Heard learned counsels for the respective parties.
2. In the present LPAs, the appellant - State as well as
University assailed the order of the learned Single Judge dated
16.09.2019in a bunch of petitions. The lead case is Mithilesh Kumar Singh and others vs. The State of Bihar and others vide CWJC No. 12657 of 2017. The matter was heard from time to time and on 23.03.2023, following order was passed:
"Matter heard at length.
Core issue involved in these bunch of petitions are service condition of 129 non-teaching staff in various institutions under the Vir Kunwar Singh University. It is reliably learnt that they were appointed during the intervening period from the year 1978 to 2011 by the respective college principal. They had grievance of regularization, at that stage, State Government and University must have taken note of various provisions of the Bihar University Act, 1976 insofar as appointment of staff to various colleges. In terms of sub-Section Patna High Court L.P.A No.1467 of 2019 dt.13-04-2023 36/42 6 of Section 10 read with Section 35, the competent authority to appoint Class III and Class IV employees is vested with the Vice Chancellor. On the other hand, 129 persons were appointed by the Principal. This issue was taken note of for the first time in the year 2017. In the meanwhile, University has already taken decision to regularize the services of 129 employees and further they have been extended monetary benefits from time to time for more than three years. In this backdrop, the University is stated to have forwarded approval of regularization decision by the University and it is learnt that it is pending consideration or rejected. According to the learned counsel for the State it has been rejected. On the other hand, University counsel submitted that such approval of the Government is still pending consideration before State Government. In the light of these facts and circumstances, Registrar, Vir Kunwar Singh University and Principal Secretary, Education Department who is handling the University matters are hereby directed to appear in person with concerned file and records.
In the meantime, respondent officials are hereby directed to take note of that once the order of regularization has been ordered, status of such of those employees whose services were regularized would be permanent employees of the respective colleges/University. Therefore, before taking any adverse action against such of those permanent employees after their regularization, they have to resort appropriate proceedings under the relevant provisions of law.
Further, 129 employees were working during the year 1978 to 2011 from various dates and they have served University for more than three decades and it is also learnt that some of them have already attained age of superannuation, therefore, State Government may take note of Hon'ble Apex Court decision in the case of Secy., State of Karnataka and Patna High Court L.P.A No.1467 of 2019 dt.13-04-2023 37/42 Others vs. Uma Devi reported in (2006) 4 SCC page 1 read with State of Karnataka vs. M.L. Kesari and Others reported in (2010) 9 SCC 247 and approve the regularization in the event of non-approval of the State Government.
It is also to be noted that termination of 129 employees on 29.06.2019 with reference to their initial appointment in the year 1978 to 2011 would be too harsh, that too when the University has extracted work from these 129 employees and suddenly discontinuing from service after 30 years from the date of their initial appointment in the year 1978 to 1982.
Re-list this matter on 13.04.2023.
Copy of this order shall be provided to the Principal Secretary of the Education Department and Registrar, Vir Kunwar Singh University through their respective counsel."
3. Today Mr. Dipak Kumar Singh, Additional Chief Secretary, Department of Education, Government of Bihar and so also Registrar, Prof. Ranvijay Kumar, Acting Registrar, Veer Kunwar Singh University (hereinafter referred to as 'University') are present in the Court.

Additional Chief Secretary assisted this Court stating that initial appointment of the contesting respondents is not in accordance with law and further submitted that there was a General Circular issued by the State Government addressing to the respective University on 17.11.1998 as to how to take note of material information for the purpose of regularization of ad hoc Patna High Court L.P.A No.1467 of 2019 dt.13-04-2023 38/42 employees who were working in the respective University. The same was violated by the University. Therefore, further action insofar as regularization of contesting respondents during the intervening period from the year 2011 and 2012 is contrary to the State policy decision dated 17.11.1998.

