JUDGMENT & ORDER
Common questions of facts and issues being involved in all the
three writ petitions, same were heard simultaneously and are being disposed of
by this common judgment.
BACKGROUND FACTS
[2] In the year 2002, the State of Tripura took initiative for recruiting under graduate teachers, graduate teachers and post graduate teachers for different schools established and functioning in Tripura. Accordingly, first advertisement was issued on 29.10.2002 for filling up 1000 posts of Graduate Teachers, 500 posts of Under Graduate Teachers and 100 posts of Kokborok Teachers. Several persons applied pursuant to that advertisement. On 05.04.2006 again another advertisement was issued for filling up 962 posts of Graduate Teachers, 389 post of Under Graduate Teachers and 100 post of Kokborok Teachers on fixed pay basis.
[3] No recruitment was, however, made pursuant to above said two advertisements and again on 23.09.2009, another advertisement was issued wherein 4856 posts of graduate teachers, 4629 posts of Under Graduate Teachers and 99 posts of Kokborok Teachers were advertised. Regarding the Page 59 of 96 filling up of posts of post graduate teachers, similar advertisements were also issued in 2002, 2006 and lastly on 23.09.2009. In the advertisement of the year 2009, it was also mentioned that the candidates who had applied in the year 2002 and 2006 pursuant to earlier advertisements noted above, were not required to apply again but they were supposed to appear before the interview board. Several candidates applied for jobs against those advertisements. [4] Prior to that, in the year 2003, the State Government framed an employment policy vide memorandum No.F.1(4)-GA(P&T)/99 dated 30.08.2003 giving guidelines regarding such recruitments in respect of various categories of posts under Government of Tripura.
[5] The selection process in respect of the candidatures received in respect of above said advertisements was initiated by the State following above said employment policy and the successful candidates were appointed. [6] Challenging the said recruitment process, several writ petitions were filed before this Court (the then Gauhati High Court, Agartala Bench) and learned Writ Court without entering into the merit of the matter, disposed of a total of 61 writ petitions by a common judgment dated 16.11.2011 remanding the matter to the Government for thorough scrutiny and examination by constituting a committee of responsible officers.
[7] The State challenged said judgment of the learned Writ Court and some of the petitioners also simultaneously filed an appeal being aggrieved by said decision. The Division Bench, in W.A. 54 of 2011 and other connected matters, allowed the writ appeals holding that matter should be decided by the Court.
Page 60 of 96[8] Thereafter, in view of large numbers of petitions and considering the public interest involved in these matters, the Division Bench took up all the matters for hearing and one of such cases was Tanmoy Nath and others vs. State of Tripura and others [WP(C) No.51 of 2014]. All the writ petitions were disposed of by the Division Bench by a common judgment dated 07.05.2014 (hereinafter referred to as Tanmoy Nath's case) quashing said revised employment policy and setting aside the entire selection process. It was also held that the selections were totally unfair and the policy was illegal and unconstitutional. The Division Bench, however, considering the fact that the education of children are not disturbed, directed that the teachers whose selection was set aside should continue to function in their present place of posting till 31.12.2014 and before said date, the State must complete a fresh process of selection of all teachers in all categories. [9] The State Government was further directed in the said judgment to frame a new employment policy within two months and to carry out the selection as per the fresh policy. In case the State did not frame any guidelines or fresh policy, then some guidelines were also issued by the Court asking the State to follow the same while making new selections.
[10] At Para 127 of the said judgment, it was further clarified by the Court that the judgment shall be prospective in nature and shall not affect the appointments already made unless the said appointments were already under challenge before the Court on the ground that the employment policy is illegal. Said paragraph No.127 of the judgment of Tanmoy Nath's case having significant relevancy in the present cases is extracted hereunder: Page 61 of 96
"127. Since we have set aside the revised employment policy which applies to a large category of posts and not merely to teachers, we would like to make it clear that our judgment shall be prospective in nature and shall not affect the appointments already made unless the said appointments are already under challenge before the Court on the ground that the employment policy is illegal."
[11] The State preferred an appeal before the Hon‟ble Supreme Court against the said judgment in Special Leave to Appeal (C) No(s).18993- 19049/2014 which was dismissed on 29.03.2017. However, the direction of the High Court given in paragraph No.123 of the judgment of Tanmoy Nath's case containing direction to the State to complete a fresh process of selection of teachers by 31.12.2014 was modified to the following extent:
"............ Since we do not find any ground to interfere with the impugned order, the directions in para 123 now required to be suitably modified. We, therefore, direct:
(a) New Employment Policy should be framed by the State by 30th April, 2017 if not already framed and advertisements for filling up the vacancies may be issued latest by 31st May, 2017.
(b) The fresh selection process be completed on or before 31st December, 2017 and till the fresh process is completed, the teachers already appointed shall continue.
(c) The candidates who participated in the selection process pursuant to the advertisements in question, whether selected or not, will be allowed to participate in the fresh selection process by relaxing their age but subject to their having necessary qualifications.
(d) The qualifications in the case of teachers governed by the provisions of the Right of Children to Free and Compulsory Education Act, 2009 shall be in conformity with the relevant statutory provisions of the said Act.
(e) The qualifications of teachers employed for Classes IX and above shall be strictly in compliance with the relevant provisions concerning such appointments.
Subject to the aforesaid modifications, the view taken by the High Court in the impugned order is affirmed and the special leave petitions are dismissed."
Page 62 of 96[12] According to the State, after the order was passed by Hon‟ble Supreme Court, the services of post graduate teachers, graduate teachers and under graduate teachers who were appointed in the year 2010 came to an end on 31.12.2017. Thereafter, those teachers were appointed again on 01.01.2018 for a period of 6(six) months on ad-hoc basis vide Memorandum dated 23.12.2017 and then in pursuance of the subsequent order of the Hon‟ble Apex Court, the tenure of the teachers re-appointed on ad-hoc basis was extended from time to time up to 31.03.2020 and thereafter, they were terminated from the service. Meanwhile, the Education (School Department), Government of Tripura formulated the Recruitment Rules of different categories of teachers following the guidelines of National Council for Teacher Education (in short „NCTE‟) and started recruiting teachers through selection processes conducted by Teachers‟ Recruitment Board, Tripura (in short „TRBT‟) since 2016. [13] Now, the present writ petitions are filed by some of the terminated teachers challenging their termination, which was on different grounds. WP(C) No.592 of 2024 is related to termination of some of the post graduate teachers; WP(C) No.57 of 2025 relates to termination of some of the graduate teachers and WP(C) No.699 of 2024 relates to termination of some of the under graduate teachers. The case bearing No. WP(C) 592 of 2024 (post graduate teachers) is being treated as the lead case.
