Procedure when only the defendant appears - If on such day, only the defendant appears the Deputy Commissioner shall dismiss the suit unless the defendant admits the claim or part thereof in which case the Deputy Commissioner shall pass a decree against the defendant upon such admission without costs and where part only of the claim has been admitted shall dismiss the suit so far as it relates to the remainder:
Provided that such decree if there be more than one defendant, shall be only against the defendant who makes the admission.