It is further stated that after regularization of services of the contesting respondents in the year 2011 - 2012, the University never requested the State Government for its approval, therefore, rightly the State Government has taken action in nullifying the regularization of 129 employees while terminating their services on various dates which was subject matter of CWJC No. 12657 of 2017 and connected matters.

The University Registrar and his counsel are relying on some of the documents like Annexure - C to the counter affidavit filed with CWJC No. 12657 of 2017 on behalf of respondent Nos. 4, 5 and 6 which reveals some communications. However, it is not in a specific wording that approval of regularized employees were sought by the University. At the same time, the State official of the concerned State department should have sought clarification from the University to the extent that what was the object of furnishing or informing the department insofar as regularization of such of those persons whose services Patna High Court L.P.A No.1467 of 2019 dt.13-04-2023 39/42 have been regularized. In other words, there is a lack of communication among the University and the State Government.

At this stage, it is necessary to take note of as to how the University audit was not undertaken from time to time so as to catch hold at a particular stage how the funds are misused by the University like funds are utilized for regularized University employees etc. In this regard also, State has not bothered to verify as to whether time to time audit of the University has been undertaken by the competent authority and further reports have been submitted to the State Government for taking any action or not?
8. It is to be noted that contesting respondents were appointed on different dates from the year 1978 to 1993 as is evident from one of the charts furnished by the University. Further, it is noticed that out of 129 employees, 54 of them have already attained age of superannuation and retired from service, 15 of them had already died and legal heirs of such of those employees were brought on record and remaining 60 employees are still in service. On behalf of University, it is submitted that few of them are due for retirement. In the light of these facts and circumstances, whatever the financial burden due to regularization from the year 2011 - 2012 till date, the University has to take Patna High Court L.P.A No.1467 of 2019 dt.13-04-2023 40/42 financial burden. Insofar as retired persons and such of those employees who have died, their financial benefits should be meted out by the State Government from the date of their retirement or from the date of death, till then University shall bear the finances. For remaining 60 employees who are all still in service, the University shall take the financial burden till date and for future State Government will take burden.
9. The financial benefits shall be calculated and disbursed by the University insofar as in-service candidates (if any arrears were required to be paid). Similarly, such of those retired and such of those employees died, their monetary benefits shall be calculated by the respective State as well as University with reference to the observation made supra, the same shall be paid to the respective parties. If any of the employee or retired employee or employee who have died are not entitled, respective parties like State and University must pass a detailed speaking order as to why they are not entitled to any monetary benefits (arrears). In this regard, order shall be passed and communicated to the respective parties.
10. To this extent, order of the learned Single Judge dated 16.09.2019 is modified. Accordingly, present L.P.A. is allowed in part.

11. Pending I.A.(s), if any, stand disposed of.
12. If any office objections are yet to be complied, the same is ignored since we have disposed of all these LPAs.
13. At this stage, learned counsel for the University submitted that from time to time budget allocation was granted by the State. In the guise of implementation of the present order, there may be certain hurdle to the extent that State may not allocate budget. Such issue could be resolved by the Government and University for the reasons that there were inaction on behalf of the University in not taking note of Government specific Circular dated 17.11.1998 before undertaking exercise of regularization of 129 employees during the year 2011 - 2012. At the same time, State Government has not apprised this Court as to how the budget has been allocated in the absence of material information i.e. whether 129 employees, their appointments and regularization was in order or not at the relevant period. Further there may be error insofar as audit of the University undertaken during the intervening period from the year 2011 - 2012 to year 2015 - 2016. Further, the State Government department as well as University are not in a position to apprise this Court whether allocation of budget from the year 2016 and till date has been allocated while covering 129 employees or not, therefore, the Government and Patna High Court L.P.A No.1467 of 2019 dt.13-04-2023 42/42 University should resolve the issue in order to overcome the hardship of the 129 employees. If there is a difference of opinion among the State Government and University, that does not result in hardship to 129 employees. State being a model employer must take special interest in order to resolve if there are any shortcoming insofar as allocation of budget.