CHALLENGES MADE IN THE PRESENT WRIT PETITIONS [14] The basic challenges of all the writ petitioners in these petitions regarding their termination from the service, are on the following grounds: Page 63 of 96
i) They were recruited following the Recruitment Rules of the State Government issued vide notification No.F.25(1)-E/70(EC) dated 26.01.1971 (Annexure 1) and not by any other rules or policy.
ii) They were recruited vide State Government policy bearing No.F.10(2)-FIN(G)/05/Part-1 dated 16.10.2007 (Annexure 2) and not by the policy of 2003 as was set aside in Tanmoy Nath's case.
iii) They were not party to said Tanmoy Nath's case and therefore, said decision was not binding on them. Though public notice was issued in Tanmoy Nath's case as per the provision of Order I rule 8 CPC and was published in two newspapers having wide circulation in Tripura, the petitioners were not concerned with said notice inasmuch as they were recruited following a different Recruitment Policy.
iv) The 2003 Recruitment Policy was not mentioned in the advertisement issued by the respondents or even in the appointment orders of the petitioners and therefore, the applicability of said policy in the cases of petitioners or even the existence of said policy itself is questionable.
v) The services of the petitioner were protected in the contexts of paragraph No.127 of the judgment of Tanmoy Nath's case as extracted earlier.
vi) That such termination was illegal and unconstitutional being done in flagrant violation of CCS (CCA) Rules, 1965, as no notice to show cause before such termination was issued to them, and no proceeding was initiated against them. According to them, once a person is recruited and subsequently regularized in service, they hold a civil post, and the only way to Page 64 of 96 terminate the service is to follow the procedure laid down in CCS (CCA) Rules, 1965 and Article 311 of the Constitution and therefore, en-masse orders of termination from service were illegal.
vii) In WP(C) No.592 of 2024, further defence was taken that after the judgment passed in Tanmoy Nath's case by the High Court, the services of the petitioners were regularized vide Memorandum dated 05.11.2015 giving the benefit of a regular pay scale and other allowances to the petitioners of said case. Therefore, said fact suggests that the selection and appointments of the said petitioners were not under challenge in Tanmoy Nath's case.
ARGUMENTS PLACED ON BEHALF OF THE PETITIONERS [15] Mr. R. Marar, learned senior counsel for the petitioners in WP(C) No.592 of 2024 addresses his argument that the petitioners were guided by the Recruitment Policy of 2001 and the policy of 2007 and not by the policy of 2003 and therefore, decision of Tanmoy Nath's case has no impact on the services of the petitioners. According to learned senior counsel, no notice before termination of their service was issued to the petitioners and therefore, it was in gross violation of natural justice. Further, the services of the petitioners were also regularized in the year 2015. Learned senior counsel also submits that there has been no inordinate delay in filing the present petition, for they earlier preferred a writ petition before the Hon‟ble Supreme Court in the year 2024 and later on the same was withdrawn for availing remedy under Article 226 of the Constitution before the High Court.
Page 65 of 96[16] Learned senior counsel also relies on a decision of the Single Bench of this Court in case of Abul Bashar Zia Uddin vs. the State of Tripura and others [WP(C) No.797 of 2020] (Annexure-13). In that case, some Assistant Teachers (Biology/Pure Science) challenged the show cause notice issued to them, alleging that they were covered by the decision of Tanmoy Nath's case. They were appointed in response to an advertisement issued by the State on 25.08.2010 and were given appointments in the month of March, 2012. Learned Single Bench categorically observed in said judgment that the decision of Tanmoy Nath's case was not applicable in the case of the petitioners of said case, as they were recruited pursuant to the advertisement dated 25.08.2010 which was never challenged in Tanmoy Nath's case and therefore, said show cause notice was quashed.
[17] Mr. T.K. Nayak, learned counsel in addition to the submissions as advanced by Mr. Marar, learned senior counsel, further argues that as per the dictionary meaning, the word "memorandum" means either a communication or an agreement pending finalization and therefore, by issuing such policy of 2003 through a memorandum, the services of petitioners could not be terminated, inasmuch as the contents of the memorandum are always subject to final approval by the different authorities of the executives. Therefore, such policy of 2003 issued by a memorandum was subject to finalization and that is the reason for which it was not published for general appraisal. Thus, said policy could not be applied in the case of the petitioners. [18] Learned counsel has also added that the policy of 2003 was only meant for the purpose of reservation and not for the selection process and Page 66 of 96 moreover, it was at the draft stage. Learned counsel continues to argue that there was no denial in the counter affidavit submitted by the State against the assertions of the petitioners that 2003 policy was not binding on them. [19] Mr. Nayak, learned counsel also relies on a decision of Division Bench of this court in case of Sudip Kumar Debnath and others vs. the State of Tripura and others [WP (C) 119 of 2020] decided along with another writ petition bearing No. WP(C) No.620 of 2020 wherein the services of the petitioners of both the cases were terminated pursuant to the decision of Tanmoy Nath's case. Those terminations were challenged in the Court and the Court ultimately dismissed said writ petitions. At the time of hearing, from the side of the petitioners, reference was made to the appointments of three respondents as science teachers pursuant to an advertisement issued in the year 2010. Said three respondents were also made party in another earlier writ petition bearing No. WP(C) 537 of 2012 which was decided simultaneously with Tanmoy Nath's case. In this regard, the Court in Sudip Kumar Debnath's case observed that one of the stray petition i.e. WP(C) No.537 of 2012 out of the entire group of large numbers of petitions, did involve a challenge to the science teachers who were also appointed on the basis of the same Recruitment Policy. However, in the entire judgment of the High Court in Tanmoy Nath's case, the sole focus was on ten thousand plus appointments made to the Under Graduate, Graduate and Post Graduate teacHers pursuant to the advertisement dated 23.09.2009 and therefore, one could not be allowed to pick an isolated petition out of the context to hold that the entire selection and appointment of science teachers which were not part of said recruitment notification dated 23.09.2009 but were by way of termination of entirely different selection Page 67 of 96 process, must also stand nullified. Mr. Nayak, learned counsel tries to impress the Court that the present case also stands on similar footing which was not the matter of controversy in Tanmoy Nath's case. But this Court is not convinced with such submissions, as the present petitioners were not appointed as science teachers like said three respondents of Sudip Kumar Debnath's case. [20] Mr. Nayak, learned counsel further relies on the following decisions:
(i) Secretary, State of Karnataka and others vs. Umadevi (3) and another, (2006) 4 SCC 1- The Constitution Bench of the Apex Court in this case at paragraph No.47 observes that when a person enters a temporary employment or gets engagement as a contractual or casual worker and the engagement is not based on a proper selection as recognised by the relevant rules and procedure, he is aware of the consequences of the appointment being temporary, casual or contractual in nature. Such a person cannot invoke the theory of legitimate expectation for being confirmed in the post when an appointment to the post could be made only by following a proper procedure for selection and in cases concerned, in consultation with the Public Service Commission. In that case, however, as a one time measure, the services of irregularly appointed (not illegally appointed) persons, who have worked for ten years or more against duly sanctioned posts, were directed to be regularised by the Government. This judgment is pronounced in a completely different context.
(ii) Gulf Goans Hotels Company Limited and another. vs. Union of India and others, (2014) 10 SCC 673- In this case, the appellants were the owners of Hotels, Beach Resorts and Beach Bungalows in Goa whose Page 68 of 96 certain properties were ordered to be demolished by the State authorites on ecological grounds, and such orders were upheld by Bombay High Court and therefore the matters came before the Hon‟ble Supreme Court. Certain environmental guidelines of the Governments, in this regard, as a matter of policy were relied on and were examined by the Court. In that context, the Apex Court observes at paragraph No.19 that Article 77 of the Constitution provides the form in which the Executive must make and authenticate its orders and decisions and as per Clause (1) of Article 77 of the Constitution, all executive action of the Government must be expressed to be taken in the name of the President. At paragraph No.21, relying on another decision of the Supreme Court, it has been observed that in absence of due authentication and promulgation of the guidelines, the contents thereof cannot be treated as an order of the Government and would really represent an expression of opinion.
