                                                           O R D E R

1. This petition is filed by wife for transfer of Matrimonial Case No.2630/2024 filed under Section 13 of the Hindu Marriage Act, 1955 by the respondent – husband from the Family Court, Kanpur Nagar, Uttar Pradesh to Serampore, District – Hooghly, West Bengal.

2. Having noticed that there is a possibility of dispute being settled between the parties, the matter Signature Not Verified came to be referred to the Supreme Court Mediation Digitally signed by NEHA GUPTA Date: 2026.02.12 17:46:16 IST Reason: Centre and the parties have entered into an agreement on 11.10.2025. The said agreement is produced alongwith the 1 application, i.e., IA No.17463/2026 which is also duly signed by both the parties.

3. Both parties are present virtually. They are identified by their respective learned counsels.

4. Having interacted with the parties, we are satisfied that the settlement having been entered into between them is voluntary, without any force, threat or coercion and out of their own free will and volition, they have entered into the settlement agreement. They have also identified their signatures on the settlement agreement and have submitted that they have affixed their signatures after having understood the contents of the terms of the settlement. The respective learned counsels who have appeared before the Court today have also identified the parties, who are appearing virtually. In the light of the same, we see no impediment to accept the settlement agreement as having been entered into voluntarily. Accordingly, it is accepted. The petitioner–wife admits and agrees that she has received the amount as indicated in the settlement agreement and she has no further dues or claims against the respondent – husband. The respondent – husband also submits that he has no claims against the petitioner – wife and both the 2 parties in chorus submit that all cases which are pending against each other may be quashed or set aside. They have also prayed for dissolution of their marriage which came to be solemnized on 01.12.2020.

In the light of the abovestated facts and this Court having found that the marriage having broken down irretrievably and the chances of their reunion not only being remote but also impossible and the parties being well educated and having agreed to part their ways, directing them to make rapprochement would be not feasible, we accept their prayer and approve their stand of seeking to dissolve the marriage by consent. Hence, we accept the settlement agreement dated 11.10.2025, dissolve the marriage solemnized between them on 01.12.2020 and direct the Registry to draw the decree of dissolution of marriage accordingly.

6. It is also made clear that all the proceedings pending before various Forums / Courts as indicated in paragraph 1.(i) to (v) stands quashed as noted herein below:-

(i) Matrimonial Suit No.264 of 2024 under Section 13 (1)(a) and (ia) of H.M. Act, titled Divya Chaturvedi Vs. Naman Chaturvedi pending 3 before the Ld. Additional District Judge at Serampore, District Hooghly, West Bengal.

(ii) Criminal Case No. 237 of 2024 pending before Chief Judicial Magistrate Serampore, District Hooghly, West Bengal arising out of FIR No. 22 of 2024 under Section 498A, 406, 323 and 120B IPC and Section 3/4 D.P. Act registered at Serampore Women Station.

(iii) Misc. Case No. 408 of 2024 under Section 144 Bhartiya Nagrik Suraksha Sanhita (corresponding to Section 125 Cr.P.C.) pending before Ld. Additional Chief Judicial Magistrate, Serampore, District Hooghly, West Bengal.

(iv) Case No. 2571 of 2024 under Section 9 of H.M. Act, 1955 pertaining to Restitution of Conjugal Rights pending before Chief Family Court, Kanpur Nagar, Uttar Pradesh.

(v) Matrimonial Case No. 2630 of 2024 under Section 13 of H.M. Act, 1955 pending before Ld. Family Court, Kanpur Nagar, Uttar Pradesh.

7. The Registry to intimate the jurisdictional Courts about this order to enable the said Courts to consign the records of the aforesaid cases, in view of the present order. Parties to bear their respective costs. Transfer Petition stands disposed of accordingly. 4

8. Pending application(s), if any, shall stand disposed of.
