Section 46 in Tamil Nadu Village Panchayats (Receipts and Expenditure and Maintenance of the Accounts of Village Panchayats) Rules, 2000

46. Payment due to a deceased officer or servant.

(1)Pay, leave salary and allowances may be drawn for the day of death of an officer or servant of the village panchayat. The hour at which death takes place does not affect the claim.
(2)Payment due to a deceased officer or servant of a village panchayat shall not be made except on the production of an authority of the nature specified in clauses (i), (ii), (iii), (iv) or (v) of sub-section (1) of section 214 of the Indian Succession Act, 1925 (Central Act XXXIX of 1925):Provided that payment may be made without the production of such authority -
(i)to the extent of Rs. 250 under the orders of the village panchayat, if it is satisfied after such enquiry as it may consider sufficient, about the right and title of the claimant; and
(ii)above Rs. 250 under the orders of the Inspector on the execution of an indemnity bond with such security or securities as he may require if he is satisfied, after such enquiry as he may consider sufficient, about the right and title of the claimant and considers that undue delay and hardship would be caused by insisting on the production of such authority.