A noting recorded in the file is merely a noting simpliciter and nothing more. It merely represents expression of opinion by the particular individual and it cannot be treated as a decision of the Government. At paragraph No.22, it is also observed that what is claimed to be law must be notified or made public in order to bind the citizen.
(iii) The Management of Rain Row Dyeing Factory, Chinnamuthu Street, Shevapet, Salem and others vs. the Industrial Tribunal, High Court Buldings Madras-1 and another, AIR 1959 Mad 137- While dealing with the question as to whether 30 industrial establishments can be allowed to file joint writ petition where the Tribunal passed an award considering the questions unit by unit and the management of all the 30 Page 69 of 96 concerns are affected by said order of the Tribunal, the High Court incidently observed as under:
"Section 141, Civil Procedure Code, provides that the procedure laid down in the Code in regard to suits shall be followed, as far as it can be made applicable, in all proceedings in any Court of civil jurisdiction. On the strength of this rule it was suggested that the provisions of O.1, C.P.C., can be applied to writ proceedings. In respect of this suggestion it is sufficient to refer to Thakur Prasad v. Fakir Ullah (1) where when dealing with S.647 of the old Civil Procedure Code, which corresponds to S.141 of the present Code, the Privy Council observed:
"Their Lordships think that the proceedings spoken of in S.647 include original matters in the nature of suits such as proceedings in probtes, guardianships, and so forth, and do not include executions."
So far we are aware, a writ proceeding has never been held to be in the nature of a suit...."
As it appears, by referring to this decision, Mr. Nayek, learned counsel tries to show that the general notice issued under Order I rule 8 C.P.C. in Tanmoy Nath's case was not permissible at Law and therefore, the same is not binding on the present petitioners. But any such question regarding validity of the notice, as was issued in that case, cannot be challenged or reopened in a parallel proceeding(s) like present writ petitions and moreover, the matter has already reached finality.
(iv) Hochtief Gammon vs. State of Orissa and others, (1976) 1 SCR 667 at page 679- In the relevant paragraph, it is observed that the Executive has to reach their decisions by taking into account relevant considerations. They should not refuse to consider relevant matter, nor should they take into account wholly irrelevant or extraneous considerations. They should not misdirect themselves on a point of law. Only such a decision will be lawful. The courts have the power to see that the Executive acts lawfully. Page 70 of 96
(v) Msr. Maneka Gandhi vs. Union of India and another, (1978) 1 SCC 248- In paragraph No.14, the relevant portion as referred by learned counsel discusses with the principle of audi alteram partem. It has been observed therein that the audi alteram partem rule is intended to inject justice into the law and it cannot be applied to defeat the ends of justice, or to make the law „lifeless, absurd, stultifying, self-defeating or plainly contrary to the common sense of the situation.‟ Since the life of the law is not logic but experience and every legal proposition must, in the ultimate analysis, be tested on the touchstone of pragmatic realism, the audi alteram partem rule would, by the experiential test, be excluded, if importing the right to be heard has the effect of paralysing the administrative process or the need for promptitude or the urgency of the situation so demands. But, at the same time, it must be remembered that this is a rule of vital importance in the field of administrative law and it must not be jettisoned save in very exceptional circumstances where compulsive necessity so demands.
[21] Mr. Aditya Mishra, another learned counsel for the petitioners also referred to paragraph No.13 of Tanmoy Nath's case. In that paragraph, basically the Court referred to a decision of the Apex Court rendered in State of Orissa and another vs. Mamata Mohanty, (2011) 3 SCC 436, wherein the Hon‟ble Supreme Court stressed upon the excellence of the teaching staff and that they should possess a good academic record/minimum qualification prescribed as eligibility.
[22] Mr. Abheek Saha, learned counsel for the petitioners in WP(C) No.57 of 2025 submits that the judgment of Tanmoy Nath's case was not in Page 71 of 96 rem and therefore was not binding on the petitioners. He also refers to Section 35 of Bharatiya Sakshya Adhiniyam, 2023 which basically deals with the relevance of certain judgments of a competent Court or Tribunal in the exercise of probate, matrimonial, admiralty or insolvency jurisdiction. Therefore, that provision being rule of evidence cannot be applied in the present contexts. Mr. Saha, learned counsel also argues that petitioners were not made party in Tanmoy Nath's case resorting to the provision of Order I rule 10 CPC and therefore, on that ground also said decision would not be binding on them. [23] Mr. Saha, learned counsel relies on the following decisions:
(i) Bharat Sanchar Nigam Limited vs. Ghanshyam Dass (2) and others, (2011) 4 SCC 374- In this case, it was observed that where only the affected parties approached the Court and relief was granted to those parties, the fence-sitters who did not approach the Court cannot claim that such relief should have been extended to them, thereby upsetting or interfering with the rights that had accrued to others.
(ii) State of Uttar Pradesh and others vs. Arvind Kumar Srivastava and others, (2015) 1 SCC 347- At paragraph nos. 22.2 and 22.3, it is observed that those persons who challenge the wrongful action in their cases and acquiesced into the same and woke up after long delay only because of the reason that their counterparts who had approached the court earlier in time succeeded in thier efforts, then such employees cannot claim that the benefit of the judgment rendered in the case of similarly situated persons be extended to them. However, this exception may not apply in those cases where the judgment pronounced by the court was a judgment in rem with the intention to Page 72 of 96 give benefit to all similarly situated persons, whether they approached the court or not. It is further observed that if the judgment of the Court is in personam holding that benefit of the said judgment shall accrue to the parties before the Court and such an intention is stated expressly in the judgment or it can be impliedly found out from the tenor and language of the judgment, those who want to get the benefit of the said judgment extended to them shall have to satisfy that their petition does not suffer from either laches and delays or acquiescence. Mr. Saha, learned counsel also submits that there must be some reasoned order of the authority before terminating the present petitioners from the service which was lacking in the impugned termination letter.
(iii) Constitution Bench decision of the Hon‟ble Supreme Court in the case of Union of India and another vs. Tulsiram Patel, (1985) 3 SCC 398, as referred by Mr. Saha, it is held that the second condition necessary for the valid application of clause (b) of the second proviso of Article 311 of the Constitution is that the disciplinary authority should record in writing its reason for its satisfaction that it was not reasonably practicable to hold the inquiry contemplated by Article 311(2).
(iv) Sukhdev Singh vs. Union of India and others, (2013) 9 SCC 566- In this case, reference was made to another decision of the Hon‟ble Supreme Court in Dev Dutt vs. Union of India, (2008) 8 SCC 725, wherein it was held that non-communication of entries in the Annual Confidential Report of a public servant would be arbitrary and violative of Article 14 of the Constitution. This citation appears to be totally misplaced by the petitioners. Page 73 of 96
(v) Managing Director, ECIL, Hyderabad and others vs. B. Karunakar and others, (1993) 4 SCC 727- In the context of departmental proceedings and imposition of penalty, it was held that proceedings must be just, fair and reasonable and negation thereof would offend Articles 14 and 21 and that the principles of natural justice shall have to be followed. No decision prejudicial to a party should be taken without affording an opportunity or supplying the material which is the basis for the decision. It was also observed that the enquiry report constitutes fresh material which has great persuasive force or effect on the mind of the disciplinary authority.
