Section 5(1) in Punjab State Electricity Regulatory Commission (Open Access) Regulations, 2005
(1)The distribution licensees using intra-State transmission system and/or the distribution system in the State on the date of coming into force of these Regulations under an existing arrangement shall be entitled to continue to avail Open Access on such transmission and/or distribution system on the same terms and conditions on payment of transmission charges and/or the wheeling charges and other applicable charges as may be determined by the Commission from time to time :Provided that in case any distribution licensee was permitted/authorised by the State Government to supply energy to any person outside the area of supply under Section 27 of the Indian Electricity Act, 1910 (now repealed by the Act), there will be no surcharge applicable till the current validity of such consent/authorisation.
