1. The Appellant filed an RTI application dated 30.10.2023 seeking information on the following points:

1. the appeal made by Viplove Tyagi against the committee decision in relation to IISER-P/PhD/20163495/1. The appeal is made via email dated 09 Oct 2023 and copied to the CVO, IISER Pune.
2. a copy each of IISER-P/PhD/20163495/4, IISER-P/PhD/20163495/5, IISER-

P/PhD/20163495/2022 and IISER-P/VT/RO dated 17/03/2022.

3. entire documentation and records of the relevant committee proceedings following IISER-P/PhD/20163495/4, IISER-P/PhD/20163495/5, IISER- P/PhD/20163495/2022 and IISER-P/VT/RO dated 17/03/2022. For each and every document not provided in this reply, appropriate grounds for denial of information must be provided.

1.1. The CPIO replied vide letter dated 28.11.2023. and the same is reproduced as under :-

2.1. The CPIO replied vide letter dated 29.11.2023 and the same is reproduced as under :-

2.2. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 04.12.2023 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 04.01.2024 upheld the reply given by the CPIO.

3. The Appellant filed an RTI application dated 03.11.2023 seeking information on the following points:

(i) Please furnish a copy of the entire documentation available with the Institute, including letters, memos, and all communications, pertaining to
(a) FIR No. 494 dated 13/11/2021 at Chaturshringi Police Station, Pune, and
(b) FIR No. 241 dated 20/4/2022 at SIDCUL Police Station, Haridwar.

3.1. The CPIO replied vide letter dated 01.12.2023 and the same is reproduced as under :-

3.2. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 04.12.2023 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 05.01.2024 stated as under: -

"The institute has not registered any FIR against the applicant."

4. The Appellant filed an RTI application dated 25.11.2023 seeking information on the following points:-

1. Kindly furnish a copy of CPGRAMS Grievance registration number DSEHE/E/2023/0008153 received by the Institute, and a report of the actions taken thereon (see supporting document).
2. Please furnish a copy of the report of actions taken on the appeal made to the Institute administration on 09/11/2023 (see supporting document page 2 onwards).
4.1. The CPIO replied vide letter dated 22.12.2023 and the same is reproduced as under :-
1. The application number DSEHE/E/2023/0008153 under the CPGRAMS portal was disposed off on 29/11/2023. Copy of the Action Taken report from the portal is enclosed for reference.

Please note that the appeal in question is made in the pursuit of justice and safety, and pertains to matters of utmost seriousness and urgency. The appeal raises significant concerns regarding the integrity and ethical conduct of the Institute administration, and must not be dismissed on inconsequential grounds or trivial pretexts by the Institute.

21. The Appellant filed an RTI application dated 11.02.2024 seeking information on the following points:-

(i) The supporting document (pp. 1-2) contains a list of documents submitted in the final report of FIR 494/21 at Chaturshringi police station, and includes the documents received by the police from IISER Pune regarding the matter.

However, these documents do not include the letters sent by the applicant to the IISER administration in his defence and to outline the corrupt and criminal activities of several members of the institute, including the complainant in the above-mentioned FIR. The applicant wants to know whether this omission was made by the police or by IISER administration itself, and has therefore asked the Page 24 of 52 institute to furnish a copy of these documents through multiple RTI requests in the past, e.g., ISERP/R/E/23/00050 and ISERP/R/E/23/00058. However, on each of these occasions, the institute has replied with irrelevant statements, whether out of stupidity or criminal intent the applicant cannot say. However, the applicant can make another request, which he does so here. Please furnish a copy of these documents.

