2. The applications for condonation of delay in preferring Cross-Objections are allowed.
3. The appeals have been preferred by the Requiring Body, challenging the judgment and awards passed by the Court of Civil Judge, Senior Division, Amalner, Dist. Jalgaon, in respective Land ::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 ::: 88 FA.572.21 and ors Acquisition References (L.A.Rs.). By the impugned judgment and awards, the L.A.Rs. preferred by the respondents for enhancement of compensation, have been allowed. After having felt the enhancement granted by learned Judge to be inadequate, the respondents-land owners have preferred the Cross-Objections for further enhancement of compensation, while the requiring body has challenged the awards on the ground that the enhancement of compensation is exorbitant. Maintainability of the L.A.Rs. under Section 18 of the Land Acquisition Act, 1894 ("the Act of 1894", for short) has also been challenged in these appeals. FACTS:-
4. The appellant-requiring body acquired the lands with structures thereon, belonging to the respondents herein. The acquisition was for Lower Tapi Project, at Village Padalse, Tq. Amalner, Dist. Jalgaon. The Land Acquisition Officer (Collector) passed award/s on 02.06.2013 under the Act of 1894 and awarded compensation.
5. The respondents-land owners urged the Collector to refer the matter for determination of the Court under Section 18 of the Act of 1894. Simultaneously, the respondents - land owners and ::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 :::
89 FA.572.21 and ors others preferred Writ Petition (2089 of 2014) to this Court for direction to the Collector to determine the compensation in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act of 2013). The Division Bench, vide its judgment and order dated 01.03.2016, allowed the Writ Petition with a direction to the Collector to determine the compensation in terms of the provisions of the Act of 2013. It is the case of the appellant- requiring body that pursuant to the directions in Writ Petition (2089 of 2014), the amount of compensation came to be determined in terms of the provisions of the Act of 2013 and has been paid to the respondents-land owners.
6. The respondents-land owners also prosecuted the Land Acquisition References, wherein the impugned judgment and awards came to be passed. Since these appeals could be disposed of on the issue of maintainability of the land references before the Court of Civil Judge, Senior Division, I do not propose to advert to the submissions advanced by learned Counsel on the question of inadequacy or inadequacy of the amount of compensation awarded under the impugned awards.

Learned counsel for the appellant-requiring body would submit that the award dated 02.06.2013 passed under the Act of 1894 came to be merged with the award passed by the Collector in view of the directions in the judgment and order dated 01.03.2016 in Writ Petition No.2089 of 2014. The earlier award dated 02.06.2013 was, thus, no longer in existence. The reference(s) filed by the respondents-land owners, therefore, became infructuous. Learned counsel has relied on a full-bench judgment of this Court in the case of Pune Municipal Corporation Vs. Rajeev L. Sangtani and ors., 2019 SCC OnLine Bom 1492. Learned counsel, ultimately, urged for allowing the appeals.
8. Learned counsel for the respondents-land owners would, on the other hand, submit that the award under Section 11 of the Act of 1894 came to be passed on 02.06.2013. Neither on the date of the award nor immediately thereafter, the compensation was paid to the respondents-land owners. The Act of 2013 came into force on 01.01.2014. The compensation in respect of majority of the land holdings has neither been deposited in the accounts of the beneficiary nor was paid to them on the date of commencement of the Act i.e., 01.01.2014. Majority of the land owners filed Writ ::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 ::: 91 FA.572.21 and ors Petition (2089 of 2014). The Division Bench of this Court allowed the Writ Petition with the observations that the petitioners therein were not entitled to claim declaration of lapsing of award in view of Section 24(2) of the Act of 2013, however, since majority of the land holders were not paid compensation on the date of enforcement of Act of 2013, the respondents therein shall have to determine the amount of compensation payable to the claimants in accordance with the Act of 2013. Learned counsel meant to say that the award under Section 11 of the Act of 1894 had already been passed before enforcement of Act of 2013. The proceedings would, therefore, continue under the Act of 1894. The respondents would only be entitled to amount of compensation in terms of the provisions of Act of 2013. Learned counsel, therefore, urged for repel of the preliminary objections raised by learned counsel for the requiring body.
