1. The alleged lethargy on part of the Respondent-Company in granting benefits to the Petitioners/Appellants with regard to their right to get employment in the Company after the apprenticeship training undergone in the very same Company and the different levels of litigation pursued at different points of time, are projected in these appeals.
2. Grievance is against the judgment passed by the learned Single Judge whereby the writ petitions came to be dismissed, which according to the Appellants is without properly appreciating the facts and figures and the relevant provisions of law, including the observations/declarations made by this Court and also by the Apex Court.
3. Shri B.P.Rao, the learned counsel for the Appellant {in Writ Appeal No.48/ 2018 arising from Writ Petition (S) No. 1829 of 2012} led the arguments.
4. We have heard Shri Vinod Deshmukh, Advocate on behalf of the Respondent-Company.
5. To have an idea as to the actual nature of the dispute, it will be worthwhile to refer to the sequence of events. Writ Appeal No. 11 of 2018 is taken as 24 the lead case and reference is made to the parties and proceedings as referred to therein, except where it is separately referred to, depending upon the context.

The Appellant and several other persons joined the Respondent-Company for apprenticeship training for a period of one year during the period 1996- 1998, in terms of the provisions of the Apprenticeship Act, 1961. After completion of the training, the trainees put forth a claim to get appointment in the Company. Some of the persons like them, approached this Court by filing Writ Petition No. 1357 of 2002 referring to availability of various posts such as Electrician, Fitter, Welder, General Mazdoor etc. and as to their credentials, having passed the technical courses like ITI and the experience gained by virtue of the training undergone in the very same Company. After hearing, the writ petition was disposed of as per judgment dated 08.11.2005 directing the Respondent-Company to consider the claim of the writ petitioners for absorption as General Mazdoor.

Met with the situation and on being aggrieved, the Respondent-Company filed MCC No. 254 of 2005 before the very same learned Single Judge, contending that no regularisation could have been ordered and hence, to recall the verdict. The learned Single Judge, vide its order dated 28.04.2006, held that 'no error apparent on the face of record' was there and accordingly, the MCC came to be dismissed. This was sought to be challenged by the Respondent-Company by filing Special Leave Petition bearing No. 14056 of 2006 before the Apex Court. The said Special Leave Petition was admitted and later, it was converted to Civil Appeal No. 1714 of 2007; which was finally heard and decided on 29.03.2007, whereby the verdict passed by the learned Single Judge in the Writ Petition and the subsequent order in the MCC were set aside, observing that as and when vacancies for regular appointment was advertised and everything being 25 equal, preference might be given to the candidates who have been trained by the establishment-Company. It was also observed that, if the incumbents had successfully completed training, there was no reason to withhold their proficiency certificate. Later, by the passage of time, the Respondent-
Company issued an advertisement on 26.06.2008 providing some extent of age relaxation to the persons like the Petitioners/Appellants herein. But according to the Company, even after giving the benefit of age relaxation, the Appellants/Petitioners could not cross the hurdle and hence, they were not appointed. After completing the process of selection, the eligible candidates were identified and they were given placement. It is further pointed out that, the direction given by the Supreme Court was given effect to, by providing age relaxation, though it did not turn to be fruitful as far as the Petitioners were concerned, they having crossed the age bar and had advanced much.
8. On issuance of the select list, some of the aggrieved persons sought to challenge the same by filing Writ Petition (S) No. 38 of 2009 and connected cases. Various grounds were raised including discrimination and such other instances in relation to the appointment effected by the Company for some other periods. After hearing both the sides, interference was declined and the writ petitions came to be dismissed as per the judgment dated 09.04.2009. This was sought to be challenged by filing Writ Appeal No. 139 of 2009, which was finalised by the Division Bench of this Court as per the judgment dated 29.04.2010. Some declarations/ observations were made, particularly as contained in 'paragraph 10', whereby the Respondent-Company was directed to forward the names of the Petitioners to the National Council for Vocational Training (for short 'the NCVT') for issuing the proficiency certificate. The said direction is stated as complied with by the Respondent-Company. Alleging non-compliance, some of the Petitioners approached this Court by filing Contempt of Court 26 proceedings bearing No. 222 of 2011, 223 of 2011 and 382 of 2011. The said matters came up for consideration before the Court on 23.01.2015 and after hearing, they were disposed of with some specific observations, however without drawing any adverse inference as far as the Respondent-
Company is concerned.