(i) With reference to the report of the first committee as furnished by the institute in reply to ISERP/R/E/23/00033, it is to be noted that this report mentions the events pertaining and subsequent to a hearing on 25 June 2021, but the report itself was fabricated on 23 June 2021, before any such hearing took place, as mentioned in multiple RTI replies from the Institute, and is therefore a forged document as defined in section 470 of the IPC. The institute is also aware that the committee and any person responsible for making this report has committed a cognizable offence under sections 469 and 199 of the IPC. The institute has not Page 25 of 52 informed the applicant of the identity of the offender(s). The applicant is therefore assuming that the institute has already filed an FIR against the said offender(s), otherwise this withholding of information is a criminal offence under section 212, 201-204 and 471 of the IPC on part of the institute administration and the information and vigilance officers. It is in this context that the applicant again requests the record of any action or litigation or FIR filed against the said offender(s) by the Institute administration being fully aware of the commission of a criminal offence. Please provide it.

35.2. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 17.04.2024 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 16.05.2024 upheld the reply given by the CPIO.

35.3. Aggrieved with the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 09.06.2024.

36. The appellant remained absent during the hearing despite notice and on behalf of the respondent Mr. Sreejit Marar, Section Officer, attended the hearing through video conference.

37. The respondent while defending their case inter alia submitted that the appellant filed multiple RTI applications seeking copies of documents pertaining to a report of the committee, including personal details of the member of the committee on Institute's correspondence with Police w.r.t the FIR lodged against him etc. and all were responded as per the provision of the RTI Act and within time. He stated that in the instant set of appeals the appellant is again seeking similar information to which the CPIO's concerned has furnished suitable replies, as per their available records, to the appellant along with the relevant enclosures. Further, the Appellant has not been judicious in the use of the RTI Act and has been using it as a tool to harass the Public Authority. As on date he has filed 108 RTIs, 80 First Appeals and 60 Second Appeals as also 50 complaints in the CPGRAMS portal. All the written submissions of the respondent have been taken on record.

38. The Commission after adverting to the facts and circumstances of the case, hearing the respondent and perusal of records, observes that in all the cases the CPIO's concerned have provided appropriate replies to the RTI Applications as per the provisions of the RTI Act vide letters dated 28.11.2023, 29.11.2023, 01.12.2023, 22.12.2023, 03.01.2024, 19.01.2024, 22.01.2024, 23.02.2024, 02.02.2024, 23.01.2024, 11.03.2024, 13.03.2024, 18.03.2024, 19.03.2024, 22.03.2024, 27.03.2024, 04.04.2024 Page 47 of 52 and 08.04.2024. The Commission also observes that in most of the instant cases the RTIs are repetitive. Moreover, in most of the RTI applications, the appellant has also sought clarification and opinion, as also requesting for non-specific information like 'All documents', if any, etc. which do not fall within the definition of "information" as defined under section 2 (f) of the RTI Act. In this regard, the attention of the appellant is drawn towards a judgment of the Hon'ble Supreme Court in Central Board of Secondary Education &Anr. vs. Aditya Bandopadhyay & Ors [Civil Appeal No.6454 of 2011] date of judgment 09.08.2011. The following was thus held:

"....A public authority is also not required to furnish information which require drawing of inferences and/or making of assumptions. It is also not required to provide 'advice' or 'opinion' to an applicant, nor required to obtain and furnish any 'opinion' or 'advice' to an applicant. The reference to 'opinion' or 'advice' in the definition of 'information' in section 2(f) of the Act, only refers to such material available in the records of the public authority......."

39. Further, the Commission observes that the appellant on grounds of his Second Appeals has challenged the correctness of the information provided by the CPIO's concerned. In this regard, the attention of the appellant is also drawn towards a judgment of the Hon'ble Delhi High Court in its decision dated 06.12.2023 in Narendra Tyagi vs Assistant Director (CPIO) [LPA 764/2023]. The following was thus held:

"13. Consequently, it is clear that dispute as regards the correctness of information provided under the RTI Act, or any other dispute or controversy, cannot be adjudicated in proceedings under the RTI Act. The CPIO is only required to supply all the information/documents within his access. Whether or not such information as provided by the CPIO under the RTI Act is incorrect in any manner, is not the domain of consideration or determination under the RTI proceedings."

