his delegatees or committees constituted by him, within a period of two weeks from the date of receipt of such representation/s.