9. In the meanwhile, the Appellants herein had approached this Court by filing Writ Petition (S) No. 1829 of 2012 with the following prayers:
"10(i) The Hon'ble Court may kindly be pleased to issue a appropriate writ/writs or order to the respondents calling records pertaining to the petitioners.
10(ii) To issue writ in the nature of mandamus to take necessary against the authorities, who were responsible for non-registration of petitioners under the Apprenticeship Act from the respondent No. 5 or direct the independent probe in the matter to fix accountability upon the public servants who were responsible for willful violation of the enforced rule of law;
10(iii) Hold that the petitioners are entitled for consideration on the post of General Mazdoor Category-I from the date of completion of successful apprenticeship under the SECL considering age relaxation as due to ban enforced, no recruitment from 2000 to 2009 has been taken place and also in absence of proficiency certificate on the part of SECL they were not able to apply elsewhere; and further hold that petitioners are entitled for backwages of their salary and other consequential benefits from the date of their entitlement on the post of General Mazdoor Category-I. 10(vi) Looking to the facts and circumstances of the case this Hon'ble Court be pleased to grant appropriate compensation to the petitioners.
10(v) Any other relief/order/direction/probe which this Hon'ble Court may deemed fit and proper looking into the fact and circumstances of the case coupled with the natural justice may kindly be granted together with the cost of writ petition."
10. Almost similar grievance was projected by the Petitioners in Writ Petition No. 2541 of 2012 as well. Nearly three years after the filing of the above writ petitions, some other strangers also came to the field by way of various writ 27 petitions such as Writ Petition No. 421 of 2015, 524 of 2015 etc. placing similar grievance and praying for similar reliefs. All the above cases came to be grouped together and the matters were heard and finalised by the learned Single Judge as per the judgment dated 17.11.2017, whereby it was held that the Petitioners were not entitled to get any relief. It was accordingly, that the writ petitions were dismissed, which in turn forms the subject matter of challenge in these appeals.
11. The learned counsel for the Appellants submits that altogether 400 vacancies of General Mazdoor were notified by the Respondent-Company;
out of which only 250 were filled up. By that time, a ban was imposed, as a result of which, recruitment could not be effected in respect of the remaining 150 vacancies. Though the ban was subsequently lifted, no further steps were taken by the Respondent-Company to pursue the recruitment, but for which the Appellants would have been appointed against the vacancies available. The laxity on the part of the Respondent-Company in this regard ought to have been interfered with; more so in view of various other lapses as well, including the delay and inaction on the part of the Company in taking necessary steps for causing the 'proficiency certificate' to be issued to the Appellants. An enquiry in this regard is also sought for.

The learned counsel for the Respondent-Company points out that the facts and figures leading to the actual dispute, with reference to the nature of engagement and the course of action pursued by the Company have been subjected to scrutiny and detailed analysis by the Apex Court in connection with the challenge raised against the verdict passed by the learned Single Judge of this Court in Writ Petition No.1357 of 2002 on 08.11.2005 and the subsequent order dated 28.04.2006 in M.C.C. No. 254 of 2005. The crucial point to be considered is whether there was any right of absorption or regularisation in the Company, which was claimed by the Appellants/ 28 Petitioners with reference to the training undergone by them in the Company. Admittedly, the training was under the provisions of the Apprenticeship Act, 1961, which does not envisage any such situation or obligation upon the Company in which such training is provided, to have the trainees absorbed by offering regular appointment. The direction given by the learned Single Judge in Writ Petition No. 1357 of 2002 and interference declined in the MCC No. 254 of 2005 was considered by the Apex Court and it was accordingly, that the matter was finalised as aforesaid. In this context, it will be worthwhile to have the directions given by this Court and also by the Apex Court at different points of time to be extracted; for easy reference. The first direction given by this Court as per order dated 08.11.2005 in Writ Petition No. 1357 of 2002, is in the following terms:
"In view of the direction of the Hon'ble Supreme Court the respondents are directed to consider the case of the petitioners for absorption and regularisation on the post of General Mazdoor Category-I immediately after the ban imposed vide order dated 28th July, 2000 (Annexure R-1) issued by the Ministry of Coal, is lifted. The respondents are further directed to take steps to get the relaxation from ban for appointment of the petitioners on the above stated posts. The petitioners may be entitled to proficiency certificates, if permissible."