40. Further, the Commission observes that the appellant is frequently filing RTI Applications on same or similar subject just to harass respondent public authority, which is purely against the spirit of the RTI Act. 2005. In this regard, attention is drawn to the Page 48 of 52 Hon'ble Supreme Court's observation in the matter of Central Board of Secondary Education (CBSE) & Anr. v. Aditya Bandhopadhyay and others [(2011) 8 SCC 497] stating that:

'37. The right to information is a cherished right. Information and right to information are intended to be formidable tools in the hands of responsible citizens to fight corruption and to bring in transparency and accountability. The provisions of RTI Act should be enforced strictly and all efforts should be made to bring to light the necessary information under clause (b) of section 4(1) of the Act which relates to securing transparency and accountability in the working of public authorities and in discouraging corruption. But in regard to other information,(that is information other than those enumerated in section 4(1)(b) and (c) of the Act), equal importance and emphasis are given to other public interests (like confidentiality of sensitive information, fidelity and fiduciary relationships, efficient operation of governments, etc.). Indiscriminate and impractical demands or directions under RTI Act for disclosure of all and sundry information (unrelated to transparency and accountability in the functioning of public authorities and eradication of corruption) would be counter-productive as it will adversely affect the efficiency of the administration and result in the executive getting bogged down with the non- productive work of collecting and furnishing information. The Act should not be allowed to be misused or abused, to become a tool to obstruct the national development and integration, or to destroy the peace, tranquility, and harmony among its citizens. Nor should it be converted into a tool of oppression or intimidation of honest officials striving to do their duty. The nation does not want a scenario where 75% of the staff of public authorities spends 75% of their time in collecting and furnishing information to applicants instead of discharging their regular duties. The threat of penalties under the RTI Act and the pressure of the authorities under the RTI Act should not lead to employees of a public authorities prioritizing 'information furnishing', at the cost of their normal and regular duties.' Page 49 of 52 Further, the findings of the Commission in the instant set of matter largely point towards a misuse of the RTI Act being perpetuated by the appellant. Here, the appellant's attention is again invited towards certain precedents set by the superior Courts recognizing the misuse of the RTI Act: In ICAI v. Shaunak H. Satya, (2011) 8 SCC781, the Hon'ble Supreme Court has held that:-
'39. We however agree that it is necessary to make a distinction in regard to information intended to bring transparency, to improve accountability and to reduce corruption, falling under Sections 4(1)(b) and (c) and other information which may not have a bearing on accountability or reducing corruption. The competent authorities under the RTI Act will have to maintain a proper balance so that while achieving transparency, the demand for information does not reach unmanageable proportions affecting other public interests, which include efficient operation of public authorities and the Government, preservation of confidentiality of sensitive information and optimum use of limited fiscal resources.' In the matter of Rajni Maindiratta- Vs Directorate of Education (North West - B) [W.P.(C) No. 7911/2015] the Hon'ble High Court of Delhi has held that:
8. Though undoubtedly, the reason for seeking the information is not required to be disclosed but when it is found that the process of the law is being abused, the same become relevant. Neither the authorities created under the RTI Act nor the Courts are helpless if witness the provisions of law being abused and owe a duty to immediately put a stop thereto.' And, in the matter of Shail Sahni vs Sanjeev Kumar [W.P.(C) 845/2014] the Hon'ble High Court of Delhi has held that: '...xxx 'This Court is also of the view that misuse of the RTI Act has to be appropriately dealt with, otherwise the public would lose faith and confidence in this "sunshine Act". A beneficent Statute, when made a tool for mischief and abuse must be checked in accordance with law.' Page 50 of 52

41. The Commission strongly advises the appellant to desist from filing multiple RTI Applications as his future appeals/complaints on the same or similar matter are liable to be summarily dismissed. The Respondents are also advised to take reference of the instant decision while dealing with any future RTI Applications of the Appellant on the same subject matter. The Commission finds no scope for further intervention in the matters. Accordingly, the appeals are dismissed.

Copy of the decision be provided free of cost to the parties.
