The instant petition has been filed for the grant of following substantive reliefs:-
(i) That the respondent No.3 may kindly be directed to construct the New Panchayat Bhawan upon the land comprised in Khatoni No. 41/52 Kita 10 measuring 00-05-00 hectare, which was donated by Sh. Lachhman in the name of respondent No.3.
(ii) That in the alternative, the petitioner prays that in any case, the New Panchayat Bhawan is not constructed upon the land comprised in Khatoni No. 41/52 Kita 10 measuring 00-05-00 hectare, which was donated by Sh. Lachhman in the name of respondent No.3, then the respondent No.3 may kindly be directed to transfer the said land to Sh. Lachhman."
There can be no dispute that with regard to fixing of headquarter of the Gram Panchayat, it is the will of the people, which is paramount. In the given facts and circumstances of the case, we direct the Block Development Officer, to personally convene a meeting on 17.7.2022 for deciding the headquarter, wherein proposal for fixing the headquarter of Gram Panchayat will put to vote in the Gram Sabha, and result thereof be sent to this Court in a sealed cover.
