                                 ORDER

This is first application filed by the applicant under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail in connection with Crime No.239/2021 registered at Police Station - Neemuch Cant, Distt. Neemuch for the offences registered under Sections 420 of the Indian Penal Code. The applicant is in custody since 04.07.2021.

As per prosecution story, the applicant is arrested on the basis of memoraundum prepared under section 27 of the Evidence Act of co-accused Sunil Patidar. This Court in catena of matters has granted bail to similarly situated accused persons.

The prayer is opposed by learned Panel Lawyer for the respondent /State. However, she did not dispute that (i) applicant is the first offender (ii) challan has been filed (iii) in several matters bail granted to the aforesaid accused persons (iv) the applicant has been impleaded only on the basis of memorandum prepared under section 27 of the Evidence Act.

The bail in similar matter was rejected in M.Cr.C. No.39073/2021 (Sarvar Khan v/s The State of Madhya Pradesh) on 11.08.2021. The Apex Court granted bail to Sarvar Khan in SLP (Cri.) No.6523/2021 on 06.09.2021. The conclusion of trial in this pandemic era will take time. Hence, applicant may be enlarged on bail.

Considering the aforesaid and without expressing any opinion upon the merits of the case, I deem it proper to enlarge the applicant on bail. Accordingly, the bail application is allowed.

The applicant is directed to be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety of the like amount to the satisfaction of the trial Court for his regular appearance before the trial Court during trial with a condition that he shall remain present before the Court concerned during trial and shall also abide by the 4 conditions enumerated under Section 437 (3) Criminal Procedure Code, 1973.

It is also observed that if the applicant is found to be involved in any criminal activities, after his release on bail, then the present bail order shall stand cancelled without further reference to the Court and the State / prosecution will be free to arrest the accused in the present case also. This order shall be effective till the end of the trial, however, in case of bail jump, it shall become ineffective.
