Section 28 in Gujarat Gas (Regulation of Transmission, Supply and Distribution) Act, 2001
28. Revocation and suspension of licence.
- If the Commissioner is satisfied either on a reference made to it or otherwise that -(a)a licence granted under section 26 has been obtained by misrepresentation as to an essential fact, or(b)the licensee has, without reasonable cause, failed to comply with the conditions subject to which the licence has been granted or has contravened any of the provisions of this Act or the rules or the regulations made thereunder, then without prejudice to any other penalty to which the licensee may be liable under this Act. the Commissioner may, after giving the licensee an opportunity of showing cause-(i)revoke the licence on the ground stated in clause (a), or(ii)revoke the licence or forfeit the sum, if any, or any portion thereof deposited as security for due performance of the conditions subject to which the licence has been granted, on the ground stated in clause (b) or(iii)suspend the licence for such period as he thinks fit, on the ground stated in clause (b).
