Order 29/07/2024 The controversy involved in this case has very aptly and deliberately been resolved by a Coordinate Bench of this Court at Bench of Jaipur in the case of Smt. Chanda Keswani Vs. State of Rajasthan & Ors in S.B. Civil Writ Petition No.7853/2020 vide order dated 08.11.2023.

The Coordinate Bench upon noticing that the provisions are silent with regard to the maternity leave of the surrogate mothers; (Downloaded on 30/07/2024 at 08:55:55 PM)

[2024:RJ-JD:31161] (2 of 2) [CW-12154/2024] directed the State Government to bring appropriate legislation in this regard for grant of maternity leave to surrogate and commissioning mothers. In this view of the matter, the writ petition is allowed in the terms settled in the judgment referred supra.

The respondent-authorities are directed to pass an appropriate order in light of judgment above within a period of seven days from the date of receipt of copy of this order.