(vi) Bilaspur Raipur Kshetriya Gramin Bank and another vs. Madanlal Tandon, (2015) 8 SCC 461- In this case, the copy of list of witnesses and the list of documents were not supplied to the delinquent in the departmental proceeding and the High Court quashed the order of removal. The Division Bench thereafter observed that although the show cause notice was served along with seventeen charges, no document was supplied along with the show cause notice to the delinquent. The Apex Court in that context did not differ with the decision of the High Court.
(vii) Deepak Ananda Patil vs. the State of Maharashtra and others, 2023 INSC 11- In this case, it is observed that an adjudicatory body cannot base its decision on any material unless the person against whom it is sought to be utilized has been apprised of it and given an opportunity to respond to it.
(viii) Smt. Bijaya Bhattacharya vs. the State of Tripura and others [WP(C) No.172 of 2015 decided analogously with some other writ Page 74 of 96 petitions on 26.02.2016 by this Court]- Said case was relating to a dispute regarding recruitment of Assistant Professor wherein it was observed that in case the State decided to reserve any post, then de-reservation and reservation should clearly be made subject-wise and while doing so State shall take into consideration the number of reserved category candidates in a particular subject and if the reserved categories are sufficiently represented, then there can be no reservation in that subject. Said judgment was also passed by the High Court completely in a different context.
(ix) Mr. M. Manju Prasad vs. State of Karnataka, by its Chief Secretary and others, ILR 2023 KAR 3869- The relevant portion of the judgment of the Apex Court in Dilbagh Rai Jarry vs. Union of India and others, (1974) 3 SCC 554, as referred by Mr. Saha, observes that the State is not an ordinary party trying to win a case against one of its own citizens by hook or by crook; for the State‟s interest is to meet honest claims, vindicate a substantial defence and never to score a technical point or overreach a weaker party to avoid a just liability or secure an unfair advantage, simply because legal devices provide such an opportunity.
(x) Sundeep Kumar Bafna vs. State of Maharashtra and another, (2014) 16 SCC 623- In relevant paragraph No.19 as relied on by Mr. Saha, learned counsel, it is observed by the Apex Court that a decision or judgment can be per incuriam any provision in a statute, rule or regulation, which was not brought to the notice of the Court and a decision or judgment can also be per incuriam if it is not possible to reconcile its ratio with that of a previously pronounced judgment of a co-equal or larger Bench; or if the Page 75 of 96 decision of the High Court is not in consonance with the views of the Apex Court. Learned counsel relies on this judgment to buttress his submission that the issues raised in the present writ petition were not raised and discussed in the decision of Full Bench of this Court in case of Pranab Deb vs. the State of Tripura and others [WP(C) No.893 of 2022] and therefore, said judgment is not binding on this Court.
[24] Finally, referring to a part of Lok Sabha debate of the year 2009 wherein one of the then MP from Tripura addressed the House on the need for establishment of a separate High Court in Tripura considering the geographical condition of the State that it was in the remote corner of North-East region and access to Guwahati was extremely difficult for common people. Mr. Saha, learned counsel submits that in such a remotest corner of the country, termination of poor employees from the service was too harsh. [25] Mr. A L Saha, learned counsel in WP(C) No.699 of 2024 mainly argues that service condition of the petitioners are governed by Articles 309, 310 and 311 of the Constitution and without following the procedure as laid down in the CCS (CCA) Rules, an employee cannot be terminated; otherwise, it would be violative of Article 21 of the Constitution. Mr. AL Saha, learned counsel also submits that conversion of the petitioners from regular employment to ad-hoc employment itself was a punishment and therefore, before doing so, Rule 11 of CCS (CCA) Rules ought to have been applied by the State. However, on query by the Court, learned counsel fairly submits that such plea was not taken in the writ petition.
Page 76 of 96[26] Learned counsel also refers to the relevant part of the draft Constitution containing the debate portion wherein Sri Brajeshwar Prasad, during discussion, expresses that there should be some authority in the State to dismiss a public servant if a civil servant is found guilty and if the authority is convinced that he is a fifth columnist and that it is not desirable to keep him in service. But there should not be so many authorities vested with this power and the President alone should be empowered with this power. This reference does not show any relevancy with the present controversies in hand. [27] His next point of argument is that quasi-judicial authorities are required to follow the principles of natural justice and there should be a reasoned order passed by such authority. According to learned counsel, both in the case of lowering the petitioners to the status of ad-hoc employee and also at the time of final termination, no notice was issued to the petitioners and the provision of Article 311 was also not followed. Even the respondents have not furnished any information to the petitioners as to by which procedure and under what authority they were terminated from the service. [28] Learned counsel also relies on a decision of Constitution Bench in case of Collector of Monghyr and others etc. vs. Keshav Prasad Goenka and others etc., 1962 SCC OnLine SC 93. This case was basically relating to the construction of Section 5-A of the Bihar Private Irrigation Works Act, 1922. Sub-section (1) of Section 5-A provides that notwithstanding anything to the contrary contained in the Act, whenever the Collector, for reasons to be recorded by him, is of opinion that the delay in the repair of any existing irrigation work which may be occasioned by proceedings commenced by a Page 77 of 96 notice under Section 3 adversely affects or is likely to affect adversely lands which are dependent on such irrigation work for a supply of water, he may forthwith cause the repair of such irrigation work to be begun by any one or more of the persons mentioned in clause (ii) of Section 3 or by such agency as he thinks proper. In that context, the Apex Court observed that on the texture of the provision the recording of the reasons is a condition for the emergence of the power to make the order under sub-section (1). Said observation of the Apex Court is no doubt in view of the above said provision of sub-section (1) of Section 5-A of that Act.
[29] Learned counsel also further relies on the following decisions:
(i) Nazir Ahmad vs. King-Emperor, AIR 1936 PC 253 (2)- In this case, it was observed that where a power is given to do a certain thing in a certain way, the thing must be done in that way or not at all.
(ii) State of Orissa vs. Dr. (Miss) Binapani Dei and others, 1967 SCC OnLine SC 15- In this case, it was observed that the State undoubtedly has the authority to compulsorily retire a public servant who is superannuated. But when that person disputes the claim he must be informed of the case of the State and the evidence in support thereof and he must have a fair opportunity of meeting that case before a decision adverse to him is taken.
(iii) Basudev Dutta vs. the State of West Bengal and others, 2024 INSC 940- In this case at paragraph No.12.5 as relied on by learned counsel, reference was made to another decision of the Apex Court in the case of Aureliano Fernandes vs. State of Goa, (2024) 1 SCC 632, and in said case Page 78 of 96 at paragraph No.73 it was observed that even when the rules are silent, principles of natural justice must be read into them.
(iv) H.L. Trehan and others vs. Union of India (UOI) and others, (1989) 1 SCC 764- In this case, it has been held that post-decisional opportunity of hearing does not subserve the rules of natural justice. The authority who embarks upon a post-decisional hearing will naturally proceed with a closed mind and there is hardly any chance of getting a proper consideration of the representation at such a post-decisional opportunity.