9. Considered the submissions advanced by learned counsel for the parties. Perused the impugned judgment and awards. Before adverting to answer the questions raised herein, it would be apposite to refer to certain provisions of the Act of 2013. ::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 :::

10. Sections 24 of the Act of 2013 reads thus:-
24. Land acquisition process under Act No.1 of 1894 shall be deemed to have lapsed in certain cases.-
(1) Notwithstanding anything contained in this Act, in any case of land acquisition proceedings initiated under the Land Acquisition Act, 1894,--
a) where no award under section 11 of the said Land Acquisition Act has been made, then, all provisions of this Act relating to the determination of compensation shall apply; or
b) where an award under said section 11 has been made, then such proceedings shall continue under the provisions of the said Land Acquisition Act, as if the said Act has not been repealed.
(2) Notwithstanding anything contained in sub-
section(1), in case of land acquisition proceedings initiated under the Land Acquisition Act, 1894 (1 of 1894), where an award under the said section 11 has been made five years or more prior to the commencement of this Act but the physical possession of the land has not been taken or the compensation has not been paid the said proceedings shall be deemed to have lapsed and the appropriate Government, if it so chooses, shall initiate the proceedings of such land acquisition afresh in accordance with the provisions of this Act:
Provided that where an award has been made and compensation in respect of a majority of land holdings has not been deposited in the account of the beneficiaries, then, all beneficiaries specified in the notification for acquisition under section 4 of the said Land Acquisition Act, shall be entitled to compensation in accordance with the provisions of this Act."::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 :::

11. Section 26 of the Act of 2013 speaks of determination of market value of land by Collector, while Section 28 deals with the parameters to be considered by the Collector in determination of award. Chapter VIII speaks of establishment of land acquisition, rehabilitation and resettlement authority. Section 51 of the Act of 2013 reads thus:-
51. Establishment of Land Acquisition, Rehabilitation and Resettlement Authority.-
(1) The appropriate Government shall, for the purpose of providing speedy disposal of disputes relating to land acquisition, compensation, rehabilitation and resettlement, establish, by notification, one or more Authorities to be known as ― the Land Acquisition, Rehabilitation and Resettlement Authority to exercise jurisdiction, powers and authority conferred on it by or under this Act.
(2) The appropriate Government shall also specify in the notification referred to in sub-section (1) the areas within which the Authority may exercise jurisdiction for entertaining and deciding the references made to it under section 64 or applications made by the applicant under second proviso to sub-section (1) of section 64.
Sections 63, 64 and 69 of the Act of 2013 read thus :-
63. Jurisdiction of civil courts barred.-
No civil court (other than High Court under article 226 or article 227 of the Constitution or the Supreme Court) shall have jurisdiction to entertain any dispute relating to land acquisition in respect of which the ::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 ::: 94 FA.572.21 and ors Collector or the Authority is empowered by or under this Act, and no injunction shall be granted by any court in respect of any such matter.
64. Reference to Authority.-
(1) Any person interested who has not accepted the award may, by written application to the Collector, require that the matter be referred by the Collector for the determination of the Authority, as the case may be, whether his objection be to the measurement of the land, the amount of the compensation, the person to whom it is payable, the rights of Rehabilitation and Resettlement under Chapters V and VI or the apportionment of the compensation among the persons interested:
Provided that the Collector shall, within a period of thirty days from the date of receipt of application, make a reference to the appropriate Authority:
Provided further that where the Collector fails to make such reference within the period so specified, the applicant may apply to the Authority, as the case may be, requesting it to direct the Collector to make the reference to it within a period of thirty days.
(2) The application shall state the grounds on which objection to the award is taken:
Provided that every such application shall be made-
(a) If the person making it was present or represented before the Collector at the time when he made his award, within six weeks from the date of the Collector's award;
(b) in other cases, within six weeks of the receipt of the notice from the Collector under section 21, or within six months from the date of the Collector's award, whichever period shall first expire:::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 :::
95 FA.572.21 and ors Provided further that the Collector may entertain an application after the expiry of the said period, within a further period of one year, if he is satisfied that there was sufficient cause for not filing it within the period specified in the first proviso.
