CRIMINAL PETITION NO.7184 OF 2021
ORDER:
This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C") is filed seeking quash of the proceedings in C.C.No.989 of 2020 on the file of the Court of 1st Additional Judicial Magistrate of First Class, YSR Kadapa District registered for the offences under Sections 188, 272,273, 188 read with 34 of IPC and Sections 5 and 22 of COTPA-2003.
2. Heard learned counsel for the petitioners and the learned Additional Public Prosecutor for the State.
3. Learned counsel for the petitioners would submit that this is a covered matter and this Court has earlier quashed the F.I.Rs and charge sheets registered for the similar offences based on identical facts. Therefore, they would submit that the petitioners, who are similarly placed, are also entitled for quash of the F.I.Rs and charge sheets registered against them.
4. Learned Additional Public Prosecutor would fairly concede that this is a covered matter in view of the earlier orders of this Court and thereby prayed to pass appropriate orders accordingly.
5. As can be seen from the copy of the common order produced by the petitioners in Criminal Petition No.1432 of 2020 2 and batch, it is clear that this Court has quashed the F.I.Rs registered in various police stations for the offences punishable under sections 188, 270, 273 r/w 34 IPC.
6. Therefore, in view of the aforesaid order of this Court and for the reasons stated therein, this Criminal Petition is allowed and the F.I.R and the charge sheet registered against the petitioners herein, are hereby quashed.
Miscellaneous petitions, if any pending, in this Criminal Petition, shall stand closed.