(v) Union of India and another vs. Tulsiram Patel, AIR 1985 SC 1416- The Constitution Bench of the Apex Court in this case observed that the pleasure doctrine embodied in Article 310(1), the protection afforded to civil servants by clauses (1) and (2) of Article 311 and the withdrawal of the protection under clause (2) of Article 311 by the second proviso thereto are all provided in the Constitution on the ground of public policy and in the public interest and are for public good. It was also observed that livelihood of an individual is a matter of great concern to him and his family but his livelihood is a matter of his private interest and where such livelihood is provided by the public exchequer and the taking away of such livelihood is in the public interest and for public good, the former must yield to the latter. These consequences follow not because the pleasure doctrine is a special prerogative of the British Crown which has been inherited by India and transposed into the Constitution but because public policy requires, public interest needs and public good demands that there should be such a doctrine. (vi) Msr. Maneka Gandhi vs. Union of India and another, AIR 1978 SC 597 (Para 56)- Mr. A. L . Saha also relies on this deicision again to the observations of the Hon‟ble Supreme Court that the principle of reasonableness which legally as well as philosophically is an essential element of equality or non-arbitrariness pervades Article 14 like a brooding omnipresence and the procedure contemplated by Article 21 must answer the test of reasonableness in order to be in conformity with Article 14. It must be "right and just and fair" and not arbitrary, fanciful or oppressive; otherwise, it would be no procedure at all and the requirement of Article 21 would not be satisfied.
SUBMISSIONS FROM THE SIDE OF RESPONDENTS [30] Mr. D. Sarma, learned Addl. G.A. submits that despite advertisements issued on 29.10.2002 and 05.04.2006, no selection was held following those advertisements, rather the recruitment was made on the basis of advertisement issued on 23.09.2009 whereby the applications submitted in pursuance of the previous two advertisements of the year 2002 and 2006 were also taken up together. He argues that all the questions raised by the present petitioners in the above said three writ petitions are already discussed and decided in previous two judgments of the High Court and therefore, now these controversies cannot be re-opened again. Learned Addl. G.A. in this regard relies on a decision of the Division Bench of this Court rendered in Sri Bijoy Krishna Saha & others vs. the State of Tripura and others [WP(C) No.1040 of 2019 decided analogously with a bunch of other writ petitions on 03.10.2019] and the decision of the Full Bench of this High Court dated 26.09.2023 in the case of Sri Pranab Deb (Supra).
Page 80 of 96[31] In reply to said argument, Mr. T.K. Nayak, learned counsel submits that the above said two decisions of this Court will not constitute res judicata as the petitioners earlier filed a petition under Article 32 before the Apex Court and as per liberty granted by the Apex Court, WP(C) No.592 of 2024 was filed and moreover, the parties of the present petitions were also not party in those cases and the issues raised are also not common.
ANALYSIS & DECISION [32] In consideration of the submissions made by both sides and materials placed on records by the parties, the points of challenges as placed by the petitioners in these writ petitions and as indicated in paragraph No.11 above are being taken up one by one for discussions and decisions. [32.1] The point raised by the petitioners that they are not covered by the decision of Tanmoy Nath's case is being examined first. It is their specific plea that they were recruited following the Recruitment Rules of the State Government issued vide notification No.F.25(1)-E/70(EC) dated 26.01.1971 and not as per Recruitment Policy framed by the State Government in the year 2003 and therefore, the decision of Tanmoy Nath's case is not applicable in their cases. Said Recruitment Rules of 1971 are placed at Annexure 1 in the lead case which basically mentions the desired educational and other qualifications and age limit for direct recruitment for the posts of Assistant Teachers, Secondary Schools. Details of the manner of such recruitment are not enumerated therein. The revised employment policy framed by the State of Tripura (as reproduced in Tanmoy Nath's case) demonstrates that certain general instructions were laid down therein by the Page 81 of 96 State regarding the age limit, reservation policy for Scheduled Tribes and Scheduled Castes, Physically Handicapped Persons and Ex-servicemen Category including guidelines for the appointment of dependents of retired Government servant, defence personnel, retrenched employee, Other Backward Community, Minority etc. [32.2] In WP(C) No.592 of 2024, the petitioners have categorically stated that they applied for the post of Post Graduate Teacher under advertisement dated 23.09.2009 (Annexure 3 of the lead case). In WP(C) No.699 of 2024, it is also the assertion of the petitioners that they applied for the post of Under Graduate Teachers under said advertisement dated 23.09.2009 and in WP(C) No.57 of 2025 it is the claimed by the petitioners that pursuant to advertisements dated 29.10.2002, dated 05.04.2006 and lastly, dated 23.09.2009 published by the State Government, they applied for the posts of Graduate Teacher. They placed those advertisements at Annexure 2 of their writ petitions. It is also the case of the petitioners of all the present writ petitions that on being selected, they were issued with an offer of appointment and accordingly, they joined in the service. Now, on perusal of the judgment passed in said Tanmoy Nath's case (Annexure 6 of the lead case), it appears that the selection of Under Graduate, Graduate and Post Graduate Teachers pursuant to advertisements issued on 29.10.2002, 05.04.2006 and 23.09.2009 was under challenge in the said bunch of writ petitions and after thorough examination of said Recruitment Policy of 2003 as well as the selection processes, High Court held that the selections were totally unfair and were not made in a transparent manner and most of the Page 82 of 96 clauses of the policy of 2003 were illegal and unconstitutional and further, entire policy was held to be vague.
[32.3] In said judgment of Tanmoy Nath's case, the entire selection process in respect of said three advertisements was set aside and the State Government was directed to complete a fresh process of selection of teachers in all categories on or before 31.12.2014 by framing the new employment policy within two months therefrom, and in case the State did not frame any guidelines, then some guidelines were also issued by the High Court to be followed in the fresh selection. Therefore, the position is very clear that the selections made pursuant to the above said three advertisements whereby the petitioners appointed, were set aside and therefore, without the least hesitation, it can be said that the judgment passed in Tanmoy Nath's case and as was affirmed by the Hon‟ble Supreme Court in Special Leave to Appeal (C) No.18993-19049/2014 (Annexure 9 of the lead case) are applicable in the cases of present petitioners and therefore, the ground raised by the petitioners that they were not recruited by the policy of 2003 is also not acceptable. Hon‟ble Supreme Court in said Special Leave Petitions however, modified the directions of the High Court contained in paragraph No.123 of the judgment of Tanmoy Nath's case in the terms as already extracted in paragraph No. 11 above with a direction to the State to complete the fresh selection process on or before 31st December, 2017 and meanwhile, the teachers already appointed were allowed to continue.
