This matter was listed for consideration on bail application.

This is first bail application filed by the applicant-Pintu Mori S/o Punja Mori under Section 439 of Code of Criminal Procedure, 1973 for grant of bail in connection with Crime No.135/2020 registered at Police Station-Petlawad, District- Jhabua (MP) for the offence punishable under Sections 353, 427, 147, 148, 341, 332 and 506 of Indian Penal Code, 1860 and under Section 3(2)(A) of Prevention of Damage to Public Property Act, 1984.

Charge-sheet has filed in the matter under the provisions of Sections 353, 427, 148, 147, 341, 332 and 506 of Indian Penal Code, 1860 and under Section 3(2)(A) of Prevention of Damage to Public Property Act, 1984.

Learned counsel for the State submits that the name of present applicant figures in the FIR.

To this, learned counsel for the applicant submits that although the name of present applicant figures in the FIR but there are number of persons who have been named and as per FIR the main accused are Kailash, Kantilal and Dhamantri who had instigated the crowd to throw stones.

It would be appropriate to consider the application after 2 HIGH COURT OF MADHYA PRADESH, BENCH AT INDORE MISC. CRIMINAL CASE NO.19201 OF 2020 (Pintu Mori vs State of Madhya Pradesh) framing of charges.

With this liberty given, this application stands dismissed, however it is made clear that if charges are not framed within a period of thirty days from the date of receipt of this order, the applicant shall have the liberty to press for fresh bail application.