69. Determination of award by authority.-
(1) In determining the amount of compensation to be awarded for land acquired including the Rehabilitation and Resettlement entitlements, the Authority shall take into consideration whether the Collector has followed the parameters set out under section 26 to section 30 and the provisions under Chapter V of this Act.
(2) In addition to the market value of the land, as above provided, the Authority shall in every case award an amount calculated at the rate of twelve per cent per annum on such market value for the period commencing on and from the date of the publication of the preliminary notification under section 11 in respect of such land to the date of the award of the Collector or the date of taking possession of the land, which ever is earlier.
Explanation.-- In computing the period referred to in this sub-section, any period or periods during which the proceedings for the acquisition of the land were held up on account of any stay or injunction by the order of any Court shall be excluded.
(3) In addition to the market value of the land as above provided, the Authority shall in every case award a solatium of one hundred per cent over the total compensation amount."

12. The Constitution Bench of the Apex Court in the case of Indore Development Authority Vs. Manoharlal and ors., Etc., AIR 2020 SC 1496 has held that the proviso to Section 24(2) of the Act of 2013 is to be treated as part of Section 24(2) not part of Section 24(1)(b). It has been further held in Clauses 8 and 9 of paragraph 363 of the judgment as under:-
8. The provisions of Section 24(2) providing for a deemed lapse of proceedings are applicable in case authorities have failed due to their inaction to take possession and pay compensation for five years or more before the Act of 2013 came into force, in a proceeding for land acquisition pending with concerned authority as on 1.1.2014. The period of subsistence of interim orders passed by court has to be excluded in the computation of five years.
9. Section 24(2) of the Act of 2013 does not give rise to new cause of action to question the legality of concluded proceedings of land acquisition. Section 24 applies to a proceeding pending on the date of enforcement of the Act of 2013, i.e., 1.1.2014. It does not revive stale and time-barred claims and does not reopen concluded proceedings nor allow landowners to question the legality of mode of taking possession to reopen proceedings or mode of deposit of compensation in the treasury instead of court to invalidate acquisition.
13. When the Division Bench of this Court decided Writ Petition (2089 of 2014), the Constitution Bench judgment of the ::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 ::: 97 FA.572.21 and ors Apex Court in the case of Indore Development Authority (supra) was not in the field. The Division Bench of this Court, in paragraphs 4 and 6 of its judgment dated 01.03.2016, observed thus :-
4. In the instant matter, the Petitioners are not entitled to claim declaration of lapsing of award in view of Section 24(2) of the Act of 2013. However, since majority of the land holders were not paid compensation on the date of enforcement of Act of 2013 i.e. 1st January 2014, the Respondents shall have to determine the amount of compensation payable to the claimants in accordance with the new Enactment i.e. Act of 2013.
6. For the reasons recorded above, the Writ Petition deserves to be allowed and the same is accordingly allowed. The Respondents are directed to determine the amount of compensation payable to the Petitioners in respect of the acquired property, in accordance with the the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. The amount shall be determined within period of SIX MONTHS from today and the same shall be paid to the Petitioners within FOUR MONTHS from the date of determination. The amount already received by the Petitioners and other claimants shall be considered while paying the amount of compensation arrived at in accordance with the determination under the Act of 2013.
Admittedly, the judgment and order passed in Writ Petition (2089 of 2014) has attained finality. The directions given therein have been acted upon.

14. The full-bench judgment of this Court in the case of Pune Municipal Corporation (supra), while deciding the points for consideration raised therein (although in somewhat different context), has observed:-
66. If we compare the provisions of sub-section (1) of section 23 of the Old Act with the parameters prescribed in Section 28 of the Act, 2013, it becomes crystal clear that the Act, 2013 enjoins the Collector to take into account the very same parameters which the Reference Court was bound to consider under section 23 of the Old Act. The provisions of Section 30(3) of the Act, 2013 correspond with the provisions of section 23(1A) of the Old Act which provided for the award of interest @ 12% per annum on the market value of the land from the date of the notification under Section 4 to the date of taking possession or till the date of the award, whichever is earlier. The provisions contained in Section 30(1) of the Act correspond with the provisions contained in section 23(2) of the Old Act in the matter of award of solatium with the change that under the Act, 2013, the solatium equivalent to one hundred percent of the compensation has to be awarded instead of 30% on the market value of the land, under the Old Act.
