2 15-05-2014Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
All the six petitioners, apprehending their arrest in connection with a case registered for the offence punishable under Sections 145, 146, 147, 153, 155 and 174 of the Railway Act, are named accused in this case with allegation of leading an agitation demanding opening of station and ticket counter at railway halt causing disturbance in smooth running of the Rail.
Submission is of false implication only due to crush their genuine demands. Further, none of these six carry any criminal antecedent.
If it is so, considering the facts and circumstances of the case, in the event of their arrest or surrender before the court below within four weeks, let the petitioners abovenamed be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) each with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, East Central Railway, Samastipur, in connection with R.P.F. Post (Sitamarhi) Case No. 55 of 2013, subject to condition laid down under Section 438 (2) of the Code of Patna High Court Cr.Misc. No.13313 of 2014 (2) dt.15-05-2014 2 Criminal Procedure with additional condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
