Section 16(1) in The U.P. Electricity Regulatory Commission (Captive and Non-Conventional Energy Generating Plants) Regulations, 2009
(1)A Captive Power plant shall not be liable to pay surcharge over and above transmission and/or wheeling charges for carrying the generated electricity from its plant to the destination of its own use or for the use of its members, as prescribed under the Act:Provided that in case of supply of power to a consumer or to a person other than its members, such consumer or person shall pay surcharge over and above transmission and w heeling charges as determined by the Commission.
