Civil Writ Petition No.8599/2022 (Shri Jain Swetamber Terapanthi Mahila Shikshan Prashikshan Mahavidyalaya Vs. National Council for Teacher Education & Ors.) are being taken into consideration for disposal of the present bunch of writ petitions.
Brief facts in these writ petitions are that the petitioners are Institutions imparting education for Diploma Course in Elementary Education having recognition from the respondent-National Council for Teachers Education. The petitioner-Institutions received public notice in the year 2019 for submission of the "Performance Appraisal Report" along with fee of Rs.15,000/-, which was the subject-matter of challenge before this Court and this Court in S.B. Civil Writ Petition No.18827/2019 granted interim relief on 16.01.2020 on the similar footing. The action of the respondents was challenged before the Delhi High Court too and the same was decided vide order dated 27.05.2021. Thereafter an appeal was preferred, wherein the interim order was passed by the Division Bench of Delhi High Court. The order passed by the Delhi High Court was assailed before Hon'ble the Supreme Court and the same was decided vide order dated 01.04.2022. The respondents, thereafter, once again introduced a scheme in its 54th General Body Meeting held on 27.04.2022.
In pursuance of the decision dated 27.04.2022, a public notice was issued on 03.05.2022, whereby the direction was issued to file a "Performance Appraisal Report" for the Academic Session 2022-23 and this public notice and decision of the General Body Meeting, is the subject-matter of dispute in these bunch of writ petitions.

[2025:RJ-JD:8252] (15 of 15) [CW-8599/2022] Learned counsel for the parties jointly submit that the validity of this decision was challenged before the Delhi High Court and the writ petitions filed by the other similarly situated institutions were allowed vide order dated 13.03.2023 by the Delhi High Court. Further, the respondent-National Council for Teacher Education had assailed the validity of judgment and order dated 13.03.2023 before Hon'ble the Supreme Court, wherein the interim order has been passed on 06.07.2023. They further submit that the controversy involved in the present bunch of writ petitions is identical to the matter pending before Hon'ble the Supreme Court and, therefore, the decision of the Hon'ble Supreme Court will govern the fate of these present writ petitions and be applied to the present parties to the writ petitions also.
Learned counsel for the parties herein thus submit before this Court that they shall abide by the decision rendered in the above referred Special Leave Petition.
In view of the submissions made before this Court, these writ petitions are disposed of with a direction to the parties that the judgment of Hon'ble the Supreme Court in Special Leave Petition No.11756/2023 (The National Council for Teachers Education Vs. Association of NCTE Approved Colleges Trust) shall be made applicable to the present writ petitions as and when decided by Hon'ble the Supreme Court.
All pending applications as well as stay applications, if any, stand disposed of accordingly.