[32.4] After said judgment passed by the Hon‟ble Supreme Court on 29.03.2017 and subsequent order passed on 14.12.2017, the State Government issued a memorandum dated 23.12.2017 (Annexure 10 of the lead case) Page 83 of 96 wherein it was stated that the tenure of the incumbents will come to an end on 31.12.2017 terminating the service of all the persons who were covered by the decision of Tanmoy Nath's case, and accordingly their services including the services of the petitioners were terminated w.e.f. 31.12.2017. Thereafter, in terms of the order of the Hon‟ble Supreme Court dated 14.12.2017, they were again appointed on ad-hoc basis for a period of six months w.e.f. 01.01.2018 vide memorandum dated 23.12.2017. Thereafter, as permitted by the Hon‟ble Supreme Court, their ad-hoc appointment services were allowed to be continued till 31.03.2020 and finally, their such ad-hoc services were also terminated vide memorandum dated 31.03.2020 (Annexure 11 of the lead case) in respect of Post Graduate Teachers, vide memorandum dated 31.03.2020 [Annexure 11 of WP(C) No.699 of 2024] in respect of Under Graduate Teachers and vide memorandum dated 31.03.2020 [Annexure 8 of WP(C) No.57 of 2025] in respect of Graduate Teachers.
[32.5] Mr. T.K. Nayak, learned counsel, submitted that the post Graduate Teachers were appointed vide policy bearing No.F.10(2)- FIN(G)/05/Part-1 dated 16.10.2007 (Annexure 2 of the lead case) but said policy is not at all an employment policy. It was a policy decision of the State Government regarding recruitment of Group C and Group D employees on fixed pay basis by keeping in abeyance the regular pay scale posts as a matter of cost-cutting method. In said notification, it is indicated that those employees would be first placed on fixed pay for five years and thereafter regular pay scale would be provided to them and during their period of fixed pay, they would also be provided with certain benefits like leave, seniority, coverage under die-in-harness scheme etc. Said notification has no relation Page 84 of 96 with Recruitment Policy of the State and therefore, such claim of the petitioners that they were recruited vide policy of the State Government dated 16.10.2007, is also not tenable.
[32.6] On behalf of the petitioners, it was also argued that though public notice under Order I rule 8 CPC in two newspapers was published in Tanmoy Nath's case but as the petitioners were recruited following a different Recruitment Policy, they were not concerned with said public notice but such a plea is also incomprehensible in view of the discussions made above. If, despite such public notice, they did not deem it necessary to contest said writ petitions, the decisions rendered therein are obviously binding on them now. [32.7] As to the claim of the petitioners, regarding the inapplicability of Recruitment Policy of 2003, it has also been argued that the Recruitment Policy of 2003 was not published in the advertisements issued by the State respondents and even in the appointment order of the petitioners also there was no mention of any such policy and therefore, said policy was not applicable in the cases of the present petitioners. Moreover, existence of said policy itself was questionable. It is also argued that said policy was issued under the nomenclature „memorandum‟ and therefore, it was a draft policy and not the final policy decision of the Government, and further that said policy was also not published by the Government for general information. Answer to the above said challenges, firstly, is that challenge to said Recruitment Policy of 2003 was the subject matter of Tanmoy Nath's case wherein despite issuance of public notice, the petitioners did not appear and participate. Therefore, in a subsequent collateral proceedings they cannot challenge the same inasmuch as the decision of the High Court has reached Page 85 of 96 the finality up to the Apex level. Secondly; that, while deciding Tanmoy Nath's case, the Division Bench of the High Court had taken into consideration the fact that said policy was never published by the State for general information of the public and was an inter-departmental communication and finally, decided that petitioners of that cases had the right to challenge it. The relevant paragraph No.36 of Tanmoy Nath's case is extracted hereunder:
"36. As far as the policy is concerned, despite our specific questions, the State has failed to show that the employment policy was ever published in the gazette. The employment policy was not even referred to in any of the advertisements issued in the year 2002, 2006 and 2009. How can poor unemployed persons be aware of an employment policy which was never made public? It was only an inter-
departmental communication. Therefore, the petitioners cannot be debarred from laying challenge to the revised employment policy."
The contention that the nomenclature was "memorandum" which does not include final decision of the State authority, is too technical to accept. The policy, by whichever name it is referred such as memorandum, notification, office order etc., in fact was implemented by the State while initiating the process of selection of the present petitioners and other similarly situated persons who were recruited following the advertisements issued in the years 2002, 2006 and 2009, therefore, embossing the name „memorandum‟ in the said policy will not make any difference. Moreover, present challenge regarding applicability of 2003 policy in the said selection processes on the ground of its non-publication cannot be reopended in the present writ petitions as the policy has already been declared ultra vires by judicial pronouncement and such pronouncement has already reached finality. Page 86 of 96 [32.8] In Para 127 of Tanmoy Nath's case, it was observed by the Division Bench that the revised employment policy applied to a large category of posts and not merely to the teachers, still all the appointments already made following said policy were saved except those which were under challenge in Tanmoy Nath's case. It was also clarified that the judgment would be applicable prospectively. This way the Court protected the other selection processes of other Departments or even of Education Department unless those were under challenge in Tanmoy Nath's case. It was already discussed earlier that the challenge was made before the High Court in said case only with respect to the selection of Under Graduate, Graduate and Post Graduate Teachers recruited following the advertisements of 2002, 2006 and 2009 and therefore, the appointments of present petitioners and other similarly situated persons were subject matter of challenge in Tanmoy Nath's case. Thus, the claim of the present petitioners regarding protection under the umbrella of paragraph No.127 in Tanmoy Nath's case is also not sustainable. Similarly, the petitioners, though raised the plea that as their services were regularized their selections and appointments were not under challenge in Tanmoy Nath's case, is also not acceptable. [32.9] In paragraph No.121 of Tanmoy Nath's case, it was clearly observed that the selections of those three categories of teachers were totally unfair and were not made in a transparent manner. Most of the clauses of the policy were illegal and unconstitutional and the entire policy was vague, as it did not provide any guideline and consequently the entire selection process was set aside.
Page 87 of 96[32.10] In paragraph No.122 also, the Court concerning the education of small children directed that the teachers whose selections were set aside should continue to function in their present place of posting till 31.12.2014. In fact, this is the initial direction of the Court following which the State re- appointed the petitioners and other similarly situated persons again on ad-hoc basis. Hon‟ble Supreme Court also from time to time extended the said period of such ad-hoc employment till 31.03.2020 as already indicated above. But surprisingly, after termination of their regular services on 31.12.2017, the present petitioners never challenged the same earlier till the present writ petitions are filed by them after 6/7 years of their termination. Even, despite public notice issued in Tanmoy Nath's case, none of them appeared there to contest the same. When thereafter the matter was pending before the Hon‟ble Supreme Court also, they did not try to intervene. Rather, they acquiesced to continue with their ad-hoc appointment without raising any grievance. Therefore the petitions are now hopelessly barred by the principle of delay and laches. Though some of them filed WP(s)(Civil) Nos. 177 of 2024 before the Hon‟ble Supreme Court same was also withdrawn by them on 19.03.2024. Said petition was also filed at a belated stage.
[32.11] Now the challenges of the petitioners on the ground of violation of Article 311 of the Constitution by not following the procedure as provided under CCS (CCA) Rules are being examined. It has been strenuously argued by Mr. AL Saha and Mr. Abheek Saha, learned counsel that termination of the services of the petitioners was without following the provision of Article 311 of the Constitution and the provisions of CCS (CCA) Rules, and therefore, such terminations were illegal and ultra vires. It was also submitted by them Page 88 of 96 that before their termination, no notice was issued to them giving them the opportunity to place their representation and to take proper defence in this regard. These points as raised are totally misconceived and moreover, these were already decided by this Court earlier, at least in two judgments passed by the Benches of higher strength.
