83. Payment of compensation to owner of surface rights etc.
(1)The holder of a mineral concession shall be liable to pay to the occupier of the surface of the land over which he holds the mineral concession, such annual compensation as may be determined by the Collector.(2)In case of agricultural land the amount of annual compensation shall be worked out on the basis of the average annual net income for the cultivation of similar land for the previous 3 years.(3)In case of non-agricultural land, the amount of annual compensation shall be worked out on the basis of average annual letting value of similar land for the previous three years;(4)The annual compensation referred to in sub-rule (1) shall be payable on or before such date as may be specified by the Collector.
