Section 49(1) in The Constitution of Jammu and Kashmir
(1)There shall be reserved in the Legislative Assembly for the Scheduled Castes in the State a number of seats which shall bear, as nearly as may be, the same ,proportion to the total number of seats in the Assembly as the population of the Scheduled Castes bears to the population of the State.Explanation. - In this sub-section-(a)[ the expression "population" means the population as ascertained at the last preceding census of which the relevant figures have been published ; and] [Substituted for 'Twenty-five Seats' by the Constitution of Jammu and Kashmir (Twelfth Amendment) Act, 1975.](b)"Scheduled Castes" means the castes, races or tribes or part of, or groups within, castes, races, or tribes which are for the purposes of the Constitution of India deemed to be Scheduled Castes in relation to the State under the provisions of Article 341 of the Constitution :[Provided that the reference in this Explanation to the last preceding census of which the relevant figures have been published shall, until the relevant figures of the first census taken after the year 2026 have been published, be construed as a reference to the 1981 census.] [Added by the Constitution of Jammu and Kashmir (Twenty-ninth Amendment) Act, 2002.]