[32.12] In fact, the termination of the petitioners from service is nothing but compliance with directions of the High Court and the Hon‟ble Supreme Court. Their termination was not on the ground of any misconduct or any conviction in criminal case. Therefore, there is no applicability of Article 311 of the Constitution or the provisions of CCS (CCA) Rules in the present cases. There were no charges of any misconduct or of commission of any crime by any of them. Therefore, all the decisions as referred to by both Mr. AL Saha and Mr. Abheek Saha, learned counsel in relation to this point of challenge, have no application in the present cases. Article 311(2) specifically mentions the word "charges" and cast a duty on the disciplinary authority to inform the delinquent about the charge and to provide him reasonable opportunity of being heard in respect of those charges. As discussed above, the present cases are not related to any such charge(s) framed against the petitioners.
[32.13] It has been held by judicial pronouncement in Tanmoy Nath's case that the entire selection process itself was unfair and, therefore, such process was set aside. Earlier total 85 nos. of writ petitions were taken up by the Division Bench of this Court under the title "Sri Bijoy Krishna Saha and others vs. the State of Tripura and others, [WP(C) 1040 of 2019 decided analogously with 84 other cases on 03.10.2019]" wherein similarly situtated Page 89 of 96 persons like present petitioners whose services were also terminated, challenged such termination, inter alia, on the ground that they were not party in Tanmoy Nath's case; that their services were protected in view of the observation made in Para 127 of the said judgment; that notice published under Order I rule 8, CPC in Tanmoy Nath's case was not binding on them; and that no notice was issued to them before their termination. The Division Bench of the Court dismissed said writ petitions as being devoid of merit. The relevant paragraphs No.16 to 20 containing discussions and findings of the Division Bench, are relevantly extracted hereunder:
"16. The core issue which arises for consideration is as to whether the instant writ petitioner(s) can be allowed to reopen the issues decided by this Court in Tanmay Nath (supra), as affirmed by the Apex Court vide order dated 29.03.2017 on the ground that; (a) this termination is illegal on account of violation of principles of natural justice, inasmuch as no notice stood issued to them, nor were they impleaded as parties to such proceedings; (b) the services of the petitioners stand protected by and in terms of the directions contained in para-127 of the very judgment; (c) whether the impugned memorandum extending the period of services on ad-hoc basis and rejecting the representations should be quashed or not.
17. In WP(C) No.51 of 2014, titled as Tanmoy Nath (supra), the Court vide order dated 06.02.2014 had directed issuance of a public notice since large number of parties (4000) were likely to be affected. Pursuant thereto, notices dated 21.02.2014 were issued in two newspapers namely, Dainik Sambad and Daily Desher Katha respectively.
During the pendency of the hearing, we had called for the record of WP(C) No.208 of 2010, titled as Shri Sudhan Majumder & others vs. The State of Tripura & others, also disposed of with Tanmoy Nath (supra), and noticed that public notice dated 08.12.2010 was issued in the daily newspaper namely "Syandan Patrika" informing the general public of the pendency of the petitions and the Court dealing with the matters with regard to the appointment of graduate teachers. Also there is an order dated 24.11.2010 in C.M. Appl. No.223/2010 in c/w WP(C) No.208 of 2010 to such an effect.

18. As such, at this stage, instant writ petitioners cannot be allowed to reopen the entire issue, purely on the ground of their non-impleadment as parties or non-issuance of notice to them. Who are the petitioners? Are they illiterate rustic villagers, hailing from the most deprived strata of the society having no access to justice, also not knowing its procedures? Most certainly not. They are educated Government employees posted at several places within the State. Can it be said that they were not aware of the proceedings laying challenge to the appointments made with regard to more than 10,000 posts of different categories of teachers appointed by the Government, pursuant to the advertisement issued in the year 2002, 2006 and 2009? The answer obviously lies in the negative and the reason is two- fold. The pendency of the original writ petitions was widely circulated, as we are informed, throughout the State, both in the print and electronic media. So also was its outcome made known. It sent ripples throughout the State. Not only that, prior to rendering of the judgment in Tanmay Nath (supra), this Court had directed issuance of notice to be published in the newspaper, which was also done. To contend that such directions or notice were confined only with respect to certain category of teachers and as such, cannot be construed to be a notice qua other categories is not acceptable. Teachers in Tripura are a close-knit fraternity. They also have a union who has been pursuing the matter at different levels. It is true that in a service matter, principles laid down under Order I Rule 8 of CPC may not apply, but then this Court was dealing with a case where as it stood observed, that the action of the Government was "a cruel joke on the people of Tripura". The entire selection process was held to be absolutely arbitrary, capricious and whimsical. It smacked of nothing less than nepotism and favourism. Prudently, the writ Court thought it fit to issue a general notice and not implead all of the 10,323 selected candidates as party respondents, some of whom, in any case, were before this Court. In a representative capacity, the petitions were considered, argued and decided.
19. Significantly, none of the instant petitioners laid any challenge to the judgment rendered by this Court in Tanmay Nath (supra). Neither did they seek review, nor did they file any appeal. Why so? remains a shrouded secret. With the dismissal of the Special Leave Petition on 29.03.2017, and their appointment conclusively found to be illegal, they ought to have returned home, but for the extensions granted by the Apex Court vide orders dated 14.12.2017 and 01.11.2018 (reproduced supra) [paras-9 & 10]. Even at that point in time, they did not express their concern or raise any protest of violation of principles of natural justice; the issue of their non-impleadment or of the order passed behind Page 91 of 96 their back. It is not that they were sitting in a penance or meditating in the Himalayas, totally cut off from the worldly affairs. Obviously they were waiting in the wings and only when they fell out favour of a lady fortune, inasmuch as time extended by the Apex Court is expiring, and otherwise not having qualified, they took steps, speculative in nature, of having the entire issue reopened by challenging the judgment of this Court in Tanmay Nath (supra). We find their such act and conduct to be absolutely despicable. By raising one false plea after the other, somehow they are just trying to cling to the post, to which they were illegally appointed and thereby scuttle the due process of fresh selection and appointment wrongfully depriving the eligible candidates.
20. Contention that in the absence of the instant petitioners impleaded as parties in the petitions subject matter of Tanmoy Nath (supra), this Court should direct continuance of their appointment, more so, in the light of ratio laid down in Udit Narain Singh Malpaharia (supra), A.M.S. Sushanth (supra), A. Arthur Jeen (supra), K.H. Siraj (supra), Rashmi Mishra (supra), Sadananda Halo (supra), Suresh (supra), Tridip Kumar Dingal (supra), Poonam (supra), Ranjan Kumar (supra), Vijay Kumar Kaul (supra), and Jal Mahal Resorts (supra), is absolutely fallacious. At this point in time, it is not open for the respondents to take such a plea, more so when everyone was made aware of the proceedings pending before this Court, by way of public notice. In the cited decisions, what weighed was interest of an individual and not general public interest, in formulating a policy which was held to be illegal so also appointments made thereunder."