13. The verdict passed by this Court was set aside by the Apex Court as per the order dated 29.03.2007 in the Civil Appeal. The relevant portion of the said order reads as follows:
"....we are of the opinion that the view taken by the learned Single Judge is not sustainable. When apprentice undergoes a training, there is no obligation for the Management to give him employment/absorption in the establishment. Therefore, the direction given by the learned single Judge is totally wrong and liable to be set aside. However, in case the vacancies are advertised for regular appointment and everything being equal, then a preference may be given to the candidates who have been trained by this establishment because they have undergone a training in this establishment and have legitimate expectation. We set aside the order of the learned Single Judge 29 passed on 8.11.2005 in writ petition and order dated 28.04.2006 passed in review application and direct that as and when vacancy for regular appointment is advertised and everything being equal, preference may be given to the candidates who have been trained by this establishment.
If the incumbents have already successfully completed the training, there is no reason to withhold their proficiency certificate"
14. In the next round of litigation, when the matter came up for consideration before a Division Bench of this Court in Writ Appeal No. 139 of 2009 {arising from the judgment dated 09.04.2009 in Writ Petition (S) No. 38 of 2009}, a verdict was passed; the relevant portion of which as contained in paragraph 10 and 11 is reproduced below:
"10. With regard to relief sought for issuance of direction to take steps for granting proficiency certificates as provided in section 21 of the Apprentices Act, 1961, the Hon'ble Supreme Court has already observed that when the incumbents have completed their training, there is no reason to withhold the proficiency certificates. It appears that in the instant case, the incumbents have not been referred to the National Council inspite of representations made by the appellants to that effect. Therefore, we direct that the appellants' names shall be referred to the National Council alongwith their particulars for giving a chance to appear in the test so that they may get proficiency certificates after getting successful in the test The National Council shall consider the same as early as possible preferably within period of 3 months from the date of production of a copy of this order. A copy of this order shall be produced by the writ appellants before the concerned respondents alongwith all particulars.
11. With regard to age relaxation, we feel that no relief was claimed by the writ appellants in the writ petition for relaxation of their age. However, since their names were not referred to National Council for appearing in the proficiency test as also the entire recruitment was banned by the Central Government on such appointment for a particular period and permission was sought to issue the advertisement after lifting the ban and in the meantime, the appellants became over age, we feel that in case the appellants approach respondent authorities for their age relaxation, the same shall be considered sympathetically keeping in view that they had already undergone 30 apprenticeship training but have been deprived of getting proficiency certificates and also the fact that there was imposition on ban on such appointments, due to which, the appellants became over age. Further the appellants shall also be considered for appointment to the post of General Mazdoor Category-I in accordance with law. "
15. The operative portion of the order dated 23.01.2015 passed by this Court in the Contempt of Court proceedings bearing No. 222 of 2011, 223 of 2011 and 382 of 2011, is as follows:
"7. I will first take up non-compliance of para 10 of order dated 29.04.2010. From a bare perusal of the said order, it would appear that this court directed the respondent-SECL to refer the name of writ appellants to the NCVT along with their particulars so that they may get a chance to appear in the test and to get proficiency certificate. The document dated 27.08.2010 (Annexure P/3) filed by the petitioners would clearly show that in compliance of the order of this Court, the respondents sent name of petitioners herein vide memo dated 29.07.2010 to NCVT as directed and the Govt. of India by its memo dated 27.08.2010 has declined to accept the request of respondent-SECL to grant proficiency certificate to the petitioners on the ground that training given by the SECL cannot be termed as apprenticeship training under the provisions of Apprentices Act, 1961, and therefore, they cannot be awarded certificate under the aegis of NCVT, and upon passing of this order, para 10 of order complained of dated 29.04.2010 stands complied with and if the petitioners are aggrieved with the said order dated 27.08.2010 (Annexure P/3), they are at liberty to challenge the same before the appropriate forum in accordance with law."