67. In view of the clear and explicit mandate of clause (a) of sub- section (1) of Section 24 of the Act, 2013, concededly, the compensation is to be determined by the Collector in adherence to the provisions of this Act including Sections 26 to 30 of the Act, 2013. The prescription of these parameters, which the Reference Court was enjoined to consider under section 23 of the Old Act, thus constitutes a significant departure from the provisions of the Old Act. The parameters which the Reference Court was expected to consider under the Old Act shall now be adhered to by the Collector in the matter of ::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 ::: 99 FA.572.21 and ors determination of the compensation. It could be urged that under the Old Act also, while passing the award, the Collector was required to consider the very same parameters which the Court was enjoined under Sections 23 and 24 thereof. But the matter does not rest here.
68. If we consider the provisions of Section 69 of the Act, 2013, extracted above, the departure from the scheme of the Old Act becomes vivid. Section 69(1) of the Act, 2013 enjoins the Authority to take into consideration whether the Collector has followed, inter-alia, the parameters set out under Sections 26 to 30 in the matter of determination of compensation. In contrast to the provisions of section 18 of the Old Act, where the Reference Court was not supposed to sit in appeal over the award, in respect of which the reference is made, the Act, 2013 envisages an enquiry into the question as to whether the Collector has followed the parameters set out under Sections 26 to 30 of the Act, 2013. The consideration of this aspect would involve an element of appraisal of the correctness or otherwise of the disposition made by the Collector, on the parameters set out under Sections 26 to 30.
15. It has further been observed that if the subsequent legislation provides a new forum, before which the right of action can be pursued, the litigant has to enforce the remedy before the new forum created under the reenacted legislation.
16. The facts of the case in hand, undoubtedly, indicate that the award dated 02.06.2013 was passed under Section 11 of the Act of 1894. The date of the award precedes the date of enforcement of the Act of 2013. The majority of the land owners filed Writ Petition ::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 ::: 100 FA.572.21 and ors (2089 of 2014). By virtue of the judgment and order in the said Writ Petition, the amount of compensation payable to the expropriated land owners, came to be redetermined in terms of the provisions of the Act of 2013. Necessarily, the factum of redetermination of compensation superseded the award under Section 11 of the Act of 1894. It could even be said that the award came to be passed in terms of the provision of the Act of 2013. The Court, which has passed the impugned award, was the Court constituted under the Act of 1894 to determine the reference(s) made to it under Section 18 of the said Act. The said Court has no jurisdiction to go into the question, as to whether the Collector has determined the compensation under the Act of 2013 after having considered the parameters under Section 28 of the Act of 2013. A separate forum in the nature of Land Acquisition Rehabilitation and Resettlement Authority has been constituted to exercise the jurisdiction, powers and authority conferred on it by or under the Act of 2013. Section 64 of the Act of 2013 speaks of reference to such authority. In determination of the amount of compensation to be awarded for the land acquired, such authority was under obligation to take into consideration, whether the Collector has followed the parameters set out under Sections 26 to 30 of the Act of 2013. ::: Uploaded on - 06/01/2022 ::: Downloaded on - 06/01/2022 22:54:05 :::

17. It is reiterated that the reference Court, which has passed the impugned awards, did lack jurisdiction to go into the questions, which the authority constituted under Section 51 of the Act of 2013 was authorised to deal with the same under Section 69 of the Act of 2013. As such, the awards impugned in these appeals have been passed by the Court having no jurisdiction and therefore, are liable to be set aside.
18. In the result, the following order:-
(i) All First Appeals are allowed.
(ii) The awards impugned in these appeals are hereby set
aside.
(iii) The Cross-Objections stand dismissed.
(iv) The respondents/land owners may urge the Collector
within a period of two months from the date of this order, to refer the matter for determination of the authority constituted under Section 51 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, if they so desire.
(v) The amount deposited by the Requiring Body be returned to it along with interest accrued thereon.