[32.14] Among several writ petitions filed by many other such terminated teachers, in one writ petition bearing No. WP(C) 334 of 2021, a Coordinate Bench of this Court (Single Bench) set aside the memorandum issued by the State Govt. terminating the services of the petitioner(s) of said case on the ground that it was a non-speaking order, and therefore, Court directed the respondents to pass a reasoned and specific order in the subject matter relating to the petitioner. Subsequently, the State filed a review petition against the same in the Court and the said Bench disposed of the said review petition only by clarifying that Government had the liberty to issue a specific Page 92 of 96 and reasoned order to the petitioners regarding their termination. Thereafter, another writ petition bearing No.WP(C) 893 of 2022 was filed similarly challenging the termination of petitioner(s) of that case and another Coordinate Bench (Single Bench) differed with the decision rendered in said WP(C) No.334 of 2021 and referred the matter for decision by the larger Bench. Accordingly, a Full Bench was constituted by Hon‟ble the Chief Justice and the matter was decided in Pranab Deb vs. the State of Tripura and others, WP(C) No.893 of 2022 on 26.09.2023. While deciding the matter, the Full Bench also observed that the services of the petitioners were not terminated on the charges of misconduct and, therefore, Article 311 had no application. The Full Bench further observed that when the Court had directed the State to frame a fresh employment policy and to conduct the fresh selection process after giving age relaxation to the appointees whose services were terminated, it could not be said that the termination orders were suffering from a violation of principles of natural justice. While concluding that there was no reason to interfere with such terminations, the Full Bench further observed the followings in paragraphs No.24 to 27:
"[24] That apart, it is now well settled that "if the mischief played is so widespread and all pervasive, affecting the result so as to make it difficult to pick out the persons who have been unlawfully benefitted or wrongfully deprived of their selection, it will neither be possible nor necessary to issue individual show-cause notice to each selectee. The only way out would be to cancel the whole selection." It is also settled "when the entire selection is stinking, conceived in fraud and delivered in deceit, individual innocence has no place and the entire selection has to be set aside." [Ref: MP State Cooperative Bank Limited, Bhopal Vs. Nanuram Jadhav & Ors, (2007) 8 SCC 264].
[25] Besides, principle of natural justice is not a straightjacket formula. It depends upon various facets in the administration of justice and it is established that there is Page 93 of 96 exception to rules of natural justice. The present case falls within such exception where rules of natural justice would not be applicable because of large scale corruption, favouritism, nepotism and arbitrariness found in the entire selection process. The entire selection process was vitiated by fraud and arbitrariness which has already been declared illegal and appointments of the persons so selected were terminated.
[emphasis supplied] [26] The appointments of the petitioners and other teachers were vitiated from the very inception which resulted in the issuance of their termination orders and in that case, the principles of natural justice were not violated, if no opportunity was given to the employees concerned to have their say in the matter before their appointments were recalled and terminated.
[27] As an upshot of the above discussions and the reasons recorded, we are of the unanimous view that no interference is called for in the impugned orders whereby the services of the petitioners have been terminated. The reference is answered accordingly. The instant writ petition is dismissed with a cost of Rs.25,000/- to be deposited in the Tripura State Legal Services Authority."
(Emphasis underscored) [32.15] As it appears, Mr. AL Saha, learned Counsel himself was the engaged advocate representing the petitioners in that case and these issues as raised in these present writ petitions, are also settled by the Full Bench. Thus, reopening these issues once more is not permissible. Though it is submitted from the side of the petitioners that the decision of the Full Bench has been challenged before the Apex Court, simultaneously, it is also submitted by learned counsel that no stay order has been passed in respect of said judgment.
[32.16] It is also argued on behalf of the petitioners that decisions of Division Bench in Bijoy Krishna Saha (Supra) and of Full Bench in Pranab Deb (supra) do not form res judicata as the present petitioners were not party in those cases. Such submission is also totally unacceptable, for, it is not the Page 94 of 96 principle of res judicata, rather the rule of precedent which is applicable in the present cases. When similar and identical issue(s) is/are decided by a Bench of higher strength, the same is binding on a Bench of lower strength as a matter of judicial discipline.
[32.17] Hon‟ble Supreme Court in Bharat Petroleum Corpn. Ltd. vs. Mumbai Shramik Sangha and others, (2001) 4 SCC 448 observed that a decision of a Constitution Bench of said Court binds a Bench of two learned Judges of that Court and that judicial discipline obliges them to follow it, regardless of their doubts about its correctness. In Royal Orchid Hotels Limited and another vs. G. Jayarama Reddy and others, (2011) 10 SCC 608 also, it has been observed that a Single Bench is bound by the judgment of the Division Bench. Thereafter, in Official Liquidator vs. Dayanand and others, (2008) 10 SCC 1, as a matter of further caution, the following were observed by Hon‟ble Supreme Court:
"90. We are distressed to note that despite several pronouncements on the subject, there is substantial increase in the number of cases involving violation of the basics of judicial discipline. The learned Single Judges and Benches of the High Courts refuse to follow and accept the verdict and law laid down by coordinate and even larger Benches by citing minor difference in the facts as the ground for doing so. Therefore, it has become necessary to reiterate that disrespect to the constitutional ethos and breach of discipline have grave impact on the credibility of judicial institution and encourages chance litigation. It must be remembered that predictability and certainty is an important hallmark of judicial jurisprudence developed in this country in the last six decades and increase in the frequency of conflicting judgments of the superior judiciary will do incalculable harm to the system inasmuch as the courts at the grass roots will not be able to decide as to which of the judgments lay down the correct law and which one should be followed."
Again in Shashikala and others vs. Gangalakshmamma and another, (2015) 9 SCC 150, the Apex Court referred to the decision of Page 95 of 96 Bharat Petroleum Corpn. Ltd. (supra) to the effect that the rule of "judicial discipline and propriety" as well as the theory of precedents, permits only a Bench of the same quorum to question the correctness of the decision by another Bench of coordinate strength upon which the matter can be placed for consideration by a Bench of larger quorum and that a Bench of lesser quorum cannot thus express disagreement with, or question the correctness of, the view of a Bench of a larger quorum. Therefore, the plea that the petitioners were not a party in said two cases and therefore, the same did not form res judicata, is not at all sustainable.
[33] In the light of discussions made in the foregoing paragraphs, it appears that after their termination from services, many of such terminated teachers, either in a group or singly have been trying to reopen the matter as test litigations which have already been decided in Tanmoy Nath's case and affirmed by the Apex Court, on similar and identical grounds which are also later on decided by the Division Bench and Full Bench of this Court. Such attempts are nothing but abuse of process and wastage of valuable time of the Court. Therefore, the writ petitions are required to be dismissed with heavy costs. Anyway, only considering the facts that the petitioners have already lost their jobs and are under mental strain and suffering, minimal costs are being imposed on them.
In the result, all three writ petitions are dismissed being devoid of any merit with costs of Rs.25,000/- (Rupees twenty five thousand) in each case. The petitioners shall deposit said amount of costs to the Tripura State Legal Services Authority (TSLSA). The TSLSA will expend these amounts only on the programmes relating to the welfare and protection of Page 96 of 96 children and for the matters relating to the elimination of drug abuse. With such observations and decisions, the writ petitions are disposed of.
Pending application(s), if any, shall also stand disposed of.