16. The case projected before the learned Single Judge from both the sides was considered in detail with reference to the binding judicial precedents as discussed in the judgment dated 17.11.2017 and the following observations have been made in paragraph 21:
"21. From the aforesaid analysis, it is quite apparent that the petitioners' cases for appointment on the post of General Mazdoor Category-I have already been considered by the respondent-SECL with age relaxation when the respondent-SECL had issued advertisement pursuant to the observation/direction issued by the Supreme Court 31 in Jivendra Prasad Tiwari (supra) and in compliance of the order of Division Bench of this Court in Writ Appeal No.139/2009 and order of Contempt Court dated 23.1.2015, representations of the petitioners have been considered and communicated to them. The respondent-SECL has already sent the names of the petitioners to National Council of Vocational Training for grant of necessary certificates who has declined to award National Proficiency Certificate under NCVT and order of National Council of Training, Govt. of India, Ministry of Labour & Employment, Regional Directorate of Apprenticeship Training, Regional Director of Apprentice Training Udyog Nagar, Kanpur and order passed pursuant to the representations dated 15/16.2.2015 have become final as same have not been challenged by the petitioners in these batch of writ petitions. Thus, these writ petitions are barred by principle of res- judicata as in the earlier round of litigation directions issued by Division Bench of this Court in Writ Appeal No.139/2009 have already been considered and complied with and subsequent orders passed by the respondent-SECL and National Council of Vocational Training have not been challenged by the petitioners. Apart from this, except WPS (S) Nos. 1829/2012 and 2541/2012 all other writ petitions suffer from delay and laches of more than 19-20 years in their filing as the petitioners have pleaded that they have completed their apprenticeship in the year 1996 to 1998 and in these writ petitions, they are seeking age relaxation after 19-20 years on the basis of order passed by this Court in Writ Appeal No.139/2009 and contempt petitions, which cannot be granted."

After hearing both the sides and after going through the contents of the materials on record and particularly, the detailed analysis made by the learned Single Judge, we are of the view that the finding rendered by the learned Single Judge is well supported by the reasoning given therein. It is relevant to note that the Respondent-Company has complied with the directions given by the Court to forward the names of the Petitioners to the NCVT for grant of necessary certificates; who however has declined to award the 'proficiency certificate' (by passing an order with reference to the representation dated 15/16.02.2015) which virtually is to the effect that since the training undergone by the parties concerned was not the training actually intended for the purpose of giving 'proficiency certificate', it was not 32 liable to be entertained. Fact remains that the said order passed by the NCVT has not been subjected to challenge by any of the Appellants/Petitioners and this has been rightly observed by the learned Single Judge in 'paragraph 21' of the judgment. That apart, it also remains a fact that, but for the Petitioners in Writ Petition (S) No. 1829 of 2012 and 2541 of 2012, all the other Petitioners approached this Court virtually '19 - 20 years' after completion of their apprenticeship done in 1996-1998;
by virtue of which such matters were not liable to be entertained by this Court under any circumstance. The said finding and reasoning is well based on the law declared by the Apex Court in Ravindra Nath Bose v. Union of India, AIR 1970 SC 470, to the effect that the remedy before this Court under Article 226 of the Constitution is not to extend relief to the persons like the writ petitioners, who were taking rest on arm chair, unmindful of their rights and liberties in this regard.
18. In the above circumstance, we are of the view that the Appellants have not succeeded in raising or substantiating any tenable ground to call for interference with the verdict passed by the learned Single Judge.
19. The appeals fail. They are dismissed accordingly.
